Thames Credit Asking me to ring them after CCA request sent

Hi Everyone,

 

Hope somebody could help me please.

18th April i received a letter from Thames Credit , stating that bAktiv Kapital Group had bought the interest of Halifax PLC in the debt that i owe them , the usual jargon then stating that Thames Credit are acting on behailf of Aktiv & that they are now the legal owner of the oustanding balance.

 

Requesting a "prompt reply " i next day by special delivery sent a CCA request together with a £1 postal order.

 

I've just got in from work to receive aletter from Thames dated 24/04 stating - "In order to assist us in investigating & resolving the issues you have raised, we would ask that you contact our customer relations team on the above freephone no.The purpose of the conversation would be to ascertain certain important facts in relation to this matter, which will assist us in complying with your request and/or resolving your query.

We look forward to receiving your response in connection with this matter by telephoning (................ ) "

 

Can anyone please help with what my nextmove should be ??

Think the debt is from around 1995 -1996 & no payments have been made since then so hopefully have got the statute barred up my sleeve, but was just wondering what to do with the tel request & there non compliance so far with CCA request.

I agree dont ring, you could send another letter if it is worrying you reminding them of their obligations re cca but personally i'd sit on it and wait dont worry its typical scare tactics and from your post its doing what is what designed to do .........worry you......please don't

you could reply to them with something like this

Dear Sir/Madam,

 

With reference to my previous letters, I wish to draw you attention to your company's lack of compliance with my legal request.

 

On **DATE** I made a formal request for a true signed agreement for the alleged account under consumer credit Act 1974 s77/8.

You have failed to comply with request, and as such the account will enter into default on **DATE**.

 

The document that you are obliged to send me is a true copy of the executed agreement that contained all of the prescribed terms, all other required terms and statutory notices and was signed by both your company and myself as defined in section 61(1) of CCA 74 and subsequent Statutory Instruments. If the executed agreement contained any reference to any other document, you are also obliged to send me a copy of that document.

 

As you may not be aware , failure to comply with this request within 12 working days renders the alleged debt UNENFORCEABLE in law. Furthermore, if this non-compliance continues for a further month then a summary, criminal offence is committed.

 

Furthermore you should be aware that a creditor is not permitted to take ANY action against an account whilst it remains in dispute.

 

The lack of a compliant credit agreement is a very clear dispute and as such the following applies.

 

* may not demand any payment on the account, nor am I obliged to offer any payment to you.

* may not add further interest or any charges to the account.

* may not pass the account to a third party.

* may not register any information in respect of the account with any credit reference agency.

* may not issue a default notice related to the account.

 

 

 

 

 

I would appreciate your due diligence in this matter.

 

I await your rapid response.

Roberto do not waste your time writing and thus let them know what you know about CCA requests. They get plenty of CCA requests every week and are hoping to confuse you over the phone.

They have 12 working days to respond to your first letter. If they are stupid enough to be waiting for you to call them and not complying with the Act, then that is their lookout. It is not your job to put them right. You have made a perfectly legitimate request and if they don't reply in time then so much the better for you.

They would not give you an edge, so do not give them one. Just sit tight and wait.

The time to write is after they have committed a summary offence and that letter may well give you so some real pleasure.

Hi Guys - Just an update for you - No contact at all from Thames Credit until a letter received today dated 21May.

 

"Further to our recent correspndence in connection with the the above ref matter, we note that we have not yet received a response.

We are endeavouring to resolve the issue that you have raised, but require further information from you in order to do so.

Without your assistance, we will not be able to resolve this matter as efficiently either of us would wish,

we would therefore request that you contact our specialist team on the freephone no, who will be able to assist in resolving this matter.

We look forward to receiving your response as soon as possible, so please telephone us on ..........."

 

What do you think my next move should be guys, My CCA request was sent Special Delivery on the 23/4 with guaranteed next day delivery.

Had one of these letters. Except in my case, all I sent them was a common financial statement ... and got a pretty similar back to yours ... wierd. As it looked 'dodgey' because of that 'we are launching an investigation, phone us etc etc' I ignored it, ever phoned, never will.

 

Already very good advice here but ... they could also be phishing to fill gaps in their 'history' of your account. Least, that's what occured to me when I saw the letter I received cos I certainly hadn't CCA'd anyone back then before I knew how to do it now.

 

Strikes me that could also be what they are doing with you as well. So don't contact them. At least by phone. It's what look ... said. Give them an inch they will take a mile.

What part of CCA request did they not understand?

 

I suppose you could send them a written 'response' simply confirming THEY have not yet responded to your legal request and you cannot address the matter further until they do.

 

!!! DO NOT CALL THEM EVER !!!

Hi there i work for aktiv kapital group i wish people didnt hate us that much we are only doing our jobs and i would like to point out i try and help customers the best i can and try and work affordable plan with them just to let you know thames credit is our sister company based in kent our relations department are the corrospondance team who deal with all our customers requests by writing if we ask you to call its only to help you!!!please ignore other stupid comments of other people and i hope you get your cca request sorted

Next day delivery meant tc received your letter on Apr24. 12 working days from then means the limit expired on May 13. They are in default. The calendar month kicked in and the criminal offence will be committed on June 10. Allow until June 12 for any Royal Mail delays.

 

On June 13 I would write to them and inform their topman the company are in breach of your request and you require their written confirmation the matter is closed. Give them 7 days. Tell them you want details of their complaints procedure sent as well.

 

If they ignore your request for confirmation of closure and details of the complaints procedure shop them staright away to the Financial Services Ombudsman.

ignore the scumbags they tried this on me as well, Thames gave my data out to BCW to collect a debt on their behalf and they even sent a solicitors letter , I sent the solicitors a CCA as well as BCW. Got my £1.00 back from BCW saying that they would asked Thames to send it to me direct but of course I never got not CCA,

I then sent a S.A.R - (Subject Access Request) to the OC barclays and after a commotion with them sending old statements with not agreement, I finally ha d to write to them and I copy the Information Commissioners Office in as well barclays finally wrote to me stating they held no more data on me and my last payment with them was 8 years ago.

 

I should say that after BCW returned my £1.00 stating that they would get Thames to send me the CCA, they gave me details out to Scottcall so I had to put up with their nasty letters as well.

 

These thugs were trying to get money from me without any authority whatsoever. If you think that the debt is over 6 years and you have had no contact with them sent the a stature barred letter. :|

Well, you said it. CAG is a wonderful place ... because without it people wouldn't know what their rights were and the companies would take advantage of that. Need I say more?

 

Back to watching Eurovision, cos no wish to engage in an internet flame war. Roberto69, there is some excellent advice here ... as I am sure you know.

 

And I've already wasted 30 seconds of my life wondering I wanted to reply to that. :D

A CCA request is simply that, it does not require any further information, just a copy of the agreement, and a set of terms and conditions.
