    • Thank goodness it's not your roof and you get to foot the bill! How big are these bits of mortar? How often are they falling into your garden? Hourly, daily? Just go ahead with your plans, of course, they're not going to be worried by your time pressures and the urgency of the situation, so simply carry on as you would have done and I'm sure everything will go fine. Unless there is a danger to life and serious structural issues which mean you cannot venture into your garden, then IMHO there is little more you can do less for what you have done so already and made them aware of the issue.
    • Hi all!   Thank you in advance for any help you can give me!!    I parked up (at 18:08) in a rush, entered my Reg and paid for an hour of parking. At 18:20 I got a ticket for not paying for parking.    I've just looked at my receipt and noticed why ... I put "22" instead of "21"  when i put in my Reg. yes... what a stupid mistake.    I seem to remember there being a court case or a rule change about entering the wrong reg but the company wasn't at a loss because i had paid for the parking just technically for the wrong car. Am i making that up?    Any advice would be gratefully received, even some key points i have to hit when doing the appeal      
    • You haven't returned to the thread to give us your views, but a couple of other things strike me which you should consider: 1. You say that at no time was your father's licence revoked by the DVLA. It didn't have to be revoked. It expired in September and his "entitlement to drive" (of which the licence provides proof) expired along with it. He could only continue driving whilst his application was being processed by virtue of s88, and it seems clear to me (based on what you have said) that he was not able to take advantage of the benefits provided by that section. 2. The letter he received threatening to revoke his licence was probably a template letter sent when any medical issues are brought to the attention of the DVLA. But it is clear that beyond September until it was eventually renewed, your father had no valid licence to be revoked. I believe a "not guilty" plea in court will fail. The basic facts are that your father's licence expired in September, it was not renewed until February because the DVLA were looking into his medical declaration and he could not take advantage of s88. So in December he had no licence and no entitlement to drive under s88. The facts that he believed he was fit to drive and that his licence was eventually renewed may mitigate the offence but they do not provide a defence. I also asked whether he had received a summons (very unusual these days) or whether he had received a "Single Justice Procedure Notice". The way to proceed from here differs slightly depending on what he has received so if you let me know, I'll advise further.  
    • Well, what I've read from various sources suggest if a CCJ is 6 years old that if becomes pretty much ineffective for enforcement purposes in its original form.  And that if it's about to expire then the claimant needs to apply to the court to extend the original CCJ within the final year.  Even if they do apply for an extension within the 6 years they have to have a very strong argument for doing so such as the person being out of the country or could not be traced, basically show they were actively still perusing the debt I guess. Now if a claimant ever does apply within the 6 years to extend the CCJ, would the person named on if be notified by the court that such an application has been made?.  In my case I've heard nothing from the court so assume no such application has been made.  The original CCJ in my own case is now a year beyond the 6 years of issue so must now make things even less likely again. So whilst the CCJ exists that they have not enforced it in that time must surely make it unlikely they can now take it back to court because as said it would be very rare for a judge to agree to such action now. That said, I guess they now can't use the CCJ to continue with any action for an attachment order to our mortgage either?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got A Letter From Csl Saying The Credit Agreement Had Been Sent To Me On 15th September 2006. The letter was dated 11th September 2006!!!!! But Wasnt Recieved By Me Until 4th October.

 

Cca Letter Was Received By Csl On 8th September a Friday. This letter was dated on the Monday 11th september

 

Even If Csl Had Sent The Credit Agreement On 15th That Would Have Given Them Just 7 Days To Contact Barclaycard And Ask For Original Credit Agreement, Barclaycard Find The Original Credit Agreement (off Microfiche As It Was Before May 2005) Take A Copy, Forward It To Csl Who Then Put A Copy In The Post To Me.

 

Who Did Not Receive It.

 

Does Anyone Think Csl Might Not Understand What A Credit Agreement Is?:rolleyes:

Not only do CSL not know what a credit agreement is but neither do Barclaycard. I sent a CCA s77/78 request direct to Barclaycard and got a copy of my original application form in return. needless to say I wrote back saying thanks but this isnt a copy of the signed , executed credit agreement within the terms of the CCA. Heard nothing back from them yet but their 30 days expired yesterday so officially Barclaycard are now commiting an offence.

Gazing into my crystal ball I see that we have established that neither Barclaycard or CSL know what a credit agreement looks like and that CSL don't even know what the date is.:o

 

Why does this haphazard approach of theirs not fill me with confidence regarding the way they approach their normal day to day handling of our accounts? :?

 

To think we actually trusted these people and companies with our finances.:eek:

 

Has anyone else noticed how a letter from any of them carries a date yet it doesn't arrive for several days? Yet letters we send arrive next day. Ahh the crystal ball reveals they are using pony non-express:p

Thanks everyone for the advice from some determined and well-informed people.

 

What I want to clear up is - if I send £3 for each m/f copy, will I be able to add this to my claim later? It's only about a year's worth, so I can swallow that for now. I got the last two years' statements and m/f brush-off promptly, so if I send the request with the £48 or so, does the original 40-day limit still apply?

 

In a Barclays bank thread, I noted that, amongst my bundle of statements, were several months'-worth of m/f copies, so it can't be too hard for them to retrieve (and I got my £10 back - not from BC, though). However, each m/f copy had, down the edge, other customers' details - name, account no., payees. Evidently, they frequented some of the same places as me, though the only similarity was matching 3rd & 4th digits in all the account numbers (possibly regional). Doubtless Barclays would say that, as m/f doesn't come under the DPA, they haven't done anything wrong there!

I Have A Joint Mortgage With My Oh, We Are Not Married And Have Different Surnames. My Barclaycard Account Number, Current Balance Etc Is Put On The Monthly Mortgage Statement From The Woolwich And Sent To Her.

 

According To Woolwich It Is What We Signed Up For When We Took Out Are Mortgage. Several Years Before Barclays Took Them Over. (Gypsy Rose Lee Again). Barclaycard Say This Could Never Happen Even Tho I Have Sent Them Evidence Of It Happening.

I Was Hoping To Be Able To Find Out When I Took This Card Out And Then Multiply My Charges By That Many Years/months. Only Thing Is I Cannot Make Out The Date. The Day And Month Are Legible But The Year Comes Out As Dots.

 

Can I Ask Is It Better For Me To Stick To My Guns Until I Get The Credit Agreement, Barclaycard Are Already In Default And Only A Couple Of Weeks Away From The Debt Becoming Unenforceable.(i Think I've Got The Wording Right). I Have Stopped Paying Them.

 

Or Should I Just Multiply The Charges I Have By The Full 6yrs And Go Forward With A Prelim Letter?

 

Anyone Any Thoughts On This?

 

Any Ideas Gratefully Recieved.

A story from a friennd of mine beats this

 

 

He had a credit card sent to him by Barclaycard, he and his father have the same middle inititials.

 

The card needed to be activated prior to use, yet somehow his father thought the card was his and got it activated

 

Result: friend sees bank statement from Barclays with Barclaycard balance of £300+ when he hasnt even got his hands on the card

 

They then claimed this couldnt of happened due to their 'tight security procedures'

 

!!

All I got is a copy of an application form which to my mind doesnt prove an agreement.I wrote to them and told them I was stopping payments as any agreement they may have was now unenforceable. Their reply was that my SAR had been complied with , that microfiche wasnt relevant and that was their final wrod on the matter lmao.

 

Not heard a peep out of them since early October so I guess it's time to kick them again :D

I have today written to my five defaulted CC companies to tell them that any agreement is unenforceable and that I consider the matter closed.

 

Now the waiting starts to see what they come back with. ;)

 

I'll share it with you all when they do reply.

Going To Get Ready My Prelims For 4 Others I Am After And Will Be Sending Out S.a.r.'s For 2 Old Accounts I'd Forgotten About And Found Reference To When Going Thru Boxes Of Paperwork. One's A Real Biggy

Then sent CCA s77/78 request. The 12 days are up tomorrow, without even an acknowledgement. 'Nother month and I'll be in the same boat as tamadus.

 

'Twill be interesting to see how this all pans out, wont it tamadus?!

 

Its definitely going ot be interesting. I haven't heard a word from them since I told them I was stopping payments as it's unenforceable, their reply was that my SAR was completed and that was their final word under the ombudsman scheme lmao.

Of my five defaulted CC companies three of them haven't even acknowledged my CCA request, despite having cashed the £1 cheques!

 

One of the three was chasing me quite hard until about three weeks ago and I haven't heard a peep from them since. :)

 

I'm waiting with bated breath to see how all of this pans out. :D

Do You Think It Is The Quiet Before The Storm. I Can't Believe No One Rings Me Any More. I So Enjoy Winding Them Up On The Phone When They Get Themselves In A Muddle.

 

The Woman At British Gas Who Told Me Just Because I Had Sent The Money And They Had Recieved It, Did Not Mean I Had Paid It. And They Would Be Taking Court Action Against Me To Recover The Money They Had Already Recieved!!!!

 

I Am In My Elements As For Years Now I Have Had To Take This Codswallop And Been Unable To Fight Back.:D

Do You Think It Is The Quiet Before The Storm. I Can't Believe No One Rings Me Any More. I So Enjoy Winding Them Up On The Phone When They Get Themselves In A Muddle.

 

The Woman At British Gas Who Told Me Just Because I Had Sent The Money And They Had Recieved It, Did Not Mean I Had Paid It. And They Would Be Taking Court Action Against Me To Recover The Money They Had Already Recieved!!!!

Call me stupid if you like ;) but you sent them money which they have recieved but you haven't paid it ? so they are going to start court action for the money you sent them but havent paid them yet ?:-|
