    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The bank cannot refuse to chargeback the account if it is an unauthorised transaction. Barclays seem to think they are above the law. Especially with their recent media coverage.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

The company ccm deny all knowledge of lasker and also deny having connection with them

 

Once is a coincidence, 3 times is very unlikely to be a coincidence, I've posted 3 different directories earlier linking one of the registered directors of ccm to Lasker, here is a fourth directory linking the other director of ccm to lasker:

More like ccm are using lasker to obtain the money and fein innocence. Pdl's aren't well known for playing by the rules. I'd like someone to get in writing from ccm that they have no connection to lasker. Because then they'll either admit they do, or send out a letter that could bite them on the whatsits

I think thats a bug ask you can barely get any sense out of them on the phone - there is absolutely no way they will put it in writing ... The only think is if the fraud dept of the bank r looking into it they will find out ccm are denying knowledge so that has to work in our favour

Yeah, that particular company reg actually is still active, there is a whole pile of dissolved ones at the same addresses with the name Lasker as well though which threw us off the track.

I would ignore the proposal to strike off for now.

 

However the links between CCM and Lasker are thickening, I've posted about the tracingagents.com website before which was registered by Simon Taylor at one of the addresses for Lasker.

 

Well, there is another website: http://www.celebritysecurity.co.uk agai they say on the website they are Lasker and link to lasker.co.uk, the domain http://www.celebritysecurity.co.uk was registered again by simon Taylor, this time however with the address:

PO Box 480-1208

Sevenoaks

TN13 9JY

 

Sevenoaks? yes, that is where CCM is registered... unfortunately its a po box, but I'll have the info who owns it tomorrow.

The plot is defnitely thickening. Im getting no sense in my head now except that my money is gone and im hoping it comes back.

 

 

So what i can gather is that its this Richard Howlett and Simon Taylor who are actually responsible for illegaly taking our money.

 

They are taking it through CCM but actually making it look like it has gone to another company so as to keep the trace of them.

 

Do they actually think people cant work out who they are. Though they are probably thinking banks wont bother looking into it too much so they have the money now and dont care.

There is still hope for your money, you just have to remind the Bank about the law until they budge, or if that fails, complain about the Bank to fos, oft, trading standards, watchdog and so on.

 

The Bank has to refund you money that was taken in a transaction you did not authorize.

 

They can run but they can not hide, got loads more info on those folks, unlike PDL Companies I happen to know a little word called morals, so I'll refrain from publishing private pictures, home addresses, private emails and so on.

Im hopeful that the bank will do as they said and refund the money for me.

 

They did say they would then have to investigate this so could then take the money back.

 

If they do take it back after refunding then they will be getting a letter and i will be reporting them to whoever i have to and i will be telling them that in complaint letter.

 

I did not authorise these transactions nor do i know the company who took them so at end of day despite what bank seem to think it is blatant fraud.

 

Im so annoyed though that this richard howlett and simon taylor seem to be getting away with this.

If they get away with it will largely depend on the Bank, if the Bank actually does a proper investigation and finds fraud and reports it to the police then it could very well end up as time behind bares for the ones that took the money, but all too often if Banks do a refund they just write the money off instead of investigating.

Its the same for me. Though im panicking a bit about the money part as well now.

 

 

It may only be £85 but as i said earlier in the thread its like a million pound to me at this minute in time with all im trying to juggle about.

 

The more i think about it the more furious i am.

 

Santander said it takes 48 working hours so would be tuesday before the refund shows in my account.

 

Did they tell you the same or has your refund shown yet?

I've been on the phone with CCM this morning. They have admitted that this is their error and that monies have been processed incorrectly. They have admitted that they have taken more from me than I even owed them in the first place. Send all details, to collections (at) capitalcm.co.uk if your bank doesn't do the refund for you. I spoke with David.

My bank won't do ****. I called them twice yesterday and both times they wouldn't set-up a dispute. CCM are obviously aware this has happened so just request a refund from them and we'll take it from there.

I dont think for a second that CCM will refund me. In fact i would bet my life they wont.

 

 

I spoke to them just now and they said i need to put any refund request in writing. They will do nothing with it as they will see it as money coming off what i owe.

 

 

My bank probably wont refund now either as they will contact lasker who will say it is capital taking the money and my bank will then see that i made a debit card payment to capital and will not refund me id imagine.

 

I think i have just lost my money. I could cry im that frustrated

Your bank cant not set up a dispute. If you inform them that it was an unauthorised transaction they are required to do so. Perhaps speak to your local police and get a crime number to force them to get the ball moving.

I will do that tomorrow defnitely if the bank do not refund. Tomorrow is when they told me i would have the refund so im hoping it will show up.

 

If they then investigate and take the money back from me i will contact the police and will then send letters to my bank and to capital with the crime reference number so that someone takes me seriously.

 

 

I am still hoping that my refund will come tomorrow and then let the bank work away

If you do get the refund, can i advise that you switch banks asap. Then make a full and formal complaint to every regulator you can find.

 

If the money goes into your bank, open up a new account with a different banking group and get the money switched over. Then if the previous bank decides to take it back, thats their problem.

 

Also note that some police stations front desks are manned by civilian support officers. They have very little knowledge of the law. If you get pushed back by them when/if you file a complaint, make sure you ask to speak to a senior duty sergeant or even the Superintendant.
