Recently I took out a payday loan (yeah I know I know - I should know better!) and then things changed - for the worse.

 

Now I get a letter from MacKenzieHall demanding £240 - but when I spoke to them (which I find out I shouldnt do now I read this site!) they offered to drop it to £172.00 - which I cant really afford but they will leave the option open to me until 30th November at 3pm.

 

Anyone got any advice? I havent been told the debt has been sold or anything - just this out of the blue.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Well now they have written to me each and every day and also started emailing and texting me - I know I dont get much contact with people sometimes but this is ridiculous! I never gave them permission to email me and I certainly dont want them texting me.

The letters are one thing but what they are doing now is harassment, by continuing a course of conduct which is a criminal offence, I wouldn't hesitate to report the matter to the Police, (not 999) and tell them that this company is harassing you, by emailing you, texting you and sending mail ever day.

 

If you have already told them that you will only communicate in writing then that is what they must do.

 

Report them to the Police, and mention the Protection From Harassment Act 1997 also the Telecommunications Act 1984

 

Aswell as the toothless OFT report them to Ofcom

 

 

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Before making a complaint to the police you must have told the harrassers (MHall in this case) to stop. Do that in writing and send the letter recorded delivery. Keep the receipt and check online to find out when it was delivered and who signed for it.

 

If the letters, texts and e-mails continue then you can report the matter to the police. Don't be fobbed off by plod who may tell you its a civil matter. It isn't, its criminal. If a pc tells you this ask for a senior officer, no one under the rank of inspector. Take notes and make sure you get names and shoulder numbers.

 

Meanwhile in your stop it now letter to MHall ask for their complaints procedure. They must have one as it is one of the conditions of their consumer credit licence. When they send it to you make a complaint on the grounds they are harrassing you by various means. They have eight weeks to come up wit a satisfactory response. Let us know how you get on.

Hang on in there, I made MH go away with a simple CCa request followed up after 12 working days and tehn 1 calendar month, they had no choice but to pass the alleged debt back to the so called creditor. :D (Who then also gave up because of no CCA!)

 

Listen to the guys and gals on here, they've never guided me wrong, and let us all know how it's going :)

I Strongly disagree, there is no requirement for person A to tell person B that they want them to stop harassing them.

 

If person B continually contacts person A by whatever means;

 

Prohibition of harassment

 

(1) A person must not pursue a course of conduct—

(a) which amounts to harassment of another, and

(b) which he knows or ought to know amounts to harassment of the other.

(2) For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.

 

There is no need to inform mucky hall that you deem them to be harassing you and to stop, this is judged by a court, if necessary.
