Clavering House is 3 miles away from HMRC Benton Park view offices.   Wardrop - unfortunately unsuccessful due to late appeal - assessments opened by HMRC in March 2019. Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got this email from these fraudsters yesterday

Everyone who has a problem with this company file a complaint here - it is with support from the F.B.I. It is quick and easy and with luck we can get something done about them. My credit card company is helping me get my money back and the legal help extra on my house insurance said they will take it further if the credit card company fails!

this what I have received. I ordered a camera on 1st of January 2010. Order was canceled. A lots of emails, no refund so far. Last email I received

I paid with maestro and noone can help me getting my money back. I tryed the bank, customer consumer as well they say maestro no chance. Any advice what else can be done?

3 months after a cancelled by agreement order I am still awaiting the promised refund! All sorts of excuses. This is a very clever operation manipulating laws! A Google search reveals hundreds of complaints but you can win! Try the equal to our Trading Standards at www.bbb.org they will take action and some forums show that refunds have been obtained. Also try Internet Crime Complaint Center (IC3) | File a Complaint which is linked to the FBI. Please pass on this message to other forums as the more that complain the greater is the chance of getting something done about them. I am taking it up with the Embassy in London. Plus my house insurance includes legal aid and they will also take it up!

Update! My credit card company has given me a full refund ( with a caution that after investigation it might be reclaimed!) and referred my case to Mastercard for them to investigate and take action.

 

I have found three USA agencies who will take up the complaint:

 

the usual www. then-

ftc.gov

ic3.gov

bbb.org

 

The London USA Embassy were not very helpful but did say:-

"The Internet Crime Complaint Center, a partnership among the Federal Bureau of Investigation (FBI), the National White Collar Crime Center (NW3C), and the Bureau of Justice Assistance (BIA), at www.ic3.gov

And to the Metropolitan Police if you are in the United Kingdom, at www.met.police.uk www.met.police.uk

The UK Fraud Office has an on line crime reporting site which is easy and quick to use www.actionfraud.org.uk

 

Has anyone found any other way of reporting them?

a USA trading standards organisation they will take up the case.

 

Also here www. ic3.gov and www.ftc.gov

 

The UK Fraud Office has an on line crime reporting site which is easy and quick to use www.actionfraud.org.uk
