      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

They sent you a really useless case summary didn't they - if I were you I would amend it - keep it to under 250 words - and send it back to them and ask if they agree your amendments

I will get this week end out of the way first then start collating all my info.

 

Shadow thanks for the offer the reason the post is long is because Optima have made so many errors with this case its unbelievable.

 

Late filling of documents to the court and me,to which they think by just apologising to the court everything will be fine.

 

Not complying with my CPR request until end of December 08 which was 2 weeks before summary judgement so denying me my right to submit a full defence.

 

Applying for the summary judgement in november 08 before they had supplied me my documents.

 

Falsifying the Default Notice which they are in contempt of court for as they did not supply the court the original DN but the fraudulent one which also does not comply.

 

Bring the claim to court on an agreement they now say in a witness statement is not an agreement but a pre-contractual application form.

 

and finally if both DN do not comply this case should not even be in the court system.

 

Do you all agree I have plenty to go on

Shadow my thoughts also but this is MBNA we are talking about here and they will throw money down the drain just to keep face and the chance they can get a moral judgment hence why they break every rule in the book

Bit odd that really isn't it - they'd rather go to court (which in this case means you have bought their shoddy tactics to many people's attention, causing them to say no to MBNA too) and risk you publicly trouncing them, than quietly admit defeat and be able to happily go on to prey on others who are none the wiser.

 

I feel I'd do a better job running these places. I have no business understanding whatsoever, but I do manage to use a modicum of common sense and a reasonable degree of logic in my decisions, which they seem to lack entirely!:rolleyes:

The statements they have sent me, their are many missing i wonder why perhaps to conseal my ppi payments to make it hard for me to work out what ive paid ?

 

I do i have one though with the balance zeroed and another with a differant number.

Yes citizen something that is also odd about those statement they sent copies of copies in the same envelope two of the same and in some cases three

This is an American company we are dealing with, and we all know how American's work (sorry no dis-respect to american's as individuals). Their gov't decided to invade a country against the advise of the UN, says it all really. Corporates are no different.

Hiya All,

 

Just an observation on the charge off statement below which ill add is a totally different account number they have added two court fees before the charge off, is this common practice are they within their rights to do this.

 

I ask because those amounts have also been added to Optima Legals fees

I think you are going to have to ask them to account for those 2 entries. Both on the same day for two different sums.

 

What's this about different account number?

If there are missing statements - make an application on an N244 for an order that they supply them - explain on the N244 what your personal circumstances are and ask for an order without a hearing
