    • Thank-you dx, What you have written is certainly helpful to my understanding. The only thing I would say, what I found to be most worrying and led me to start this discussion is, I believe the judge did not merely admonish the defendant in the case in question, but used that point to dismiss the case in the claimants favour. To me, and I don't have your experience or knowledge, that is somewhat troubling. Again, the caveat being that we don't know exactly what went on but I think we can infer the reason for the judgement. Thank-you for your feedback. EDIT: I guess that the case I refer to is only one case and it may never happen again and the strategy not to appeal is still the best strategy even in this event, but I really did find the outcome of that case, not only extremely annoying but also worrying. Let's hope other judges are not quite so narrow minded and don't get fixated on one particular issue as FTMDave alluded to.

    • the claimant in their WS can refer to whatever previous CC judgements they like, as we do in our WS's, but CC judgements do not set a legal precedence. however, they do often refer to judgements like Bevis, those cases do created a precedence as they were court of appeal rulings. as for if the defendant, prior to the raising of a claim, dobbed themselves in as the driver in writing during any appeal to the PPC, i don't think we've seen one case whereby the claimant referred to such in their WS.. ?? but they certainly typically include said appeal letters in their exhibits. i certainly dont think it's a good idea to 'remind' them of such at the defence stage, even if the defendant did admit such in a written appeal. i would further go as far to say, that could be even more damaging to the whole case than a judge admonishing a defendant for not appealing to the PPC in the 1st place. it sort of blows the defendant out the water before the judge reads anything else. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

My first post, so I say 'Hey', I plan to hang around. Secondly, I apologise if this has been covered before, but if anyone can give me some information or this it would be greatly appreciated.

 

I started claiming JSA 5 weeks ago after becoming redundant.

 

JSA agreement was fine and my signing on days usually went fine, the adviser pleasant enough where they print off vacancies. 4 weeks ago I went into sign on and received 6 jobs to apply for. 2 weeks later, I return and the adviser asks me individually about each job and told them that I did apply for them all baring one, which I forgot and must have misplaced the print out as the job didn't ring a bell.

 

Roll on a week later, I received a ES195REJP asking me why I refused employment/applied for a job.

I have now replied on that form about misplacing the paper awaiting the outcome of this decision - which I have mentally prepared will be returned with a sanction.

 

I have set up a file on my e-mail of all jobs that I have I applied for over the past few weeks after hearing this. My JSA agreement was to apply for 6 jobs a week and I'm on average applying for at leas 2 or 3 jobs a day and have evidence in this folder. I also contacted the employer regarding the job I did not apply for asking if it is possible to still apply, but was told the position is now filled.

 

This is my first 'offence' as such and fully expect to be penalised for this and will take my medicine but I feel frustrated at this as I am everyday spending 2-3 hrs a day looking for work and I wonder if I had just said 'Yeah, not heard anything back'. I wouldn't be in this pickle.

 

Sorry I am rambling, but main queries are

-How long likely would a sanction be and would this inbox full of 'evidence' of jobs and such, help such an appeal if I am facing a long period of no payment.

 

I moved back to my folks house a few weeks back since I became unemployed so I am grateful to have a roof under my head, and plan to hopefully move out if I find a job asap.

It won't matter if it's your first or 10th offence, they will be looking at the reasons why you failed to apply for the vacancy in question.

If the closing date was prior to 22nd October then you could be looking at a sanction between 2 and 26 weeks and if it was after 22nd October you could be facing anything between 2 and 26 weeks for the sanction.

Thanks for your reply. I replied stating I must have misplaced it so I suppose I am in for it, by being honest

 

I'm hoping that with a print out of emails and applications sent out that the sanction is a small one, but not holding my breath and take this as far as I can.

 

I know I've done wrong but it was an honest mistake, and I am contacting employers and completing job application forms every single day trying to find employment.

 

Heading in on Friday to the jobcente for a signing on day.

yep its an unfortunate position to be in...honesty these days are not the best policy...as it can seriously damage your 'wealth'

as above the new sanctions are draconian in nature, and are being applied with impunity im afraid.....hope it all goes well for you...and good luck with the job search....

Hi bialoman,

 

good luck with this. From my limited experience of signing on (after a number of years in employment) it would seem that you may just be unlucky with your 'job advisor' as well. I have signed on with one or two different advisors - one or two are reasonable enough - but there is also my 'regular' advisor who seems super keen just to get me off claiming the JSA benefit..... full stop. Like I am happy to be on £71 a week (no HB payments) rather than a full time wage!

 

I also got a redundancy payment which will tide me over for a few months. I feel really sorry for those who are up against it financially and have to contend with the 'attitude' of some advisors, which could cost them weeks/months in lost benefits due to the new sanctions that are now in place. I can't wait to get back to full-time work.

Thanks, Lorraine. I agree though, it's almost pot luck on who you get. I signed on about 4 years ago for 2 months and my adviser then was so snotty and ignorant and treated me like a child. I was always told to turn up 10 mins before and often I would be kept waiting for 15-20 mins to sign on, yet as soon as you are 1 minute late, they are on your case.

 

I'm just back from the jobcentre. My adviser is helpful and friendly. When I asked her about it and what type of penalty I would receive she mentioned that as its a first offence and that she can tell I am working hard to find employment that it would ''hopefully be a week or two at the very most, if sanctioned''.

I'll just have to wait and see what happens over the next few days through the mail. If it is a 2 week fine/sanction, I would probably just accept it but any longer then I will fight it as it was a mistake, I was never informed I had to apply for every job printed out and I have proof that I am applying for jobs every single day.

 

Hope you are doing ok too and we both find something soon. :) I too am dying to get back out there. I've just put my name down to volunteer in the charity shop on a Tuesday and Thursday and looking forward to that and keeping myself busy.

So I received a letter from the Jobcentre today ;

 

''A doubt has arisen in your claim for JSA bla bla.....

A decision will be made if JSA will be affected and will be notified asap, etc etc''

They also enclosed a ESL 48 (a guidance form with info on how/what may be affected and what to do if I am sanctioned etc).

 

I made up a letter to either use as an appeal or send in earlier detailing how I've tried to apply for the position that I forgot to apply for, proof of applications during that period that I sent via e-mail and online and how I am actively seeking work.

I fully expect a sanction, but I hope with proof of jobseeking and a letter of explanation, I may get it reduced to a smaller time frame.

 

Would it be best to hang off to hear their outcome? Or hand in my appeal letter on Monday to the JC office?

 

Does anyone have recent experience of this? Or fighting it in similar circumstances.

 

I'm so fed up of this already and it's not even a week long and I'm yet to hear the outcome. I know it's my mistake for being careless and I should have been more careful to not misplace the printout.

My money from signing on Friday has now gone in which I wasn't expecting at all considering the letter I received on Saturday(A decision will be made if JSA will be affected, etc).

Well, I got the letter today. Some near on 3 weeks since the original, so I can only imagine how long this appeal will now take, but anyhoos.

 

''We have now decided you have failed to apply for this employment and you didn't have good reasons etc etc. This decision applies from 8 December 2012 to 4 January 2013.''

 

Then it mentions hardship payments (but doesn't state if this a loan, or how you apply for this?

 

It also then says ''We cannot pay you JSA from 5 Jan 2013 or been credited with, enough Class 1 N.I contributions''.

 

Again, I can't thank you all enough for your help in this, but if anyone could answer a couple of questions I would be very grateful

 

1. Is a hardship payment a loan, as in would you have to pay it back?

2.Although I'm getting penalised for a month, my allowance will not be extended after the 5th due to not enough NI contributions. Are there any other benefits that anyone knows of that I could attempt to apply for?

 

I'm away to print of the appeal form and send it back today to their office (I expect this will take weeks and with it being Christmas soon, possibly longer) but does anyone have any experience of appealing? I had an idea of sending in prints of my 'Jobsearch' section I have in my 'Inbox' of all the jobs that I have applied for as backing documents and my arguments for appealing.

In order to claim hardship you will also need to make the application to determine if you woul be entitled to Income Based JSA you do this on form JSA3.

Hardship is not a loan it is a payment in lieu of JSA and is reduced by either 20% or 40%.

You will need to read the notes part of the JSA10JP application form carefully and provide any devidence it states is required to detrmine if your application can be accepted to be considered.

You can submit your additional information showing all the other jobsearch you conducted however as you didn't apply for the one specified vacancy unless you can show that you did apply for that one it won't change the decision sorry. When you submit the appeal it will automatically be referred for a reconsideration.

You can collect the JSA and JSA10 from your JCP office.

I managed to get through to the local jobcentre, they have sent out a JSA10 form for hardship payments.

I appealed the decision, not expecting a reversal, but see how it goes.

I had a sanction applied and got it reversed so with a good argument it is possible.

 

In my case, I was looking for IT support jobs, my jobseeker agreement had some stuff on from years back about admin jobs, an admin job was mentioned to me but it wasnt really admin, it had something to do with test firing weapons at the MOD base at Shoeburyness, anyway this job wasnt ITSupport, it wasnt even Admin so i didnt apply, also I was not informed during the interview that I had to apply,. it was just mentioned in passiung, my letter to JC was very angry and I pointed out all these facts and no sanction was applied.

 

As mentioned honesty isnt always the best policy you must play them at their own game, dont give them any reason to doubt, personally I'd say I had applied and quickly fire off a letter. In my last job search I was applying for sometimes 100 a week so could never keep track.

 

Please to say Im in temp job at the mo with new perm one starting in Jan :)

Interesting how the DWP harasses its victims:

Jobcentre Plus decided that, before they would implement the tribunal’s decision, they needed evidence of how he had supported himself while they had not been paying him.

 

So, first they take your benefits away, then they want to know how you support yourself without the benefits.

Crazy isn't san_d?

 

I live 8 miles outside of my local jobcentre office and I am currently on a 4 week sanction. I'd like to know how they expect me to travel in when I have no money coming in. I have a huge interest in exercise and run/cycle/walk regularly but even a 16 mile route in the current weather would be too much.

 

It's pot luck it seems. I've learned a lesson from all this and not a good or honest one and that is do not tell the truth!

What I don't understand is how the Job Centre can prove they gave you details of the position. Do they keep logs of what was printed off? From my perspective, your adviser asked if you applied for a job you didn't know existed.

 

I would argue you weren't actually told about the vacancy until it was too late to apply for it, and ask them to prove otherwise.
