i tie myself in knots thinking about it all ... i wish i could sleep and wake up on the morning of the hearing, this is a nightmare, but i cant give up now after all this time.

Ruby, if you have done everything you can, gathered all the information you can, got the support of the people who know, then there is nothing to worry about and nothing to detract you from the sleep of babes. Have faith.

Just to let you know no post today. Will not be posting on Friday and Saturday. On the back of having won at the appeal tribunal and arrears being due I booked a break in Oxford for 2 nights. It was at a reduced price but immediate payment due and no refund if cancelled.

 

Hope you get some word soon.

well i`m really upset today, post man delivered a brown envelope from dwp so i took a deep breath praying for good news,but it was from job centre plus,calling me for an interview on dec 18th,so this tells me dwp are not going to accept my appeal result,gutted,if they were going to accept it then why would i have to go to this back to work interview,also i didnt realise you had interviews every three months at job centre,what will i do if they send me for jobs i just cant do

i am not sure thats right, if your still basically in appeal, as theyre appealing now against the tribunal? so until thats had a final outcome i dont think they can do this, but you need advice from someone who knows for sure, is the 18th within the time for them to give reasons for taking the appeal up a step? i would check it out with the CAB or maybe someone here knows the ruling?

no its not not within the time,which is why i think i`v got bad news comming my way,they have got till dec 4th(to lodge an appeal)but i think they must have already done so or why else would they call me for an interview

yeh but surely even if they feel they have grounds to lodge another appeal, then that would have to be heard and decided before anything else? its not done and dusted until if/when that happens, surely? even if they lodge an appeal now it wont be heard by the 18th december, you need proper advice on this one, i would have thought that while any kind of appeal is still open then this cant happen, please get proper advice on monday from the cab if nobody here has come forward with it. i would even start a new thread on it to bring it to the attention of those on here that may know? it wont hurt to try?

when i first lost my pca medical i was advised by dwp to claim jsa,i wish now i had opted for income support,looking for at least 3 jobs a week is killing me(either emailing them or phone or just calling in places etc,and then you have to produce proof of looking for work,i am now seeing a specialist nurse to commence new treatment in jan/feb(i have ankolising spondylitis)this treatment is approx £10.000 per person and is only given out in severe cases,surely that tells them something,also i was awarded dla low care in july mainly because i cant bend without severe pain,depending on my how my treatment goes in jan i will maybe put in for low rate mobility as i`m struggling to walk without pain,does any one know ,if dwp do take it the next level,can i change to income support

Sorry I can't offer a lot of help ee-bee, especially as I've just noticed you're on JSA of which I know nothing :(

As a short term measure, can't your GP sign you off for a while? I would have thought, with the pain you're in, it would be reasonable request...

Hello ee-bee,

 

Just a quick post. You are going down 2 paths at the same time at the moment. One path is your IB appeal and the other path is your JSA claim.

 

The Back to Work interview does not mean that anything bad has happened with your IB appeal. While you are waiting for your IB appeal to be sorted out you have to do the things that people claiming JSA do and that includes the BTW interview.

I know nothing I say will stop you worrying but you have not heard anything new about your IB appeal that is bad and the DWP are nearly out of time for a chance for them to appeal.

hi melissa teadybear,thanks for that reply,it has made me feel a bit better,believe it or not i was always a very optimistic person untill all this happened,and slowly but surely the whole business of this pca medical is wearing me down,have you heard anything? hope you had a good weekend

No post today so no bad news today. Had a great weekend.

 

Just a thought about something that if you decided to do you really would need to take proper advice. If you have a supportive doctor and the whole business is getting you down could you get a medical certificate for anxiety/depression? In other words if they have turned you down for IB for one reason now claim for another. But seriously if you want to do that to avoid claiming JSA get proper advice as Mr T does not if doing that would cause you problems down the line.

hi melissa, isnt your month up tomorrow? mines on friday,i`m not going to change anything regarding jsa untill i know whats happening regarding my appeal, and my btw appointment isnt till 18th dec so i`m assuming i will know something by then,(well i can hope)

hi ee-bee ...no date yet, but they wrote to me a few weeks ago and said that the earliest date is likely to be in january, my CPN did say in her letter that the stress of this is affecting my treatment, which it truly is, as well as my whole day and night, and asked if possible could my hearing be a priority, i doubt they do that, as all of us are waiting and ill, but it was nice of her to try, she is just being as supportive as she can, so no hearing date yet.

they said i would get 2 weeks notice of a hearing date? so hopefully i should hear fairly soon, its my birthday in january would be a nice present to win the damn thing lol

hi ruby tuesday,yes i seem to remember that you get 2weeks notice for the tribunal,hope you get a successful outcome,would be a nice birthday prezzie,did i read in one of your other posts thet you had complained about your medical or am i getting you mixed up with someone else
