PCN for parking adjacent to dropped kerb

Help!!

just received a fine for parking adjacent to a dropped kerb (contravention code 27).

 

The dropped kerb had access to a 6ft fence!!!! In fact the dropped kerb was quite random on a long stretch of road with no real reason for being there!!!

If it was for pedestrian access I have read on a similar thread that a dropped kerb for pedestrian access is only offical if there is a matching dropped kerb on the opposite side of the road?

 

Any advice for a worthy appeal???? Cheers:mad2: So annoying!!!!

Generally you are correct that the dropped kerb should match one opposite for wheelchair access etc. It sounds like it is an historic vehicle access perhaps to a factory or something and the CEO has been overzealous. Can you give us a street location so we can view it in google streetview, it should make more sense then to the council parking experts

The council should be put to strict proof as to the reasons why this dropped kerb is in situ.

 

(a)the footway, cycle track or verge has been lowered to meet the level of the carriageway for the purpose of—

 

(i)assisting pedestrians crossing the carriageway,

 

(ii)assisting cyclists entering or leaving the carriageway, or

 

(iii)assisting vehicles entering or leaving the carriageway across the footway, cycle track or verge;

A dropped kerb in the middle of "nowhere" still allows a wheelchair user to access the pavement if they are parked in the road - especially on a long, straight road without any other access to the pavement.

Agreed re Highway Code Rule 243 as partly cited. Can we know the council, streetview and see the PCN, please? Less personal details, VRM etc to identify you.
