    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hey all my nan wants to re-write her will and i have just seen an offer on WOWCHER offering a will writing service for £19 from a company called WSL limited?

 

how can i find out if there legit?

They appear to be a genuine company, but from limited search online, appear to have mixed reviews.

 

Your nan would be better off seeing a local solicitor and getting her will drawn up properly.

 

My experience with an elderely relative, is that various companies offer will writing services, but they don't appear to properly look after the interests of the person they are dealing with. An aunt of mine already had a will drawn up by her solicitor she had dealt with for years. But somehow, her bank talked her into getting a new will, when she was a bit confused. Anyway she later realised this and her solicitor had to deal with it.

 

My instincts are that this company are unlikely to spend much time dealing with issuing the will or they will be wanting to charge more.

We could do with some help from you.

Unless the will is very very strightforward will writing companies are not the way to go, please use a local solicitor or if its that easy a DIY form would be just as good as a company only charging 19.99.

Actually I expect the true cost will be more as there are extras that they will find, false economy IMO

i thought as much, yes its a simple will she knows what she wants to leave ect,

 

we had a couple of quotes but they all want £80+ and my nan is only a pensioner, are the D.I.Y wills legal and legit??

Yes as long as they are clear (no trusts or anything) and they must be properly witnessed by two people who are not the benificiaries, simple form can be obtained from any high street stationer.

Given what you say about the stepson, I think it's worth paying for professional advice. The cost of having a will challenged [if that happens] is going to be far more than paying to have a well-drafted will at outset.

 

Just my view. :)

My mum used a will writer instead of a lawyer at the instigation of her second husband.

I have been involved in a legal battle since her death .

Part of the case is because a will writer didn't do something, which if they had used a lawyer he would have been obliged by law to do , but a will writer is not obliged to do.

Please be very careful.

It may be a 'false economy' to skip on proper legal advice at this stage - and could save a lot of heartache and family problems as well as money to get proper advice now instead of leaving grieving loved ones dealing with the additional shock of a will which doesn't do what it was supposed to.
