I need to take debtor to small claims court for missed payments. Only address I have is "care of"

(debtor says all correspondence can be sent here).

Does anyone know if it's possible to get "care of" forwarder to release forwarding address?

Can I get a court order if I need to?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If the person resides at the " Care Of " then its acceptable that is the place of residence.Summons are not sent out recorded or sign for so It will be assumed that service is good.

 

 

CPR 6

Methods of service

 

6.3

 

(1) A claim form may (subject to Section IV of this Part and the rules in this Section relating to service out of the jurisdiction on solicitors, European Lawyers and parties) be served by any of the following methods –

(a) personal service in accordance with rule 6.5;

 

(b) first class post, document exchange or other service which provides for delivery on the next business day, in accordance with Practice Direction 6A;

 

© leaving it at a place specified in rule 6.7, 6.8, 6.9 or 6.10;

 

(d) fax or other means of electronic communication in accordance with Practice Direction 6A; or

 

(e) any method authorised by the court under rule 6.15.
