The company name on all the correspondence from them says

 

Book Club Associates Ltd Company Reg No : 6997902.

 

That is the company I have checked and that company has no License.

The CCA entry appears to show the registration number from the former company (as used at the London Address )

It may be that the OFT have not updated that.

Nevertheless,the registered office and trading names do appear on the licence and it is fully paid up.-so current.

They have the cheek to ask me not to print an email unless necessary yet they are throwing books away left right and centre. I wonder if he is asking me to just put the books in the bin?!

I know this company. with 2 similar issues.

 

Some unsolicited books turned up at our address for my partner back in 2005 and they send us a bill a few days later. we denied even recieving the books and even ordering them asked them to produce the proof we had ordered them and they said they could only tell me it was from a guardian magazine page. Warning bells wrang as we never by the guardian unless we need to.

 

complained in writing and said police will be asked to get involved as this is nothing to do with us and as a guesture of good will they closed the account with a zero balance.

 

The about 2008 a similar company done the same after i had my daughter they kept sending these books and cards and then sent a bill. They got my info from the hospital so complained to the hospital and refused to pay anything as it was unsolicited mail and they had gained my info illegally.

 

Hospital denyied they had done wrong by passing info but the company enven quoted me my D number, this is my hospital notes number, and as a guesture of good will closed my account after l said l was going to the ICO and would ask they investigate this fully.

Well as I see it you do seem to feel that you have a valid complaint.

Since there has only been yourself and Systemerror on here its difficult to take a definitive view in the absence of others posting.

The site is first and foremost for its members and I have no issues at all with challenging wrongs.

You say that you have invited them to comment here,then let them do so.

They may feel they have no wish to post on here,thats their choice,but it does not mean if they dont come here they are not interested to resolve your complaints.

I am sure you will post up those responses,and it will be interesting to see them.There have been a number of negative comments made and I think there are questions to be answered.

Hopefully that will happen and we will be in more of a position to determine if those things that have been referred to in 2006/2007 have changed or not in 2009.

This is the latest email to come which I am happy to say goes some way towards rectifying the problem:-):

 

Thank you for your perseverance in allowing me time to investigate your complaint.

 

I agree that there appears to have been significant failings in our service which were not properly investigated or explained. I also acknowledge the efforts made by .................... to resolve the problem and the frustration caused as a result of subsequent collection activity. Please accept my sincere apologies for what I regard as an unacceptable level of customer service.

 

I have issued instructions to close the account immediately and remove any outstanding balance. Without prejudice, I would appreciate you accepting the books in your possession with our compliments or donating them to a deserving recipient of your choice. Alternatively, should you prefer, I will arrange for these to be collected from you at a suitable time.

 

I do hope this will conclude the matter. Please be assured that we have taken steps to remedy procedural failings and review training needs, including recognisingthe requirement to internally escalate complaints to senior management, when appropriate. I appreciate you bringing the matter to my attention and have include my direct phone number below, should you have need to contact me directly in future.

 

I have asked Louise Howe, our Legal Counsel, to contact you in writing with regard to your request to perform a Data Subject Access Request.

Martin, I would like to point out that there are many online discussions about this practise going back a long long time. To get this far I have had to by pass their totally derisory customer service department (which has sent a total of 3 threats of debt collectors now) by buying information from the company register to get the name of the Directors and then only through persistence have I been able to get this email address.

 

Rather than just accepting that I didn't want their books, I have had to complain to Trading Standards, the OFT, the ICO, post on here and throw everything out of the pram to get this far and only then have they recognised that they might have to do something. The default setting, as Natalie hinted earlier, is for their employees to fob you off. At least there is now an online record of an alternative way to dealing with this company other than being frustrated by their customer service department, threatened by their debt collectors and then just submitting to their demands for money.

Yes I can see your points.

They have admitted there were failings and acknowledged your complaints,we see quite often that action only follows,once steps are taken to involve regulators and contact key figureheads-just as you had done.

The result appears to have justified your efforts and determination.

Lets hope that those steps to remedy procedural failings,are implimented sooner,rather than later.

ok it may be crossed mail but i would contact tony day again and inform him of the letter. Also i would print off a copy of the email and send it to them with a copy of the letter they sent with a covering letter advising:-

 

that the matter is now in the hands of tony day and further to his email of XXXX, copy enclosed, that you consider the matter closed.

Looks like the old story of the right hand not knowing what the left is doing-but TD only sent you the response on Friday-looks very likely that the demand was sent prior to this.

Although its not unreasonable to think that TD would have seen this from your account files and told you in the email to disregard further recovery requests.:confused:

I am also being harrassed by BCA for items I never ordered and on numerous occasions phoned them to say items not received or I sent back and yet they still continue and now they have passed this on to CCS Collect Debt Collectors who did not want to speak to me about the past and put the phone down on me. Does this still mean he bailiffs are coming round

On phoning BCA I always get through to India who imply it is soted yet again I receive threatening letters and now receibing the letter for CCS Collect is the final straw, i see this as harrasment and wish to understand what I can do to threaten them
