  1. Like a lot of people, I've been duped, thinking this was UK based firm!!! Wanting to capture my daughters firtst xmas on film, I purchased a camcorder worth nearly £700 and I am now at my wits end not knowing if I’ll get my refund. I sent an email on the 17th December telling bitesizedeals.co.uk to cancel my order (for the second time), but without any success. Trying to keep this post short, my email included the following, which they have kindly commented on: I placed this order in good faith in the belief that I was dealing with a British company. At no point did you indicate that you would be shipping the item from the United States and that I would consequently be subject to import duty and sales taxes. I then received the following response: Please rest assured that you are not liable for any charges further from when you placed your order. The price indicated on our website includes everything, even delivery. Also, as of December 10, per our terms and conditions: During the holiday rush all orders are final - we cannot accept cancellations. We apologize for the inconvenience. So when does the holiday rush begin? There's no dates specified!!! I have since sent a third cancellation email and received: We apologize for any inconvenience caused. Unfortunately, we are not accepting cancellations during the Christmas season. In accordance with our terms and conditions, all sales are final during the Christmas season and no cancellaions are accepted. Why can’t I just get my money back? I haven’t received my goods, nor have I have confirmation of what’s happening with my order. I made my order on the 8th December, but the only update I have had for my order was on the 9th December. This was after a bitesizedeals.co.uk representative called me pestering me for my delivery details, and then was sent an email confirmation of the phone call and telling me in writing that my order would be shipped by the end of the week (12th December). The representative stated, by mouth, that my order will arrive 15th December. I attempted to obtain an update on my order, as my status was still showing as ‘In process’, but I have yet to receive any response to this email. As of now, my status is still unchanged. That’s 10 days now!!! What rights do I have? I have spoken with my credit card company, and they’re not being much help. I have told them I would like to make Section 75 claim, but shouldn’t they be doing something for me before I go this far? What do I do if it now arrives, even though I have attempted to cancel my order three times now? I’m also worried that the camcorder will not be a UK model, and won’t be covered under the warranty. I know if it was a UK firm, I would have more rights under Distance Selling Regulations, but being a US firm what rights do I have? I find the website to be very misleading. No geographical address, so I’m unable to write to them. I have spoken with Trading Standards but they’re unfamiliar with US consumer laws. I have since received a ‘junk’ email from bitesizedeal.co.uk advertising some special offers they have. Unlike the actual website, it has detailed an address. A UK address??? In Nottingham to be exact!!??? Doesn’t this imply that bitesizedeals.co.uk operates in the UK? So many questions, but please help me – this is tearing me apart!!!
  2. Hello all My apologies for the really long post! I was hoping I could take a few minutes of your time and be kind enough to read through this message, and hopefully maybe provide me with some advice and/or guidance please. I'm new to all this PPI reclaiming, and after a lot of digging around I came across this site's forum and found that many people on here appear to be very knowledgeable and clued up on how it all works. I'll be honest and tell you that I'm really confused and uncertain how I should I approach the bank, or if I'm actually entitled to. Let me start by explaining my situation to you all. March 2005 - I found myself unnecessary and stupidly in debt. I won't go in to details exactly why, but let’s just say she took me for one big ride!!! I found myself exceeding my overdraft limit each month, had a maxed out credit card, a maxed out store card and 2 x loans to go on top too. Plus with bills, rent etc, I was struggling to get by and had more outgoings than incomings. Couldn't even afford to eat sometimes. Really depressing times. So out of desperation I contacted LTSB to try and reconsolidate my borrowings. The loan people I spoke to over the phone told me that they couldn't help me but they did give me the number for their loan refinance - Customer Support Unit. So I called them. I explained my situation to the very nice lady over the phone. However, with my circumstances then, I found it very difficult to explain and got quite upset and emotional over the phone. I was offered a loan of £22,200 at 5.2% APR over 10 years. This was where I was told that I could either have the loan protected or not. However, the lady then explained to me that it would be in my best interest that I took the protection out in case I lose my job and that my circumstances would be then become worse that what they already were. She also added that it would aid my application by doing so. Without much thought, and not wanting to get back into money trouble, I accepted. I thought to myself that it would be either paying an extra £84.05 a month or to live on the streets. As I was that desperate to get myself sorted, I signed the forms once they arrived, and I admit, without reading them in much detail, I posted them back. It was only a few months later, not sure on exact dates, that I tried to cancel my loan protection. I was told that I could only cancel it within the first 30 days, unless I refinance my loan once more but I would no longer be able to get the 5.2% APR rate. Should have read the small print! I was really peeved off that I was wasting £85 a month on something I didn't really need. With not really happy with what I was told, I went to my local branch to discuss my loan, but they couldn't talk to me about it as they said they don't deal with my loan, their Customer Support Unit does. The Customer Support Unit whom I talked to when I applied for my loan. So I accepted defeat!! Then around May 2006 I was planning to move house, and I thought there would be no harm in trying again to try and get that little bit extra to get me started in my new home. Again, I called the Customer Support Unit and was told exactly the same thing. Then over a year passed. I spoke to my bank manager a few weeks ago about my current account and I thought it would be a good opportunity to ask if she knew about cancelling loan protection. Again, I was told that I could only cancel it within the first 30 days, but no mention about refinancing?!! So I've had the loan for over 2 and half years now, and I'm still paying for something I really don't want and definitely don't need!! I've felt not longer after taking the loan, that I was pressured to take the PPI by the Customer Support Unit representative, as I was most definitely vulnerable and very desperate at that time, and felt that they used that for their own gain. With a few promotions and pay rises on the way too, I am still with the same company, which has been a total of 9 years and 2 months to date. I am entitled to 6 months full sick pay and half pay (which could be upped to full pay dependent on circumstances) for the other 6 months, which resets every year. I would also be entitled to a good redundancy package if that ever were the case. I also have a Scottish Widows policy, processed through LTSB, which also covers me for any critical illness and death. This has been in place since March 2004. Loan details - March 2005 These are the details of my loan agreement: Loan amount = £22200.00 PPI = £8477.77 Total Loan = £30677.77 It states that a fixed rate of 5.2% APR on the total loan. The document I have states that the loan is a CCD Refinance Loan. What's a CCD?? I have only just noticed over the past few days that the length of the loan is in fact 11 years and not 10 as mentioned when I applied for the loan. On a separate section it shows the loan protection premium, which is £8477.77 but below reads £2616.67 in interest. A whooping total of £11094.44. Is this right? Is this in addition to the 5.2% APR? Over the life of the insurance this interest does not work out at 5.2% APR but it appears that I’m getting charged it on the section above in the total loan. Loan details - Novemebr 2007 I have requested a loan settlement and here are the details: Capital plus interest = £24747.44 Early settlement fee = £185.00 Insurance rebate due = £4944.17 Total balance to close the loan = £19988.27 I have since been paying a monthly sum of £304.14 since March 2005 and have not missed one payment. That's 32 payments of £304.14 to date. That’s £9732.48 in total but it appears that I’ve only paid off £2211.73. That’s £69.12 a month written off my loan. Where has the other £235.02 gone from each payment? I’m confused to say the least!! As you can probably tell, I’m at my wits end trying to figure out how my payments are spread, let alone if I was mis-sold the PPI. I felt I wasn’t explained the consequences of taking the PPI, nor if I had any other options. Is it my own fault for not understanding how loans work? They always word their T&C’s as if I should have a degree in banking. Most of it just goes straight over my head!!! I’m not sure if I’m in a position to make any claim based on the above, nor if I am legally able to cancel my PPI policy. If I am, then wouldn’t they just tell me that I agreed for it, signed for it, and now you’ll just have live with it! Please help!!! Many thanks for everyone’s time Steve
