    • Nice work dx, much what I thought and glad to have it confirmed by the expert. Radio silence remains my game plan, I have been resident in Scotland since birth and although I had moved a couple of years prior to defaulting, all addresses were updated and I am confident all begging letters are coming to my current home address. I appreciate the info that they probably wouldn't get a claim in by Aug anyway - I think I'll hunt out my big box of badness in the next few days just to see if I can find any default notice letters so I can pin down some dates to satisfy my semi-OCD. Much obliged, and unlike some others i will look to update in the future as I certainly intend to send them the SB letter as I like to pull the chains of these types of cretins! Of course i'll be back to confirm the correct procedure if I get any "proper" legal letters other than the usual Overdales toilet paper type of scare tactic.  
    • statute barring in Scotland is 5yrs from last payment/use date or date of default Notice + 14 days, whichever is the later. dont confuse that with the 6yrs debts show on credit files (DN's 6th bday regardless to payment or not). they'd never get a claim raised by august in 99% of cases . as long all these debts were taken out whilst resident in scotland and you have not moved since taking them out but failed to inform the original creditor before the debt sale....... then stay radio silent until sb date is reached. then if you wish send our scottish sb letter. just remember unlike E&W in scotland debts are extinguished, dead , gone , parrot. once SB'd dx  
    • Hi all, Love this site and it's no nonsense advice, have dipped in and out of the consumer forums over the years, mostly to assure myself that what I was doing was the right thing when dealing with various businesses (almost 100% success rate, thanks in part to reading and more reading here.). Anyway, the time is almost approaching where I might need to ask for some specific help and I have a couple of queries that I can't see definitively answered. Due to financial mismanagement and severe anxiety issues I stopped paying all unsecured debt in December 2018 (one slipped to the first week in Jan 2019 when the last payment was made having rechecked my bank statement from that period - all my unsecured debt direct debits were cancelled in early Jan 2019). This has left half a dozen debts;  a couple of credit cards, a bank loan, Shop Direct and some Hitachi Finance stuff having been sold on and passing the rounds through the usual suspects, Lowells, Link, PRA Group, others related to them, and then back to them again. I have somehow successfully managed to maintain radio silence and avoided anything more worrying than their begging letters.  I have blocked their phone calls and texts, bumped all emails to the spambox and had a chuckle at their desperate letters.  I've never had anybody at the door.  I have been at the same address since before I defaulted and all correspondence comes to my current home address.  I have NEVER contacted them or admitted any debt. In anticipation of them perhaps ramping up action at the last minute I've had a look at my credit report on Credit Karma (rec'd from this very place) and I see that the default dates on these range from May 2019 to November 2019. Also in preperation I've been reading, reading and reading lots here as advised. Obviously being in Scotland there are a lot fewer posts relating to these matters and it's always quite annoying when OP's do not follow up with any outcome on their cases - how rude! This has also left me a bit confused of when I am able to finally breathe easy (although cancelling all the direct debits in Jan 2019 was the biggest sigh of relief as I knew it was all going to be unmanageable and, well, default one, default all.). I've been reading that defaults should be filed 3-6 months after the missed payment but one of my larger debts was defaulted on 27th August 2019 when the last payment I made was 10th December 2018, meaning the first missed payment was 10th Jan 2019.   My query for now is - when should I infer that these debts are prescribed?  From when the payment was missed, or taking the default date plus 5 years from the credit report? The three I have with the May date are moot anyway as either way they are gone  - some letters from Lowell offering me 90% off to settle is what got me thinking these must have been near SB status, however I have one big 10k+ with a July date and another 10k+ at the end of August I am feeling a bit anxious again, even though I know there is nothing to worry about with the begging letters.  Reading the various forums I am not sure why the OC's didn't take action against me when I read time and again the surprise that other posters haven't already been taken to court for lesser amounts - I'm also surprised I've avoided any action this long as there are plenty in this forum and sub forum who are whisked off to the court by the beggers minions after only a year or so after defaulting.  There are no CCJ/decrees listed on my credit report and I have not received any such judgements against me.  I still just regularly receive the begging emails to the spambox, the blocked phone calls and the letters from the they. I'm also reading that there is no need in Scotland to send an LBC so what should I be looking out for to know that the time has come to engage with CCA requests etc? I'm afraid in a fit I threw a lot of the paperwork out but I have a box of stuff I'm going to go through which may have the original letters from the OC's. Thanks in advance for any advice.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Everyone THANK YOU so much for your words I can't tell you how much it means to me it has given me something I thought had long gone HOPE

 

I am taking the advice and going for the CAG's to all of them and the first thing I done after my first post on here went home and unplugged the phone!!! AND YOU KNOW WHAT i INSTANTLY FELT BETTER

 

What can I say CAG literally saved my life maybe we do have that angel on our shoulder as something pointed and helped me to find this site.

 

Again reading some of the truely heart breaking stories on here makes you realise and be grateful for what you have got.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Hi there Sorry to hear about your financial problems the loss of your loved ones....

 

I couldn't say i know what your going through right now but believe me its not the end of the world and you CAN solve these problems....

 

Have you considered getting an appointment with the citizens adivce bereau or the Consumer credit councelling service? These are two charity orginisations i know help people in your predicament? If you need the numbers i can find the nearest CAB to you...

 

I work for a credit card company, in the collections department, and i happen to know that if you specifically request we remove your number, we must do so by law. So i suggest if you do speak to them again you request they remove your number and corresspond with you in writing. Perfectly reasonable request and also they are obliged to do this...

 

if you want any help from an insider just PM me or something i would be happy to give you some help....

Dont let them get you down. I have only been on this site two weeks and they are great. I have sent all my CCA letters and already had £18,000 written off by Natwest!! So it will be worthwhile in the end.

 

You have already had some really good advice. Organize your files in seperate folders and keep everything. Have a good nights sleep and wake up 2moro with the will to beat these people. Remember banks and Credit Cards companies dont care and they have no morals!!! so dont be affraid to challenge them.

There must be times when either you feel extremely sorry for somebody who is quite clearly being given a hard time when they don't deserve it, or quite angry when you can see that somebody is simply trying to evade their responsiblities. Does this make your job more difficult?

thats excellent, eventually you'll be so uplifted by your own progress it will get to a stage where you can't wait to log on to see how someone else is getting on because your'e 'problems' have paled into insignificance. Be warned, this site is highly addictive.

its actually quite frustrating at times when i speak to people who are going through a tough patch and all i can say is send us a letter. I wish it was me who makes the rules but sadly it aint :|

Teldave: first off (((((((((((((((((hugs)))))))))))))))))))

 

You have had so much to deal with, but you are still here, and with our help you will be able to not only get through this, but actually laugh about it before long.

 

Firstly, send off the Consumer Credit Agreement letters (included below)to anyone you have a loan or credit card debt with. They cannot be used for mobile phone, utility or nursery debts I believe. Make sure you send them unsigned (very important ~ some debt collections agencies have been known to cut and paste signitures onto agreements) and by recorded delivery and with a £1 postal order in them. Do this on monday (or as soon as you can afford to, but certainly by the end of next week), to all the companies (yes, the debt collection agencies who are doing your head in). They have 12+2 working days to respond with a copy of the Consumer Credit Agreement or the agreement is in default and cannot be enforced.

 

Secondly, I don't know who you bank with or if the debts are within the same group but if you have say a Halifax bank account and a debt is with Halifax or Bank of Scotland then open another basic bank account to have any money and bills paid out of. Banks have been known to take money out of accounts to pay off debts of other banks in their group.

 

Thirdly cancel any direct debit payments you have arranged with these debt collection agencies. They can change the payment amount and date without you knowing.

 

Fourthly, DO NOT SPEAK TO THESE PEOPLE ON THE PHONE. It is their job to get money out of you, and can and will be as nasty as possible to try and get it. In the letter I have put below there is a bit about you not wanting any contact other than in writing.

 

When you get anything back from these companies let us know, some might try and fob you off with application forms for loans or credit cards and hope you do not know that this does not satisfy the law.

 

WE are here for you, we will support you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

 

Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

 

Be advised that any further telephone calls from your company will be recorded.

 

I await your written confirmation that this matter is now closed.

 

Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I expect your due diligence in this matter.

Everyone once again thank you today not so good I have had to plug the phone back in to be able to work to get broadband yesterday I had 63 calls today not even 11am 28 calls so far my husband is on nightwork and going mental as he cannot get any sleep

 

I am so scared to go to ccs or CAB because of my debt in case the recommend bankruptcy I am self employed contractor and my work involves supporting trading floors (mind you no work around in that field at the moment) so this would then bar me from working in that field if I was made bankrupt. I got a letter from my bank yesterday I have always made sure that I keep up with everything with them as I need them for my salary etc and now they are threatening to pull the rug from under me as they are concerned over my credit file!!!!! I want to fight back but feel so low - anyone out there won by them not having a CCA I have read so much my head is spinning I only seem to see court actions and then it depends on the judge.I flip between being positive and desperate I wish I could just stop crying I just crave some peace. I feel worthless and ashamed how could I end up from being comfortable having a good life to going to bed cold and hungry. Sorry bad day!!!!

You need to stop those phone calls. Pull the plug out of the phone again! :)

There is also a website by a lovely young woman who had to face bankruptcy: if you google Ladiesinthered, you'll find it. She was also self-employed and doing well, but hit a real crisis in her business, hence BR. She got through it, and her pages are an inspiration - very funny as well! :D

sorry guys just a bad day feeling down buzzer system in rented property so even with phone unplugged it buzzes every room need to work out how to disconnect every buzz just brings it home what a mess I am in my whole family now gone only have my husband but he is at the end of his tether scared he will walk and I lose him too not looking for sympathy as there are worse off them me!!! some positive win stories please thanks everyone
