Yes you're right, I believe PCAD are now in breach of their duties. I emailed Mr B Turner on 14the July and have received only the inaccurate reply, sent on his behalf since.

My further requests for clarification have been ignored.

Do you know btw if it's the college in general who is deemed to be in breach or the individual the request was directed at?

just a quick question, is it worth FOI for the minuites of the meeting that have already been mentioned - the one where it states that the car park is still allowed to be used by students?

 

wouldnt this stop them claiming that the online information is incorrect?

Not that I'm suggesting that this is done, but I wonder what would happen if a still was taken from PCAD's own video of "the event", which didn't feature Fred. Then a letter was sent to PCAD (or someone working for them) asking if this is the barrier that was present when Fred exited the car park, and if so, what make and model it is.

Those minutes have been filed at Court already in support of an application Fred made last week. The Courts patience will be sorely tested if PCAD even tried to amend them or deny them.

Okay thanks Patma that's what I though but just wanted to check.

 

If there has been no clarification, completion or amendments then PCAD are now in default of the 20 day period. How many reminders did they receive just the one or was it two?

 

Reckon Fred has them over the proverbial barrel on the Data Protection Issues. We'll see what happens with the first one before hitting PCAD with a new action though.

Hi Patma etc,

I used to think that Thatcher was the biggest disaster Britain had ever suffered,but I believe now that the strings are being pulled by unelected faceless manderins and always has been .As regards standing up for yourself and others,there really isnt any choice .Better to fight and loose than go like a lamb to the slaughter.From what I read on here and from experience no political party is interested in the ordinary guy or gal.Personally the 1984 strike totally changed me,I have rarely gone out and socialised since,I look at all the excesses of the police and I am not even suprised ,one thing about me hasnt changed though I will always go to the assistance of the oppressed, I am not the guy in the video my forte is radio transmitting ,make of that what you will.Sorry about digressing good luck to fred,I will have a search to see what I can find out about biasd Judges,but I doubt there will be much that will have been recorded the judge I refered to removed himself when he was challenged about being biased.

It's very interesting to read how you see the situation we're in today. I very much agree with your assessment, especially about the political parties.

You say you'll always go to the assistance of the man in the street and I think that sums up what CAG is all about, because it all started for ordinary people without any particular legal expertise to stand up for themselves and help one another against the banks. Now it's grown out of all recognition and has had tremendous success in all sorts of ways. You're in the right place, Wobbly.:D

It certainly looks a lot brighter for Fred now the police are taking him so seriously.

 

As for PCAD......

 

With the distinct lack of proof available to them (remember they have admitted they hold no records, no documentation and neither do the company who installed it), their entire case rests upon the caution existing at the time of the hearing.

I hope any of the claimants 'team' who have been following this thread are just beginning to realise what a stupid mistake it was to have have rested their case on the caution. At least them being silly enough to admit that they do hold no records for this barrier or incident does mean that if any 'magically' appear (and we know what I mean by 'magically') between now and the hearing Fred will just rip out the entrails of their sordid little attempt on 'False disclosure' matters.

 

It's a lose/lose they've opened themselves up to, let's see that the Police keep up their end of the bargain it certainly looks hopeful from that email.

 

So they've backed themselves into a corner whereby to now produce evidence in support of their claim they are by default in contempt of the Court, if the police do come up trumps with the 'F' word in the original records or statements they are by default in contempt of the Court and of course if all goes as has been intimated by the police then they will be walking into Court without a case but that's not to say there wont still be a hearing of sorts.;)

Yes, TLD I agree, things are looking up somewhat and the mountain of paperwork, the court have seen land in their laps over the last week, will start to trickle through any day now and will cause a few anxious moments I should think.

I thought the clerk's rubber stamp was going to wear out yesterday LOL

Yes it's still very much a runner, but they're waiting for the file of evidence to be sent to them.

With deciding to concentrate on the police and the court, there just hasn't been time to deal with them too for the moment....oh yes and lets not forget the Solicitors Complaints Authority who have had 2 thick dossiers from us.:D

Oh yes.:D:D

 

As are many other offences such as contempt of Court, fraud, false accounting, obtaining monies by deception, extortion, harassment, false disclosure, tampering with criminal evidence, VAT fraud, using false instruments, smoking..... ooh there's a long list of things the Courts seem to actively erm... discourage.

Not being the investigating officer I couldn't possibly make comment whether anything 'discouraged' by the Courts has actually been committed by any of the parties involved or even whether any such thing has been alleged.

 

I do know for fact that none of the parties involved 'lit up' at the last hearing so everyones in the clear there.....:D:D
