    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real.     • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am currently in finacial difficulties due to over committing myself with credit and losing over £20K on the stockmarket. I lost all my savings and was left owing Barclays Stockbroker £1000. They passed the debt straight to Collect Direct (UK) who have tried to make me pay them through constant harrassment. I have sent them a repayment proposal based on a budget I did with a charity. They have so far not excepted my offer.

 

I have sent them a harrassment letter which has helped, however today I received the attached Court Action Warning. I am aware that the bright red letter is supposed to scare me, can any advise me on a suitable response?

They letter is to put pressure on you - their letter is full of "mays" and "mights." They would look silly taking you to court when you have made a payment proposal because no judge would make you pay more than you can afford anyway. You can do one of two things. You can ask the charity to negotiate for you with CD(UK) - they must under OFT guidelines negotiate with a nominated third party of your choosing - or you could just send payments to them and make sure you keep a precise record of all paymnets made. My preference would be the former.

At the moment I am planning to deal with all my creditors first hand. This is because I am currently in the process of CCA request and hope to get some of my debts written off or to make reduced Final Sttlement offers in the future. If I hand everything over to the charity I will have to pay out all of my spare funds. If I deal direct I hope to be able to pay CDUK a bare mininum. I will a requst that they accept my payment proposal and provide me with a paying in book or details to set up a standing order (again).

 

any further advise or opinions are welcomed.

I have again written to CD(UK) asking them to accept my repayment proposal based on my affordable funds after all essentials. Today they repliead with a letter stating;

 

Dear sir,

 

when you purchased the shares you were not given an instalment facility, you supposed to have the funds available.

 

You will not get a facility to repay this debt at £**'s per month, even through the court.

 

We suggest you now contact a solicitor to act on your behalf as will be taking further action for the recovery of this debt.

 

You now have until the 30th March 2009 to find the £****'s (full ballance) if you with (assumed typo, should be 'wish') to prevent further action.

 

TREAT THIS MATTER AS VERY URGENT.

 

Does any one have any advise? I cannot pay in full or offer them an increased offer as this would affect my repayments to my other creditors. Should I stick to my guns? are they likely to take me to court? would a judge make me pay in full although I can't afford it?

Well, if you can't pay anymore you can't. This is just putting pressure on you, to up your offer. You must stick to your guns, and as you say in fairness to other creditors as well.

 

How can a Court (as they say) NOT accept your offer, it is not for them to say, they have NO power over you at all.

 

I am sure someone will be along shortly with more helpful advice, but please do not let them bully you.

If they continue to harass you, keep replying with your repayment proposal and also put a paragraph in that if they would like to take you to court then all the correspondence between yourselves will be shown to the judge to show how unreasonable they are and the contempt they would show a court if proceedings started.

 

A Judge will make you pay ONLY what you can afford, they cant get a lump sum if you cant afford it.

Its borderline as they state "COULD" on almost anything... the oft debt collection guidelines state a DCA should not claim to take actions that they cannot actually do.

 

Another possible thing to do is to find out if they have purchased the debt or are working on behalf of barclays?

 

As I understand it only the owner of the debt can commence or instruct legal proceedings[Clarification needed] in which case the letter is grossly misleading and breaches OFT guidelines and a complaint should be sent ensuring you carbon copy collect direct(uk) :D

Correct. If they don't own the account they would have to be joint claimants with the OC ;)

Despite sending them a harrasment letter the phone calls have started again. Should I warn them again or report them to Ofcom?

Definitely make Trading Standards and OFT aware of their blatant breaches of OFT guidelines
