Were you aware the account had been assigned – did you receive a Notice of Assignment? Yes Did you receive a Default Notice from the original creditor?  I'm not completely sure at it was nearly 6 years ago, I have done a CCA request and they have sent a screenshot of their system showing it was sent. Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  Yes Why did you cease payments?  Couldn't afford to make payments. What was the date of your last payment?  August 2018 Was there a dispute with the original creditor that remains unresolved?  No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan?  No
    • It’s all with current lenders and no missed payment to date. so with any reduced payment to them it’s likely to be going to debt collectors at some stage. we jointly own a property together me and my partner 
    • It’s all unsecured loans and credit cards. Mainly loans now though as most credit cards are paid off.   so 95% unsecured loans.   I just don’t know my situation job wise it’s almost impossible to say whether it’s likely or not just don’t want to be caught out by it. My mental health trying to pay this off has taken a huge hit also if I’m being honest. I feel like mentally I need some kind of respite and the credit file cost is something I can accept also.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Loosing a great chunk of filling in one of my teeth!!!!! and it's a Fri night!!!........ and I'm at work!!!!.... and I don't finish nights till Tues morning!!!!Spending alot of time at the dentist at the mo..........might as well just send my wages direct to him!!!

Bought myself some new bras today the old grey ones had to go!!!!!!!!

 

Daughter in the queue of people decided it was time to discuss how the matching thong I got in the largest size possible was going to be bum munched by my large derrier. Okay I giggled at first but when noticed a gent was taking a keen intereste and my paranoia was sure he was looking at my bott and agreeing, my daughter decided to do munch munch noises and impressions to which I slowly started to shrivel.

 

The man at the till picked up the nickers and smiled at me and I swear he was thinking NOOOOOOOOOOO.

 

Wait till I get her some new ones, they will be granny ones:madgrin: Not really:lol:

The air did go blue just now but not due to the trainset - hsbc!! I got so angry with the bloke on the phone that when I saw clarity had written to me again, I phoned them to shout at them!!!!

Don't waste time shouting down the phone at the banks........they love it! They do it to get a reaction. There are other ways.

Oh it was more the manner of the bloke who told me that, to avoid charges, I needed to cancel payments going out to priority debts when I explained that the £100 worth of charges they wanted would make my dd's bounce!!

 

Didn't help it was a call centre in India......

 

So I vented my spleen at the bloke from clarity!! They keep writing to me telling me I haven't got a plan in place for my debt. I have. I told the bloke if they couldn't get their house in order, I would be dropping their payments down to a £1 a month!!

 

Oh that felt sooooo good!!! Lol

letter from crap1 asking for an up to date i&e along with proof of my income and outgoins bank statements and wage slips,

 

every 6 months they ask for this, and every time i tell them, they can have the i&e the rest is confidential and is covered under the DPA, and only if they wish to take me to court will they ever receive them

The end of the world is nigh in my house tonight, I am for once distraught on a serious subject other than mentally, but i am sure you will feel for me:lol:

 

I have misplace my lady ga ga headphones and feel lost. I cannot bop till I nod off to my hero lady ga ga:sad:

 

I have torn the house apart and am really peed off I cannot find them.

 

One consolation is the magazine I misplaced last month has turned up under my bed looking for the bl**dy headphones.

My OH breaking his foot yesterday. Poor thing refused to have pot on so that he can go to work today as it couldn't have happened at a worse time and they won't allow you on site with a pot. Such a trooper but I'm worried he's going to make it worse by ignoring what they said (no weight on it, keep it elevated) but what can you do. We really need the work but I can't stand the thought of him in pain, I think I'd rather not eat. :-(

Doesn't sound good breaking a foot and not have the support of a plaster!

There are a lot of bones in the foot and if they are not aloowed to fix correctly they can lead to increased pain and further problems later in life.

Make sure he takes good over the counter painkillers regularly and elevates his foot to prevent swelling or he will find himself off sick for a while.

People who can't control their spoilt brat, er I mean child.

 

Might need to count me in on that one tonight, son promised to cook tea for us to say thankyou for half inching my found mp3 player. He wanted it once i had found it, he then renaged on his offer and changed his mind, so I took it back, well it sounds great and he has to learn to stop taking the pee out of mum:wink:

 

The swearing comming from his room had to be heard:-x
