Tide no offence but my daughter will NOT be having a blue football shirt.

Well JC not everyone can have such good taste in football and support liverpool. That is my opinion. I also think someone has to support these other teams as if not they would look very stupid.

Hi Stephen, good to see you still here and working hard xx

I am a little confused by the benefits/charges situation.

I thought that banks could not take charges from benefits because the money comes from; and belongs to, to state.

This is what I have been telling service users where I work, who have used this line and got their charges back. All of them have succeeded in the end. Some straight away with a phone call, others needing to write in. I do tell them it is better to make the letter a personal one rather than use the formal letters I have seen, as the formal letters don't seem to swing it for them.

So, is it the fact they write and give their circumstances (homeless, extreme hardship etc) that wins for them rather than the money ought not to have been taken in the first place?

And those that win with a phone call, would that be because the bank worker isn't sure, but because of the confidence in which they (the service user)speak the bank worker believe what is being said?

Some people have succeeded in getting back charges using these Acts but there is no real basis for doing so. If it went to court, they would definitely lose.

Hi everyone, currently arguing with yorkshire. Sent all the necessary letters only to be told that their legal department cannot find the social security or tax credit act. Sent them another letter with the case mentioned in the scottish law courts only to get a reply from their legal department saying that this applies in Scotland and not in Wales. Does anyone know where I can find the act or where I can find a case that has been won in England or Wales. The will not be able to deny this. Thanks

You will find the two cases here and here - however, you wil not find a case where anyone has won bank charges back in court based on either of these acts because they do not apply to bank charges, as explained in the link in post #810.

I hope someone can advise.

 

I have had over £400 taken out of my Nasywest account, all benefits.

I took the advice here and filled in a customer financial statement form. I am left with £3.00 a fortnight to live on. Natwest say I do not come under the financial hardship category.

Where can I go from here? I have stopped all my direct debts and have my benefits paid into the post office now so I do not get caught for anymore charges.

Any advice to where I go from here please?

Money help, if you start your own thread someone will come along to help as this one tends to get used for general benefit stuff and quick questions and answers.

If the bank won't help with refunding then you will have to go the long route of claiming them back, starting with a list of all the charges (dates and amounts) and writing an S.A.R. This will probably take some time at the moment although some banks are still paying out.

You've done the right thing getting money into P.O. account.

i am on

carers allwance, income support and DLA. on my bank statemens it has my NI with dwp at the end.

 

and back in round oct 06, by bank hsbc took most of it.

 

was the bank Legally allowed to do that?

 

after this happend my bank give me a overdraft of £500, now that has gone up to 1K

 

after reading about all the posts about benfits beeing taken can the banks take your benfit money or not.

 

it is very confusing reading all the posts about this matter

The bank thinks so.

 

You will have to do what we are suggesting others do - open a basic account or post office account and have your benefits paid there to stop your bank getting their greedy hands on them. Then start the process of reclaiming charges in the normal way. You won't get them back for a while but you will eventually, and you should get interest as well from the date you start the process at least.

Advantage of using ours is that hopefully it should reduce the time to be dealt with.

Please see my thread- Natwest followed my prelim with a nasty letter and an I&E form.

 

The letter said even if they do find hardship they may not pay back charges and may take debit card and facilities from account.

 

And they want a full list of my assets (including house/equity) and liabilities- even though I don't owe them anything. I have completed and sent off- we'll see what happens.

If it can be shown that the banks are manipulating or breaching terms of the waiver-or intimidating claimants because they want reclaims then the FOS will take a dim view simple as.The reasons they are getting away with these tacs is because very few are complaining.
