And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't understand the logic in this at all.

 

As you may know, my JSA was sanctioned a month ago. Since then, I've had no money. I can't even get a crisis loan.

 

I sold my body for sex and had to sell some household items.

 

I complained to the DWP and told them what I had done. They were not interested.

 

I claimed for severe hardship and they delayed the claim for seven whole days. They received it this morning despire the fact that I personally handed the application in 7 days ago.

 

Phoning them to find out where the application was up to, was like climbing a mountain. The woman on the phone had no clue what she was talking about.

 

So today, they "fast tracked" the claim. And now they're telling me after all this time that I wont get any hardship allowance untill two weeks time!

 

I don't understand this at all. I'm in a crisis right now!

 

What's the point in giving me the money on the day I get my JSA reinstated?

 

Are they doing this on purpose? Who are these incompetent people?! I've a good mind to write a letter to the Secretary of State!

Do the DWP exist just to aggravate people or what?

Nothing. There's nothing more I can do. :(

 

I just don't understand it. Hardship allowance should cover the time you really need it, not when you don't need it. I can't even get a crisis loan to tide me over.

 

I thought I was entitled to a crisis loan "to meet my needs following a crisis". I can't get one.

Also worth considering going into one of the welfare rights advice places-such as the one in Corporation Street opposite the old Council offices.

I went to the one in Corporation St today and they told me that they can't help me, "the law is the law" was their exact words. Looks like there's no help for me.

 

The state is starving me out. Why are they doing this?

Fraid only others can answer that one George.

Despite lots of replies here,seems you remain in the same position.

Lets hope that you can find alternative means of surviving without those you speak of.

I am not in any position to know such desperation,but I have witnessed many many cases and situations of hopelessness on the CAG over the years,and can say that as dark and as your situ appears now-theres always a way with a clear head.

But Its not so easy for you to see it at the moment.

Its your right under the Data Protection Act to have copies of all data held on you sent.

There is a fee of £10 which covers everything,although there are certain exclusions where they can be exempt,or else ask for additional charges.

In your case,none of those should apply.

 

Getting copies of all the data held on you,could reveal any decisions or actions that were taken inappropriately,or outside their remit...which could give rise for you to challenge.

 

In particular I would be asking for screenshots,and activity logs/reports that covered the period in question leading up to/and after the decisions that were taken.

 

No one can say conclusively,that there WILL be anything incriminating there,but for a tenner-I think its worth a shot.

DWP generally waive the fee, and their template doesn't require it. DWP SAR template attached.

The issues with your stepdad should bear no reflection to your own issues insofar as any SAR is concerned.

 

Whilst its understandable that you will feel no trust and question the worthiness of a SAR,its very serious for them to ignore,or to be uneconomical with facts.

I did a SAR to St.Helens Council,and without going into details,I can tell you that it was extremely productive to me.

There is no indication as to what the computer or clerical records include.

In the box for additional info it encourages the subject to be as specific as possible tho.

Many will know that a data controller can refuse a request that does not contain specific requests-so here should be used to request copies of everything,and it should be listed by bullet point.

 

There is no requirement to use their form-nothing in the DPA demands this-except in the case for example for CCTV images.

 

I am also wary of sending any request for a SAR to any address other than the one registered with the ICO.

if you initiate an apeal ask them for detail regarding the alledged job. in all ferness they should give you full details of the accusation.

I was told life was supposed to be one long learning curve.

Loan Ranger prev gave some good info on this-I saw in particular the criteria that would appear to suggest allows consideration for other requirements.

I'm not a qualified welfare rights adviser, but I'm planning on becoming one. The appeal time limit is one calendar month from the date of decision. An appeal can be submitted later than this however reasons for the appeal being late would need to be provided for the Tribunal Service to consider whether they can accept that there was good cause for the late request. (If they aren't provided the TS can reject a late appeal). The absolute time limit is 13 months from the date of the decision. The DMG on sanctions can be found here. I find it very strange that CAB and Welfare Rights are unwilling to offer assistance given what you have told us.

Most claimants will have no idea what the computer or clerical records include. Most claims will be computerised (i.e. information about the claim held on the computerised system) however just about every claim will have clerical papers such as the claim form, written notes by the decision makers, copies of documents as supporting evidence, etc. A Clerical claim is different from a computerised claim though, and again most claimants will have no idea whether or not their claims are clerical unless they have specifically been told so. The general advice with DWP SAR's is to ask for both computer records and clerical records to ensure that this provides all of the information.

 

It can also be extremely useful to ask for a full audit trail; an audit trail shows up information which would not normally be included in a SAR, and which is not immediately obvious; every keystroke made on that person's records for the requested dates.

Me too-in particular since I am familiar with these organisations in St.Helens and its not something that I have heard of (certainly for BOTH to reject)
