      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If CPP have good intentions,and really do want to sort this,then they will have no objections to you reporting.

To me it makes no difference how they choose to resolve it,if you get your money back.

This may mean agreeing to confidentiality and in your situation that would be understandable,if there is a way to get an agreement sorted fast-no one will think any bad of you for that.

There will be more fish to fry and cats to skin down the road.

This is a decision entirely of your choice-it would be nice to see you report here-all done and dusted and sorted.

It is up to CPP how long they wish to keep this going,and whether they want to see it escalated.

At this moment we do not see any positive reasons to expect good news.

Therefore I think you should give them 14 days to return your losses or else give a final response.

The ball is in their court.

The bank equally should be put on notice that they will not be escaping -their handling of things has been scandalous.

It is another team within the business that handle our cases so we don't have this lady's details for us to comment on her specific case. For data security we need her to contact us so that we can then contact her and discuss next steps.

 

If that is the case then maybe you should get them to register here so that things can be moved more speedily.

When I call the number and you can see there has been a problem for 12 months now, you must want to try and help? Surely nobody is this heartless, I have been ringing cpp forever! I will now write to you.

 

I have taken advice and this is what I am going to do. Write to you , if you would be kind enough to give my case the attention it deserves . I have spoken with the fraud expert and the case worker. I have been told so many times that you cant help. I cant even get you to call me. I never have my call-back, Only once did this happen. When I have called for help three times the same advisor that helps with fraud,tried to cancel my policy and renew it early because it was up for cancelation when the policy runs out.

 

The actual truth is....It shows as a cancel on that date because I paid in full for 12 months. If you dont have that monthly DD you can't utilise that nasty loophole that lets you carry into another year. Everyone needs to be aware that if you dont cancel at the end of period they take the DD again. I have to say that paypal will have not have it, but it looks like the banks are not really bothered. That is Unauthorised and it should be returned, if you ask for a year then thats it.That is what you should get. Not a trick that lets companies keep taking DD annual payments if they are one off.

There HAS already been telephone contact yet nothing has been sorted.

Perhaps CPP will be more forthcoming if the issues are put to them in writing,and they will have a responsibility to deal with it then and respond.

Yes I think it best to write. I will print off the letter today and send first class, recorded. I can see it is clear that it is buying time on their part as the policies both end in June.I will leave update as to what takes place, don't worry about that. Thank you for all the support I hope that it works out. Apparantly according to one morning show on tv, it is possible to use chip and pin fraudulantly, it is called cloning. I am not sure why the bank refuse to say this is the case. I am currently still trying to persue the cctv footage, the cctv at the main ATM used. The shop is run by a well known chain, owned by a large well known superstore but the ATM is a bank I have contacted in fact, but will make another attempt. Thanks again and i will keep in touch. Is there any point in worrying about the post still going to the other address? The credit report is clear at the minute but then it was 12 months too. Not too sure about that.

I've just read through your thread with great interest. What an awful experience for you!

You're getting sterling help from Martin, shame CPP don't measure up.

Strikes me that regardless of whether you or anyone contacts them on their helpline or through a CAG rep, the service and help should be the same. It shouldn't make any difference that the case is publicised, but sadly it does...otherwise programmes like "Don't get done get Dom" wouldn't be needed! (Now there's a thought.... :wink: )

 

I've had some personal experience of stalking, and what's happening to you has similar elements. It's important to keep good records of events, and equally important not to let it take over your life otherwise it will make you ill.

 

Rolling back to some of Martin's earlier comments, in addition to writing a formal complaint to CPP as you are doing, I agree that you need to send a Subject Access Request to Clydesdale Bank. You'll then have a hard record of everything that's gone on, the computer records. communications log, statements..everything they hold on you. You'll need to specify the main things you need...include transcripts or recordings of any telephone conversations, precise details of ATM withdrawals..date, time, location etc etc. We can help with the wording.

Once armed with hard evidence, I'd make a formal complaint to the CEO of The Clydesdale.

 

How did you find out about the letters in your name going to the other address? Do you know who lives there?

Hi elsa that would be great. I need to get fixed and fast. I am managing week to week, just. I have had the worst year to 18 months ever.

I am feeling it and I am trying to keep a stiff upper lip but it would seem if it can go wrong it does! I know the post is there because i know someone that visits there. I did know the person and they worked for my Mother,I was freindly and they worked for me for a short while.

It was some time after that i rang for an offer i had been waiting on, and i got put through to fraud. The amount was about 500 maybe just under and I stupidly used my savings to pay it. I did say that it was not I to the credit people, because it was only fair i thought. I was so ashamed of this debt... but in reality I should not have done that. I was niave and worried sick. I found out it was ther by chance when it was mentioned by "the visitor" that there was lots of post with my name on it. After the entry for the amount above was removed, there appeared two more entries for capital one.

 

This was recently and the other above some 5 years ago.There was a week or two between entries but both said capital one europe plc. my name and the other address. I have been to the P.O. the bank the card people the Police. I am nearly qualified to be a columbo understudy! Worst is I have kept it to myself until just prior to coming here because I was embarassed, and I had to borrow money to cover my direct debits. Oh dear.

Hmmm, if this person worked for you and your Mother, they could be in a position to know quite a lot about you. (One of the most frequent bank logon questions is Mother's maiden name, for instance.)

My experience was different...someone stalked my OH, and bizarrely tried to "become" me...grew her hair into same style, coloured it, bought the same clothes (I wore very distinctive styles much different to what she originally wore), to the extent my MOTHER thought it was me when she saw her in town, LOL. She persisted even when she knew he was terminally ill. Whenever we went into town, she appeared behind us. Lived across town but kept driving past our house. Phone calls with no one there, etc etc. She was someone we'd known years ago, had actually asked my late husband out when she was 17....he turned her down and told her he'd just started going out with me. It obviously stuck with her and festered for years.

 

Which begs the question....Is there any incident, even a minor one, that could have caused a grudge with your ex employee?

I have thought long and hard, I think there could be reasons why she would and would not think twice about doing it, never the less they know me and they would know I would find out. There is another one who could do it. The only thing there is that they also know it would be risky. I had a male stalker once but alas it wasn't money he wanted!

The bank had a phone number that was assosiated with me and it is local too. I tried to call it but it says that it does not receive incoming calls.

I asked the bank to give me information last week, i asked for the times and locations of the atm transactions, I got an email saying they cannot deal with these sorts of things through the contact us section on the internet. I was given the telephone banking number, who then said my branch will call me .

I think it us really naughty that the bank never called me to say that I was low on funds and that I was about to go OD for the first time ever. Good job I looked.

Yes.

You need to be putting these requests in writing.You can either take it to your branch and ask for a signed receipt for it,or else send to their HO recorded delivery.

This will give them no excuse and also enable you to have a paper trail of evidence later.

Hi

I have not heard from them as yet,I will wait until Monday seeing as it was a bank holiday. I did try to check on my credit report via the website but i have no access now i think it is because my cover is up soon.

Shall i renew it?

Will they ignore me even more?

Getting scared now that I will never have that money again. I can do without all this. I cant plan anything, I have bills coming out my ears. One insurance company is sending me continous reams of demanding letters for money because they cancelled my car insurance twice. They said I have not given them some info which i did. So they have had the years money in a quarter and made me look like a bad payer. I am not. But this is whats happening now, this must be stage two of id theft or fraud!

I cant pay some large bills that i would usually have no problem with, that is because my money got stolen, the bills are getting bigger and the threats are coming thick and fast and I cant stop it. I am working for nothing and I am just starting to drown and It is a bleak lonely place.

I have started to put stuff on ebay to get some cash so i hope that helps us a bit. The kids were off this week and a friend gave 2 tickets to the cinema which was great so i only paid for the girls. At least they done something we should be grateful some people have nothing. So thats where its at today, I am selling my clothes. I rang the bank to get spreadsheet format of my account details again no chance. So I need to do the other thing that Elsa said.

I have to do so much stuff I am feeling dizzy, I am a bit low on resources and lack a bit of confidence today so sorry for the tone, but the smiley mask is nowhere to be found today.

Yes I use the website to access my report, I cant trust the emails because they never alerted even after they were told about the previous fraud at that same address. I will post off for it.As for the car insurance it is just so embarrassing. They cancelled it twice. They were horrid and now they are after another 56 pounds, i would be so grateful for some help i cant actually face it, it makes me feel sick. I can give you all the details. I really appreciate this i really do.

To round up a great week I went to court on behalf of my brother his home repo. Then the dog got picked up and they charged me three times in the past ten days 120 a time. He was not even at the kennels he was at someones home. There is a bitch in season. He will have to be castrated. The council let him out one of the times, the postie the other and then me. What Next?

Jeez ...yes you are getting more than your share.

Send me the insurance stuff I will take a look.

Usual format....date taken out what was agreed ...when did things go wrong....what you said to them...them to you....how communications were done how much paid original policy /if they have added charges etc etc.

A great start to what could be another great week.. yeah yeah. Just checking my bank account as i do every day, and thought oh no not again! Balance wasn't as I was expecting. Hunted high and low to find out what the payment was for and it turns out that it was CPP taking an amount for the annual cover of the card protection which I paid as a one off payment and it was a cancel for the end of the twelve month period. They were quite aware of this as i spoke to them on the phone and they were the ones who brought it to my attention when they tried the hard cell three months before my policy was due for renewal trying to use scare tactics to renew the policy early by cancelling and taking out a new policy! CPP told me that they would give me three months for the inconvienince because i had paid a one off payment in full last year that by default it was set to cancel in 12 months. I then said to them 'no i dont wish to cancel my policy right now and take out a new one as i want the policy that i have paid for to run and then i will make the decision about what i want to do'. Quite frankly the three months free, wasnt free because i'd already paid for it! I think this is disgusting but even worse than that, to go and check my bank transactions to find on a cancelled product that they have managed to access my account which now i have a different card than the one i used to pay with initially, and remove the money on a cancel product. Is there any rules that these companies dont break?! If that was me doing it, i would be swiftly arrested and prosecuted!

Hi Sweene,

 

You'll probably find this is one of those payments that is taken automatically by CPP each year until you cancel it with them.

 

The bank would have paid it under the existing DD mandate, despite the new card on the a/c.

 

I'd write to CPP saying you'd already told them you didn't want to renew the protection when they asked and they should not have taken the new payment. Accordingly, you require an immediate refund.

 

In my view, such policies are entirely unnecessary anyway.
