    • Speeding "tickets" are not like parking tickets. They cannot be appealed.  No you won't get one of them cancelled. They were two days apart and so will be treated as separate offences. If your speed was 53mph or below you will be offered a course for one of them (cost of about £100 but no points). For the other you will be offered a fixed penalty (£100 and three points). If you want to decline either of those offers the alternative is prosecution in court, where the financial penalty will be considerably higher. Make sure you respond to the "requests for driver's details" within the 28 days allowed. Failure to do so will see you commit a more serious offence which carries a hefty fine, six points, and an endorsement code which will see your insurance premiums double. Also make sure you submit your driving licence details if you accept a fixed penalty.
    • So if I've understood correctly, you had a meeting with a company who employ PPM to manage their car park, but PPM gave you a ticket and the company refuse to get it cancelled.  Eh???!!! You are being somewhat secretive with the details and it would help us to give correct advice if you would be crystal clear about the story.  Who did you have the meeting with?  What is their address?  Why do you think it was them who called in PPM?  Were you informed about the matter of the permit by this company?  Etc.

I will wait for exactly 24 hours and then contact the local newspaper XXXXX and the local radio station XXXXX about Iceland's disgraceful disability discrimination.  Nothing much happens in Gravesend so I'm sure both will be happy to do a piece which will generate terrible publicity for your store and drive away customers, which is exactly what you deserve.     • You are absolutely right to be cautious. It would be helpful if you will be prepared to send me a private message containing details of the outlet and the address et cetera. It might help me to get things more into perspective. So I understand that you had a business selling your husband's photographs. You were unable to continue your direct involvement and so you made an arrangement with a manager who you trusted to carry on the business for you while you were recovering elsewhere in the country. Is this correct? This manager has possession of all the files of your husband's photographs. Is this correct? Do you have any copies of the files? You made a reference to having a Co-op. Does that mean that you are running a Co-op supermarket or groceries outlet? I don't quite understand here. In terms of the possibility of continuing the arrangement with this manager – my own view is that you need to bring the arrangement to an end and I don't see how you could trust them. As far as I can see you are asking about two issues. Making sure that the files in the manager's position are destroyed so that you regain control of the photographs. Obtaining some damages for the loss of revenue. How many photographs do you believe are in his possession? What you estimate is your loss of revenue so far – probably calculated on your average revenue over, say, the five years before you stopped your involvement in the business? You are talking here not only about a breach of contract. You are talking also about breach of copyright and frankly you're also talking about deliberate copyright infringement – which is a criminal offence. Also fraud. Additionally, if you begin the dispute with this person, I would say that they will probably leave immediately. Have you got somebody else to run the business or would that be the moment that the whole thing collapses? If it is the latter, then this is something else that you need to prepare – somebody to take over as seamlessly as possible   Also, do you know the address of this person – and do they own their own home or any other assets?  
    • Just as i thought (from above post) : i just hope this is not the normal customer service that say they cant do anything and that you have to appeal to excel parking 🙄 this is the response my friend has received today - totally ignoring the subject which was: 'victim of disability discrimination on the part of your agents' does anyone have any ideas to reply with please?     Thank you for your response.   I would like to apologise for the error in the previous email; our CEO, Tarsem Dhaliwal had received your email and tasked ourselves in the Executive Resolution Team with looking into this.   We have raised this with our internal property department who have more information on parking charges and any appeals, we can see that you had appealed the PCN with excel which was rejected, you then appealed the PCN with IAS which was also rejected.   Because of this, we would not be able to cancel or refund the charge.    I understand this may not be the outcome you had hoped for, I am sorry for any inconvenience caused.   Kind regards, Cissy

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I was at my Job search session with Ingeus today after arriving 10mins early for my 1pm appointment i sat waiting til 1:20pm til the receptionist had to ring my advisor to ask him for the 2nd time when he was going to see me, he just told her it was job search and to tell me to go to the PCs....after a hour looking through the same half a dozen jobs i waited to been seen by him to get my travel sorted, when he finally came for me he asked if i have had any luck i told him no, he then said i think we will have to have a chat next week (when he had more time???) about what you are doing wrong as you haven't had a job interview in the last month so you must be doing something wrong?(nothing to do with the fact there are very few jobs out there that i am trained to do, plus that match my hours needed as i am a single mum with no family to help watch my child) He wanted me to apply for a job at Tesco but it was for evening/night shift and he knows i have a kid. So i wonder what joys he will have planned for me next week to get me my dream job. p.s a friend of mine has just been told she has to start the work programme, she told the person "i thought they were getting rid of those" he replied no they are going no where, so she is now about to start her 2year sentence.

On one occasion, after being kept waiting whilst an adviser did her nails & engaged in idle chitchat with a colleague, I pointed out "You expect me to be on time. Conversely, it is reasonable to expect you to be available at that time". Fortunately, I never had the "well do a job search", but if the suggestion had been made, a suitable response would have been: "The appointment was to see you or a suitably qualified adviser, not to engage in pointless activities that I am quite capable of completing at home."

Not just for being unemployed - Complained about an "adviser" that mumbled and appeared to ignore me when ever I sat in front of him... It was determined that it was my fault for not fully engaging in the programme. Also had the "you must be doing something wrong because you are not getting any interviews. Bring in a CV and covering letter so that we can criticise it". That was despite having had two job interviews and one offer of employment (with a confirmed start date) within the previous month.

I suspect they will stay until one or more of the following occur:

 

  • A change in government - The current programme will be recycled and punted out as something new & radical. See the New Deal -> Flexible new Deal -> Work Programme evolution as an example.
  • One or more major prime providers go bankrupt or cut their losses and run.
  • The current contracts run their course and the DWP see no sense in renewing the contracts :flypig:
  • A public revolt takes place and the likes of IDS are severely castigated (or should that be castrated).

I got the blame at SEETEC for their petty stupidities such as not allowing jobseekers ring the bell more then 3 times, never being willing to help, phoning for dentist at their desk and then claiming they were at lunch and other stuff

Got told I think the world revolves around me by the manager

Finished soon after and had an attack of CBA for the last session as they had no interest in helping me with a job interview that went bad due to homophobic staff and a petty small-minded female interviewer/numpty

Sorry to be the bearer of bad news.... But don't forget, you could use the printer/photocopier at Ingeus to print the forms. If you do it on a day when you've been mandated to attend, you get to claim travel expenses back too.

Well I guess they'll take it as your permission to spam your details/cv round to whoever they feel like sending it to. Additionally it is your permission to contact any future employer to check on your hours and conduct and enable them to get their precious outcome payment from the DWP.

What do you mean by conduct? They never said anything like that when I heard the spiel off their intro muppet. Is it attendance etc? Surely that's not legal/legit?

I have over-heard those conversations from the drone that I attend

I am glad I have removed consent now

My drone can't convince as far as I can tell from overhearing

In-work support just seems to be a misnomer as they can't support but they can get those precious answers that mean pimpo earns more money

I spoke to another advisor at the WP office I go to regarding the IngeusWorks site login problems. She told me that my advisor had now moved another office. The advisor has verablly given me a new appointment, but doesn't seem to be responding to any emails requesting a letter or confirmation email. I always have hard copy. My imagination then starts to wander.....hmmmm... I have to sign on tomorrow so do think it's best to go into the office to request a letter.?

The original appointment with my advisor who has now transfered was on the same day but a different time. I've just rang and it took ages to answer, no receptionist again...My advisor did answer,however she said she'd ring back as was in an appointment.

They own you! They will check up to see if the employer thinks you are a good employee. They wouldn't want to lose their ongoing fees just because you were naughty and got fired. If the employer says to them that you are deficient in some way you can be sure that the drone'll be on your case faster than lightning!

Don't surprise me

I was told it was so they could contact employees on my behalf, resolve any difficulties once I have a job but nothing about it for them to make a buck

They don't own me

My time served finishes I'm August but I got an NVQ through them (with luck) don't want to say loads about it though

I finish early July, so I've applied for voluntary work which I hope will keep the DWP off my back....... The shop is opening this month and is literally a 4 minute walk from my house!
