    • Could you post up the letter, with your personal info and their reference covered up, please? It should say Letter of Claim, but let's have a look just in case. HB
    • I know dx, a lot of it was my partner and how she felt about it. I also appear to be addicted to my credit file being clean. I still worry for my partner she has too much on as it is, but I am ensuring I manage both of ours so She can forget about. i guess in terms of time I bet masses are defaulting with this economy as it is right now and high interest rates might be the only thing going for me right now. I guess  I’ll find out
    • Please see below for an extract from the letter more about my case.    You have been convicted of two matters of failing to give driver details linked to two speeding offences and been disqualified in your absence. You confirmed that you did not receive the court documentation and the first you knew about the cases was on 3/6/24. As you can make a statutory declaration it is possible that we will be able to persuade the police to accept pleas to either or both of the speeding offences as they were committed within a very short space of time and withdraw the two fail to give driver details offences as normally if you plead to one or other of the speeding or fail to give driver details the prosecution will withdraw the other related offence. If successful you would not face a totting ban. In respect of the speeding offences, it could be argued they were committed on one occasion due to the proximity of the time and location and we may be able to persuade the prosecution to drop one of the speeding offences. You are technically guilty of all the offences because you accept it was you driving when the speeding offences were committed and that you did not update your change of address with the leasing company when it was your responsibility. If the prosecution will not withdraw the two failures to give driver details offences, you will face a totting ban but will be able to put forward an exceptional hardship argument. This may or may not go ahead at the court hearing date, so we need to prepare for all eventualities. As a safeguard we have lodged the appeal and applied to suspend your ban pending appeal due to the time limit for being able to automatically appeal without getting leave of the Judge. The court have dealt with the matter very quickly and have actually listed your matter for an application to suspend the disqualification pending appeal on the above-mentioned date. We could actually use this date to make the statutory declaration in court having explained the situation to the magistrates and then see if the prosecution will agree to accept pleas to one or both of the speeding offences as a way of resolving the matter without the need for you to put forward an exceptional hardship argument. It is possible the case would need to be adjourned so that we can make those representations, or the court may want to go ahead and hear the exceptional hardship argument. The outcome of your case is always at the discretion of the Court.
    • Hi,    I will look over your case shortly.   I am sorry for the delay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

MBNA/Restons have now officially discontinued!

I have just checked with the court after receiving a call and then an email from Restons earlier today.

They said in the call that they would discontinue if I agreed not to go for costs.

Royalblue.

Have they registered a default against you.

I haven't checked for a while but I would be suprised if they hadn't.

It is something I will look into changing in the future but right now I am not sure if I ever want credit again!

They do appear to be worried about those court costs though,

maybe ask them if theyve put any defaults on and say youll accept a couple of hundred quid for keeping it away from court, its all in the negotiation:)

How does the land lie as far as defaults on the credit record are concerned? Bearing in mind that there hasn't been any legal judgements in this case.

well thats in the negotiation, IMHO, I wouldnt let them off that easily, theyve most likely done some trashing of your credit score, which, if you ever wanted a loan or any credit, would definitely cost you in the long run.

as Snoop says, get them to remove it all or no deal

If they were my only creditor problem then I am pretty sure I would do as you advise and protect my record but I have 8 others lurking in the background some of which will I am sure be defendable but some maybe not.

I have learnt many lessons and while my problems are not entirely my fault I do have to take some of it on the chin and I am quite prepared (and happy) to avoid credit for a good while. I am very lucky that I have family back up to help out with the odd supermarket shop and petrol tank!

Cheers.

good decision

they will not remove adverse credit and to push them on this will simply back them into a corner that they would then come back fighting from-

having just won on 25k i would quit whilst i am ahead

  • 2 weeks later...

letter from exsquirto a couple of weeks ago (sorry over a month actually!) basically wondering if I was confused by the different account number they had assigned it, confirmed the old account number and said to contact them if I needed any more clarification!

Not a thing since.

Just one thing if anyone has an idea:

I have recently had legal paper fun (didn't actually get to court) with MBNA and Restons. Do other DCA and CC companies know or get information about these proceedings from anywhere?

As since it started to heat up with MBNA all my other (dis)creditors have been quiet.

Cheers all.
