    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

the subject is why the baby is crying, surly it is better to get a trained professional to check whats happening than have another media frenzy into the social services?.... or worse

im saying no more on the matter as its too annoying..not on one post did gyz mention this child was dirty or looked hungry or ill treated... just cried a lot...i myself am a mother of 8 and 3 of my children have cried from morning till night for no apparant reason and i was given a helpline for crying baby problems which helped me a lot.not all babies are the same and my health visitor couldnt explain why mine cried a lot it just happens.i cant believe your encouraging someone to phone social services on someone because there baby crys a lot.nothing has been mentioned about the child looking dirty or hungry ...the main issue was loud music bumming fags etc and a crying baby.. and yes ive experienced neighbour problems i live next door to a nosey old bat and my poor kids only have to fart and shes on the phone to the housing. crap like this makes my blood boil. i wont be replying to any more posts here as they are too trivial

Exactly the very reason why a trained professional should check the situation out.

 

The possible evidence of drug and alcohol abuse in the household demands someone who knows what they are doing should go and look and make an assessment of the situation. Until a trained professional makes an assessment we are all talking rubbish.

 

The possibility exists that a child is in danger. are you willing to say its not because your a good mother but had a few problems with your own children that you overcame?

no im not simply because i dont think theres a problem with a baby.i think theres a problem with loud music and bumming a few fags a little pot smoking that a vey lot of people do. and its escalated to making a mountain out of a molehill .start again from the very first thread and you will see all this for what it is. nothing but spite

 

whatever anybody else thinks, i care not, if they think the same as me, then there is hope in this land.

 

to make a comment where it is obvious a person finds nothing wrong in pot smoking is , in my mind, totally wrong.

 

sadly, it is because of like minded people we are in the mess we are in today.

reorete, I think you saying you will not post again on this thread is the only good thing you have written so far !

 

For a mother of 2 to condone smoking pot around children beggers belief. This is a clasified, illegal drug.

 

I hope Gyzmo has a result with Social Services........it is about time someone did something this has gone on for far too long. But this does not surprise me in todays society....no one is prepared to accept responsibilty and stand up and be counted.

 

Like you Pete, thanks god I wont be around to see the mess that is about to come.

Kinda looks like reorete has issues with social services etc because she's been on the receiving end of what sound like dodgy complaints. Doesn't mean they shouldn't be called if a child constantly sounds like it's in distress though.

 

The thing is, much as you say the child may be crying because they are crying, it could just as easily be because it is in trouble - why would anyone take the risk? So social services go in and nothing's wrong; great, they can give the same number that helped you and the parents (and Gyzmo) can have a break from the crying. Far better that than if something is wrong and we all take your attitude that any baby crying all the time is doing it just because.

 

The other issues are obviously being overlooked by her as well though - there is frequent loud noise both of crying and music, the garden is in a state due to other neighbours which poses health risks, there is drug use going on (regardless of how minor pot is seen to be, it is still drugs) and it is causing ill health to another human being who is having to deal with it. Gyzmo deserves to be heard on this.

 

I can't imagine being so unhappy that I literally can't stay in my own home.

 

And I still can't get over anyone having 8 kids but not being able to see the problem in pot being smoked while there are children around! I don't care if it's every day or once a month, you don't do stuff like that when children are there.

Well some manager from the housing has come round.

 

It appears that other people have been complaining about the other neighbours behaviour and action is being taken. The police have quite a hefty file on them apparently (probably my complaints making a large part of it). Three other people complained about the last incident, so that's some good news. They also said that they are giving me the number of a private investigator. If any noise happens, day or night, I just need to call and they will come round to witness it. It won' stop it that particular night, but at least it's something.

 

As for downstairs, the structure of the property will be looked at. The baby was crying throughout the visit but the officer didn't seem in the slightest bit bothered.

 

In terms of that baby, I've done all I can and care to do. It's welfare is a concern, but (and this will sound callous), it's mainly the noise and disturbance that has driven me to complain. It's welfare is not my responsibility. I've reported my concerns to the authorities, and on there heads be it if there is a problem that they nothing about.

I wasn't for one moment suggesting a media frenzy. I just suggested Gyzmo told a paper about the situation because if social services get a call from a paper they will do something about it. They would assure the paper that the matter was in hand, and then make sure it was really looked into. Social services don't like to come under scrutiny, and they would want to cover their backs in case something happened to the baby. The paper would not do a story, just make the call.

 

Your life has been made hell by these awful people, Gyzmo, but please don't say the baby's welfare isn't your responsibility. I know you can't mean that. You would be absolutely devastated if you heard that anything had happened to the baby. A child who may be in danger is everyone's responsibility.

 

It could be crying because it is being distressed by all the cigarette smoke. As Lexis has said, she suffered as a child. I once worked for someone who chain-smoked Benson & Hedges (before we knew about passive smoking). It was a great job and he was the boss so I put up with it, but my eyes and nose would literally be streaming through every morning meeting. Imagine a baby having to go through that.

 

Hopefully the housing people will remove them soon. Unfortunately there are dozens of people just like them all over the country with no regard for other people and the councils tend to be so wet they don't take immediate action against them. Years ago anyone behaving in this manner would have been warned and then evicted. They are obviously utter dross and I am so sorry you have had to experience all this misery.

It not needed on top of everything else i've had to put up with recently (isues other than those posted on CAG).

 

I just hope this new job carries some relocation allowance. If it does, you wont see me for dust. Most of my stuff I'll just leave behind.

Its not callous, youve done what you should, if the authorities dont want to act thats their fault, you dont really have any powers to do anything else and could get into trouble for trying.

Sounds like something is starting to get done for you, I hope it works out very soon.

Im glad my wife was the voice of reason at that time, I was seriously close to getting into trouble. And at that time I dreaded coming home from work, had that gut feeling even if someone just walked passed on a night, and tried to drown any normal noises out with headphones, but couldnt sleep in them so used ear plugs for a while.

It does make you react to anything, even someone talking normally as they pass your home, that gut feeling returns and you start thinking what you can do to stop it, it takes over your emotions and is very bad indeed for your health, and possibly others if you lose control. So I understand exactly how Gyz feels.

I think we are all hoping for you Gyz, and are watching this thread with great interest.

Another lovely few days in the land of Gyzmo.

 

Friday Night / Sat morning - next door's windows smashed in at 3 am. Dunno who or why, but it woke me up.

 

Saturday night - Music. from 11 pm til 2 am so not that bad really. Until it started again at 430.

 

Sunday Night. Loud music again. This soon turned into the usual fights so police called out. Another 4 hours of lost sleep.

 

Last night. Music again started at about 11 pm. On and off until about 2 am and then it was constant until 530.

 

Tried to get asleep afterwards but then we have a power cut. for some unknown reason, about 6 burglar alarms are currently going off, and of course the Creature (baby downstairs) has started off along with all the motherly whoops.

 

The HA have been informed and the nighbours are getting a ..... warning. Great.

 

Been 28 hours since I last had any sleep and over 4 days since I was able to sleep more than three hours at a time.

 

Does anyone know if I am able to sue the HA for stress or anything? Would at least get me a car for my job.....

It would be nice to sue HA's wouldn't it. Personally, that lends too much weight to the abusers and liars who will have covered their backs with there lies, so I am just escaping when I can and paying them back the arrears in installments (I need a bond and rent in advance) to get out of this 'very quiet building'.

 

A new girl moved into this craphole a few days ago and is already in tears and being comforted by the nicer residents of said craphole. Moving is stressful and I know how it feels and she was very wary of any potential noise so she, as I found out, had also asked the 2 lovely ladies from the HA if the building was quiet. She got the same outright lie as I did (I saw her viewing flat and my neighbour was saying nice things about the building because the woman was present - she took one look at me as if to say 'you say nothing' .....I didn't and I regret that. The HA will lie quite freely in order to fill these heavily problematic flats (in their view) so the role is stained, if that makes sense.

 

I'm also knackered after no sleep (party time upstairs last night - by the time it was finished I was too stressed to sleep) The downstairs neighbours started at 7 with the door slamming as per usual (I pad my doors so noone has to go through it, but whatever)

 

Anyway, sorry for the hijack Gyz, but I know what you are going through, and I feel you are having it worse (I can barely breathe with it - so god knows how you are coping).

 

Good luck with the car, maybe you'll have to consider a real cheapo with a view to getting rid of after a few wages. You'll get sorted one day, and your neighbours will get their comeuppance or however you spell it.

I think you said earlier that you are quite young (sorry if I'm wrong about this) which may be why the HA are not taking you very seriously. Do you have a parent/older friend who will take this up for you and really read them the riot act? There must be something in the lease which says that you are entitled to quiet enjoyment of the premises, or something like that, and the HA clearly have a duty of care towards you and your other(decent) neighbours. Landlords have obligations too. Have you and your other neighbours thought of withholding your rent. If the HA then serve notices on all you to quit you will be able to state to a court why you have taken this action. Other than moving sooner rather than later I don't see that there is any other alternative. Why would anyone in their right mind put up with this? That would be apparent to a court.

 

It's not nice to call the baby a "creature", I agree with reorete, but you are at the end of your tether and must be at cracking point. Reorete will disagree with me, but I don't think that the baby is at all safe in his environment. I'm not surprised he/she is crying nonstop. He/she is suffering from the noise/broken windows/fights/police visits as much as you are. Please pm me if you want me to get on to social services. Sorry, reorete, but this baby is being choked by smoke/drug fumes, deafened by constant noise and it is not the right environment for a young baby. You're a mum - you must agree.

I'm 34.

 

As regards to my "creature" remark, when you have had a total of about 7 hours sleep in 3 days, and cannot get to sleep in the daytime because of a constantly screaming child that you can hear loud and clear and it isn't even yours, then you generally are not given to being nice about things.

One of the girls also sleeps round quite a lot, has 2 babies by two different fathers. One boyfriend keeps coming round and mouthing off every few nights. I've called the police several times who have responded and arrested him. And then what happens? He gets released and the stupid cow next door lets him move back in. A few days later she kicks him out and the whole process is repeated.?????????????? your (edit) gyzmo and a (edit).i only wish your neighbours could see these posts and do you for slander and defamation of character.if i was them id see the council about slapping an asbo on you for being anti social

Everybody who posts in these forums would do well to remember that nobody knows who the other registered users are.

It is not beyond the bounds of possibility that your neighbours are registered users of these forums.

 

No names, no pack-drill but post enough information and somebody might recognize themselves.

 

If an action for libel were to be initiated, CAG would be bound, by law, to reveal any information held to enable the litigator to identify the poster.

That would include email addresses, ISP and IP addresses. Not because we would derive any pleasure from being forced into that position.... we would not have a choice.

 

Please, just think about what you post.

i agree rooster. for your information mr lex that wasnt a personal insult just a fact. read some of the highlights of gyzmos post. one of the girls sleeps around a lot???????????? that to me is damn rude and in another post she calls this persons baby a creature,it is not i who is being rude or insulting im just disgusted that everbody is encouraging this behavior and as rooster points out the person shes slagging off could be a member of this forum
