What to do if you don't receive an item or it doesn't match the seller's description

If the seller hasn't made things right, contact us so that we can help. You can open a case 3 days after the estimated delivery date of an item or 7 days after of making payment if you weren't given an estimated delivery date. A case has to be submitted within 45 days from the date of payment.
I never yet heard of a case where eBay took an interest, beyond the 45 days, except for legal action or a police investigation.

:|:|You have to follow the complaints procedure as instructed by ebay it is easy to find out how to do this on the site, but if you need to speak to someone at ebay then be as clear as possible.As you generaly deal with an overseas call centre and all the Problems we all know they can pose.:roll:Good luck.

Hi All - I am having a problem with drivers.lounge from whom I purchased front grilles for my car and needed to change them as the wrong ones were sent. They repeatedly delayed responding to my request about best to deal with it and then had me send them to another buyer (I paid the postage) and have not replaced them or refunded my the original cost and postage. This has been going on for months now and they just keep coming back asking the same questions about the type of car etc. and so are clearly delaying. How do I raise this with eBay as it would appear to me that the seller has no intention of replacing the grilles and they now have the sale twice over??

 

 

You needed to have opened up item not as described case with ebay within the relevant time I believe 40 or 45 days to guarantee ebays/paypals help. Looks as if seller has strung it out till the only route you would have for repayment if they wont exchange would be small claims court.

It used to be true enough that the only route would be the county court.

 

Since The Consumer Protection from Unfair Trading Regulations 2008 the better bet could be to prosecute by way of a local magistrate. Peruse the terms. The scope is considerable. Almost any sort of misleading statement or omission may be prosecuted as a strict liability criminal offence.

 

If you reckon that what they are doing is tantamount to an attempt to steal your money, treat is as such, an offence to be tried.

Reachingrob - not sure if you'll come back to this - your issue is not with eBay for a number of reasons.

 

Firstly, when dealing with a registered business user on eBay, you need to know your Consumer Rights under the Distance Selling Regs as well as following eBay's complaints procecedures.

 

Never send anything on to someone else on behalf of the seller. If it's faulty or not as described, your contract is with the seller for them to sort out. Also, they should not be passing on other customer's information to you.

 

You are out of time to raise this with eBay as a complaint. If the item was over £100 and you paid with a credit card and you are still within time, ask first to see if you can get a refund from the cc company. Some debit card providers may also help, but you'll need to ask.

 

Failing that, your only recourse is to go the small claims route and you need to write to the seller stating you want the full refund including the postage to the other buyer within the next (say) 14 days or else you'll seek to recover it that way.

 

Hopefully the 'instructions' to send the item to another buyer were given by email and you have proof of postage (costs). If not, you may have great difficulty recovering those costs.

u can contact me and let me know what goes on. i dont check forums much but will be available on email. ebay is a crappy company now and will be shut down if people start ignoring it and go to new sites such as ubid.com or so. they barred me from selling and did not give me any reason. i have never done any fraud or any such activity. i basically had a verbal fight with an ebay employee as she was mumbling and i could not verify her info so she said im suspended. ebay has become too strict and mafia like in their behavior. i would like to take action against them and what happened to you is pathetic. they not only screw over good guys but dont help their customers either. we need more of these forums to support complaints against ebay and if we get atleast 500 peoploe, we can file a law suit. thanks.

I have been trying to sort out problems with E-bay and if ever a company has the worst consumer communications it has to be them. The address to write to is: The Chairman, The Atrium Building, Old Navan Road, Blanchards Town Centre, Dublin 15, Ireland. You will need an airmail sticker and from the UK a European stamp. Good luck as they think they are invincible!

Hi All

Sorry for jumping on the back of other peoples threads but I'm also desperately seeking a way of resolving a complaint I have with Ebay and their awful customer service.

I recently sold an item which was in perfect condition. The buyer opened a case against me saying the item was not as described - total lies!! Nevertheless, I offered a refund if she returned the item. The upshot is 2 weeks later, the buyer still has the item, has not communicated further with me or Ebay resolution centre, and Ebay are still holding the paypal payment! Unbelievably they have decided in the buyers favour even though she has not made any effort to return it or reply to my emails.

I'm absolutely furious about it and it appears there is nothing I can do. I feel like I've been robbed!!

What does the decision notice actually say?

 

Does it say they have decided in the buyer's favour as long as she returns the item, or is it a no fault decision?

 

I would really recommend posting on the eBay forums as a lot more people there can give very helpufl step by step advice.

 

Try Seller Central - but if you do, perhaps do it tomorrow when more people are usually around.

Thank you for your reply.

 

The decision notice says the buyer must return the item but she's already had it 2 weeks and I told her in the beginning that she could return it. My argument to Ebay was that she can't be that bothered can she!

 

Ebay have replied to my initial complaint to them but like thier previous emails, the repsonse was abrupt and illiterately written. I will follow up on your advice though so thank you for that.

I don't know the timescales, but she can't leave it forever. There will be a point at which you should be able to request the dispute is closed and ensure that it is not recorded on your selling account because the buyer failed to return the item for a refund.

I have a live one with Ebay at the moment and have gone for them from all angles.

 

Firstly Claire Gilmartin does not answer her emails, nor her personal mobile number of which I have both. Even writing to Mr Donahoe CEO in the US gets you nothing.

 

So, here is what actually works. Take Ebay to The Small Claims Court. It is very simple and I can talk you through the process. But the good news is that, I am happy to provide you all now with a phone number, yes that is right, a real live phone number.

 

Forget the 0800's or the 0870 or even the 0845's. So here it is, but firstly you have to 'DUCK THE IVR'. This line will constantly ask you for a Pin number. Just keep hitting 'Dont have one', eventually it will say it will put you through to someone called Alan England in Mumbia! 0208 605 3000

 

If you get stuck then email me and I will help you through it.

 

A brilliant website to use is Say No TO 0870 .com it gives you all chargeable numbers at a rate that you can call on your mobile.

 

I love this site, I want to see these huge CEO's brought to task over terrible customer service. Good luck fellow poor service receiving ebayers

This was my point, she doesn't respond to either CEO Email is great and these addresses are correct but she does not answer.

Righty ho, assumed that Miss Gilmartin would change it when she knew I was going to atek her 'personally' to court as she signed the email.

 

Call the number 0280 number and follow it through as if you have a complaint but do not have the PIN number. eventually you get a real person, not much use but they are helpful.

 

What I would do is to write to CLaire Gilmartin at the Ireland address and also send it to the Chief Financial Officer but make sure it is recorded delivery. Allow them 14 working days to respond and then use this if you go to court. chris from lazyblueskies of the com word. Tell me what its about and there might be another way round. Try not to cry as its their fault not yours.

 

Also I would say send the same letter to Mr Donahoe in the US.

I have written and got no reply. What other business would do this and get away with it? Imagine trying to get into Tescos to get some groceries and them saying no thanks you can come back in a year then we will have you. Why has the Consumer Council not done anything about this? All I have to say right now is what goes around comes around.

I quite like ebay - and have had an account over ten years with 1000+ feedback and no negatives ever from buying or selling.

 

However, making a complaint is difficult - and after submitting two complaints in 2007 my paypal account was frozen with about £200 in it.

 

After spending well over £200 worth of time trying to fix it - its still there.

 

The other downside with ebay is its massively open to dodginess (if such a word exists) due to it being so difficult to actually make complaints.
