I was declared bankrupt on wednesday. On Saturday morning the bailiff called i explained about the bankruptcy gave him my bankruptcy number. He said I still want 740 pounds or i will clamp your car. I told him he would have to speak with the insolvency officer as the car was no longer mine.He replied it is registered to you and clamped it. Can he do this?

nope he cant!

silly begger

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Was the debt the bailiff called for included in the petition for bankruptcy?, if so he may have a problem, likewise if the OR has included the car as an asset to be sold, then again bailiff is out of luck, If you have been permitted to keep the car, and it ISN't in the bankruptcy then you may have a problem, but going on your original post you have lost the car into the bankruptcy then the bailiff is a muppet as the car isn't yours, and he will have to eat humble pie and remove the clamp, or risk the wrath of the OR, others will know more

We could do with some help from you.

Surely it doesnt matter whether the Debt was listed or not, apart from certain debts like secured loans, everything is covered - thats why a bankruptcy is advertised in the london gazette etc.

Interesting.....are parking fines included in the bankruptcy even if they are not listed on the petition. If so then this give sme a whole new approach to Marstons who are really becoming a [EDIT] pain.

Marstons obviously think they can make it up as they go along and hope nobody notices.
