ive had £1300 paid into my bank account by an employer i used to work for about 6 month's ago

 

 

 

 

i received a letter today telling me to return the fund's!

 

 

but ive spend some of the money

 

 

thinking it was my ppi claim,

 

 

where do i stand with this,

 

 

i don't know what to do?

So

The your old employer has paid into your account and they have decided to use a debt recovery company to claim

Back the money

Very naughty

I would definitely write a letter to the original employer and offer them a small amount on a weekly basis

Let's get it straight it's there mistake not yours!!!!

well as I see it its THEIR mistake not yours , obviously it needs to be repaid but on your terms not theirs . As long as you agree a reasonable/affordable repayment plan I don't think there is much they can do . So there you go , an interest free loan .

So your employer made an error and made a substantial payment into your bank account. Bit foolish of him.. He then waits 6 months and instead of requesting you to repay it.. he hires in a group of thugs.

 

Meanwhile, knowing that you are due a refund of Payment Protection Insurance monies and believing this money to be it.. you have spent all or some of the money your ex employer has "given" you ?

 

Are you therefore still waiting on the PPI refund?

 

In the circumstances, I would deal only with the ex employer.

 

Send letter explaining what has happened from your side of things. You are, I assume able to repay what you havent spent in a first payment. Then when you receive your refund of PPI you can then repay the balance.

Entirely up to you of course but personally I wouldn't be in a rush to pay this debt off , its not often a lump sum interest free comes along . write to your ex-employer explaining why the cash is no longer in your account and offer to pay back the minimum you can afford . Happy Xmas
