Yes it is amazing how trusting we can be, I always assumed that the company's are somehow policed so that everything they said and did was legal and correct. I must be so thick!!

Reading through the post on these boards has been a bit of a shock , discovering the underhand tactics employed by the debt collectors is amazing.

The majority of the members on this site held that view, prior to becoming empowered with knowledge about their rights.

Has anybody else realised that the DCA's do not seem to be picking up their registered letters anymore.

I have three in the pipline at the mo all posted on the 13/10. and still not signed for.

 

I'd check that if I was you, I understood they got returned after 7 days non-delivery. You can do it online or by freephone:cool:

New to this site! Thanks for your advise so far , took some reading, but now i do need to post!

They issued us with a letter saying that we need to pay them with no dates, back in august- when we phone up they were dam right rude as they have been to everyone else, wont deal with payaplan happy to take money put taking to court for non payment and accountin default... they then sent us a letter for court not even a letter before action... payplan filled it all in , a ccj was issued by northamptn bulk office, with a fee of £96 when we can only pay £38, so we sent a letter to court asking for reconsideration its now in our local court and awaiting court date, we did issue a cca to link but they didint provide the details in the 12+2 days and now some 30-35 day letter they have sent what we asked for .....my question is even after they have accj can we still ask for it to be set aside as they didint have the proof and we only filled the papers as payplan advised us to...??

 

2. we als have anothe debt with GE that has been passed over to link, we sent a cca straight away again they failed to provide the details and they have just send us the details the deadline date was 6th oct, will that be in default? QUESTION: can they still chase us for the money if in default? What would our next pkan of action be on both accounts??

 

They did tell me that they was going for acharging order on the house?, do dea with debt managment kans, ive reported to TS , but TS advsied not to report to OFT as they only deal with financial companies not DCA!

 

IF THEY ISSUE COURT PAPERS WE INTEND TO DEFNED BUT WHAT WOULD OUR DEFENCE BE AS THEY HAVE SENT THE PAPER WORK FOR BOTH ACCOUNTS NOW JUST NOT IN THE TIME SCALE GIVEN...

Hi Somad, are the agreement in both cases enforceable, if you're not sure, post them up. If they do take you to court on the second one, there are other issues you can defend on, i.e., Default Notice not being compliant, The Assignment, cancellation rights, if they apply, etc.

 

Also, OFT do deal with complaints regarding DCAs, so you can certainly report Link to them.

Clearly their aim is to misdirect you into sending court paperwork to them instead of to the court ! The court then register you haven't responded and Link move in for the kill. How dirty can you get? So, if anyone is dealing with these cowboys be mindful of what they send you and do not be misdirected. There is of course no comeback on Link as it's your responsibility to get the response back to the right place at the right time."

LF went to court Northampton Bulk center and a court summons was sent to my home address.

They are now applying to a local court in Wales to get a charging order on my house and charge me interst at 19.95 % pluss court fees £170.

I went to my local CAB and their so called Financial expert was expected by me to respond to the court summons with a prepaired defence. He failed to respond, and LF won the case by default without any responce being sent by CAB(advice please)?

CAB now claim that LF assured them that the case was on hold (as they did to me on more than three ocasions by phone).

The next thing I know is the day I open a letter from Northampton County Court to say LF win there case by default as no responce was sent to the court within 7 days full amont now due pluss cort fees added.

My view is that firms such as Link Financial & Cabot etc., are breaching their own code(s) of practice thus breaching the CPUTR's by not treating their customers fairly!

 

The use of deceitful/misleading practices when issuing county court claims through Northampton CC Bulk Centre e.g:

failing to send out LBA's

serving vague particulars of claims;

misdirecting duly completed claim forms to their own offices as opposed to back to the court etc...

must be considered to be 'Unfair Practice' and abuse of the courts.

 

It has become increasingly worrying that these firms are using these deceitful methods, inorder to obtain default judgements!

Can you get a letter from CAB to say they were given this information by Link on the telephone ? That will help in your complaint to the regulatory authorities.

 

Are you going to attempt to have the judgement set aside ?

I always thought it was against the rules to offer further loans to those already in trouble. Links own pages are less than clear

i keep reading this forum, i havent heard from link since may now, when they apply to get a charging order against property, i assume you know and get something from the court etc???...... im worried because ive NOT heard from them lol....

Can you get a letter from CAB to say they were given this information by Link on the telephone ? That will help in your complaint to the regulatory authorities.

 

Are you going to attempt to have the judgement set aside ?

Because they are getting away with it, AC.. !. I am really surprised that CAB havent offered to help make a complaint in this respect as well. It doesnt look to good for them if they are just going to sit back and let this kind of abuse go on.

It is very important to keep our wits about ourselves in respect of Link Financial especially whilst the postal strike continues!

Link clearly will continue to use 'Unfair Business Practices'...

 

However, they cannot obtain a charging order on your house, unless they have taken you to court prior and obtained a CCJ.

 

I believe this matter re: the obtaining of default judgements is extremely serious indeed.

The CAB can make a Super Complaint, the OP needs to get back on to the CAB;

lets get this out in the open.

i was reading this forum just before bed last night, and then had trouble sleeping, not good bedtime reading is it!!!

its awful how people are being treated. im going to court a month from today, with HFO services, so im pretty nervous already anyway as never been inside a court room, and dont know what to expect, or say to a judge. but i guess i get my day in court as they say!.....

the last letter from link i have was a 'final response' regarding the complaint i made to them. and it says that after 8 weeks the file will be closed....how would you stand if a court summons was lost in post....!! i really dont want to open up a can of worms ringing them to see why they havent contacted me.:|

I would not blow this matter out of all proportion. If Link Financial issue a county court claim and it is not received;

you apply for a set aside.

I believe that we can take comform in the fact that, this thread was started in order to bring to the attention of ALL members, the Unfair Business Practices/tactics employed by Link Financial.
