Im still a little bewildered though at why lady rossers still believes that her bailiffs are angels and work by the book. If her or her colleagues read the forums then they should know that their bailiffs do not and can be very threatening to some people. One lady bailiff quite recently lost her certificate who was working for them. So thats two we know of for definite, any one care to list any more. please no mention of personal names , just dates etc what happened, maybe we can get a list together and show some one that this was not the first and it still goes on.

 

If they all work by the book why was it the bailiff i took to court failed to turn up at court twice and then lost her certificate

Ken Clarke the justice minister said a few weeks ago that you are allowed and entitled to defend yourself in your own home and that no one should ever be charged with anything if you reasonable force. Unfortunately the police are not acting on what he has said and will arrest and charge you if 2 bailiffs force their way into your home and assault you, even f the reasonable force used is a light slap to the cheek of one of them after a 45 minute ordeal

I am still ill sadly, and trying to not get upset, but this whole situation makes me mad, So Many honest innocent law abiding, hard working people. who trusted once reputable institutions, banks etc. with their money. only to be miss sold PPI. and ripped their own customers off, at any opportunity, by way of charges, fines, PPI.interest, etc (otherwise known as fraud.) And when in difficulties. their customers are first given a poor credit rating, to ensure there is no other alternative to juggle money to pay off anything. Then a program on television shows some loudmouth hired thug, boasting about the threat of commiting GBH by incapacitating these now criminalised innocent people, with a blow to the throat! well forwarned is forarmed, personally i will be ready for the hired thug! but how can such behavior be allowed? Where is the help for people in difficult situations bought about by the once respected institutions? i have been S/E all my life. who got the money! it wasnt me, it was the thieving banks! who it seems are not honourable enough even now, to willingly pay back the money they obtained (under false pretences) to their victims! re PPI claims, before the 6 years wether before or after the six years! it is still theft.! why are they allowed to keep their customers money, obtained under false pretences? because they they stole it pre 6 years! if they are keeping the money they stole, putting their customers in unforseen situations as a result, no one will be able to use their own money to pay anytrhing! and we get charged for this!Ro

At the end of the day they are nothing but bullies and think they are above the law because people are scared of them i was to hence why i turned to my dog thinking he offerd me some protection after all what else are we ment to do let them walk all over us ?

The more I read on here and other sites and with yet again another joyful bailiff experience the more I realise this country is totally backside first!

 

Normal people who have got into debt, don't have the money to pay except in instalments, get treated worse than criminals.

 

We get harassed, threatened, have your daily life put on hold while you ensure that bailiffs don't get peaceful entry by default.

 

Some get assaulted, or worse and there is relatively no come back.

 

These companies and individuals just seem to do as they please, without fear of reprisal - because there are none!

Even when it is in the guidelines or law, there is nothing that will bring them to justice over it, therefore no deterrent so they do what ever they please and we have to put up with it.

 

Surely if prisoners convicted of crimes, can get their case heard at the court of human rights for better treatment then a member of the public, being harassed can?

Surely being harassed, conned in the way of illegal fees and threatened goes against anyone's human rights?

It's disgusting and just goes to show what's important to the powers that be - money, money, money.

They support these people to enable them to continue to behave like this, yet if a prisoner or someone suspected of a crime were treated like this

then there would be a number of avenues to pursue.

 

Something needs to be done to control these legalised thugs and their companies and a set of laws and regulations laid down,

complaints taken seriously and creditors taking more responsibility for collecting their own dues instead of farming it out at the first available opportunity.

Bid to stop 'heavy-handed' bailiffs.The Government has unveiled measures to protect the public from "heavy-handed" bailiffs.Justice Minister Jonathan Djanogly outlined updated national standards to define acceptable behaviour.They are designed to tackle intimidatory and threatening conduct, and prevent bailiffs from misrepresenting their powers.Councils and other authorities will adopt the standards which will be used to set rules for any bailiffs working for them.Mr Djanogly said: "Bailiffs are an important part of the justice system so the few unscrupulous bailiffs must be stopped from putting people in harm's way or taking advantage of the vulnerable. We want to bring an end to the rogue behaviour that can make people's lives a misery."Whilst I know the majority of bailiffs are responsible, too many are not. We often hear stories, and see evidence, of people being mistreated by heavy-handed bailiffs. We are working with the bailiff industry, and other groups, to make sure that cannot happen any more, but also that people can still collect their debts fairly."What we have announced today is the first step towards tackling this issue, which will be followed shortly by proposals for a new regulatory regime."The updated standards will include minimum levels of behaviour, including that bailiffs must not behave in a threatening manner or use unlawful force to gain access to a home or business, they should avoid discussing the debt with anyone except the person owing money, and they must withdraw when only a child is present.Mr Djanogly also outlined proposals to create a new legally-binding regulatory regime, which includes new rules around the modes and times of entry, which goods are exempt, and what fees bailiffs can charge for the range of debts they collect for local government, courts and businesses.The full proposals will be consulted on in spring, with a view to them becoming law as soon as possible.Hope this is best place for my post? I am just putting the finishing touches to a NEW THREAD which will include a link to the "updated" National Standards for Enforcement Agents. I will also be including my thoughts on this new guidance ( not good I'm afraid) !!! Should be about another hour or so.....

 

PS: I'm surprised that on a "public relations" basis that MoJ saw fit to release this "guidance" on Friday 13th !!

There is nothing new in this. They are just part of the Nolan recommendations of 2002 and besides, if the police were to enforce the law you will find a high propensity of illegality from assault to fraud and other related activities that as an investigating authority, they have wilfully refused to pursue. I have yet to find a single victim of bailiff abuse that has received just and caring response from the police.

I would agree with you TT that any changes are likely to be to the advantage of the enforcer, and the ultimate detriment to a hapless debtor.

Bailiff Regulations Brought In To Cut Bad Practices The way in which bailiffs are regulated will be overhauled in a bid to clamp down on threatening behavior and privacy issues. Justice Minister Jonathan Djanogly said the move would help protect vulnerable people and ensure that bailiffs carry out their work professionally.Under the proposals, the Government could ban the use of force against people and set out exactly when and how force may be used to enter premises.New national standards to ensure bailiffs are fit to operate could also be brought in."Too many people have experienced intrusive, expensive and stressful bailiff action and more often than not the public do not hold bailiffs in high regard, despite the fact most bailiffs carry out their work professionally," Mr Djanogly said."Last month we announced the first stage of reforms with new national standards and we are now unveiling plans for legally-binding changes that will clamp down on bad practices."We want to restore balance to the system, improve clarity for both debtors and creditors, strengthen protection for vulnerable people and ensure that individuals, business and Government are able to collect the debts they are owed - but in a way that is fair and regulated by law."The updated standards will include minimum levels of behaviour, including that bailiffs must not behave in a threatening manner or use unlawful force to gain access to a home or business, that they should avoid discussing the debt with anyone except the person owing money, and that they must withdraw when only a child is present.The new legally-binding regulatory regime, which includes new rules around the modes and times of entry, which goods are exempt, and what fees bailiffs can charge for the range of debts they collect for local government, courts and businesses also form part of the government's consultation.Encouraging! ro

It does not go far enough. Nor does it do one scintilla to address the clearly illegal practises that Ms Christine Sharples as her role at the MoJ dictated, nor the non-compliance of both the police and the legal profession as a whole to combat such outrages. Common law assaults have been apparently let ride until after they get timed out - 6 months – so no charges can be taken against the perpetrator. It has been a sickening and needless exercise in malfeasance by both bodies that culminated in the death of one, at least, Lancashire veteran. With the welter of correspondence and the number of complaints to the Lancashire Chief Constable, the IPCC (not fit for purpose as in the report published towards the end of last year revealed) the MoJ et al, it beholds our political elite to explain why, as in the plethora of other cases of INJUSTICE, why not a single charge for Corporate Homicide, under the 2007 Act, has not be made against either Marston's or it's employee?

It is again all smoke and no substance. Do we all remember Blair's and Browns promises on putting away potential criminals who carry knives. Again a family is grieving because worthless and over paid public servants, politician alike have paid lip service to a readily foreseeable event for which THEY will accept no responsibility.

This communiqué by an already discredited Ministry politician is no better than all the rest. There will be some satisfaction when those guilty of these insidious acts are brought to account.

the day the new regs were annouced i saw the 05.00 bbc world news and the company they were holding up for using "proper" procedure was Rossendales

 

They are having a laugh, at vulnerable and hard pressed debtors expense

Sad but true incidentally the TV combo, being carried out looks positively antique, so shouldn't he be chancing his arm on Dickinson's Real Deal :-)

It seems Lady Green-Jones thinks the government should provide a high speed rail link between Rossendale and Manchester for the benefit of her business.

 

Julie Green Jones of Rossendale, the largest bailiff company in the UK, said that she worked as a nationwide company, and a rail link would give much easier access to clients, many of whom arrive in Manchester on national rail and have to be picked up. She also said that the provision of such a link would encourage people to live in the Rossendale area and provide her work force with opportunities.

 

Lady G-J's conceit is evident in this BBC news article:

 

Mrs Green-Jones said: "I personally would feel very uncomfortable if I was in the boardroom because I was a woman, because my colleagues would be resentful.

 

"I've had to work hard to get where I have; no one has handed it to me on a plate. CREAM ALWAYS RISES TO THE TOP so if you are good enough, you will succeed."

I would have thought with all the "phantom" charges they rake in that a helipad would be more applicable.

Whoa, she will want one of those silent Black Stealth Helicopters beloved of the US NSA if she had one of those, the better to descend on a vulnerable debtor, before 6am like Mr Boast used to do.

It's a shame we have not got "vigilante" groups taking preventative action to protect Citizens from Bailiff's. :D

 

Let's see how easy their jobs are if they are followed to every single address during the day, every day by people who can advise the victim on the doorstep, and loudly begin shouting when the Bailiff lies, breaks the law etc :-)

 

Could even form human shields around property entrances to stop them even getting to the doors - unless the Householder wants to press charges against their Protectors (if even any offence has been committed) there is nothing the Bailiff or indeed the Police can do.
