even with amended POC's what are you expecting?????

 

I have sent 4 Govan letters and had the near same response from all 3 banks... They already knew about the amended letters and have collectively battled against it...

 

New POC's aint going to win this fight... hence the reason they have taken so long , even Martin Lewis is distancing himself from them....

Only direct action by the masses will work....

 

Look at all successes they have never come from negotiation!!!

WHAT WOULD HAPPEN IF EVERYBODY IN THE UK OR AT LEAST A VERY LARGE PORTION STOPPED PAYING UNSECURED DEBTS????

CREDIT CARDS, UNSECURED LOANS , STORE CARDS ETC??????

Only direct action by the masses will work....

 

Look at all successes they have never come from negotiation!!!

Single point attack or multiple? I haven't seen a multiple offering but that is one thing the GLC man recommended; presumeably that is what we will be provided with - whenever.

Also any chance of a sight of their reply?

Hi Guys,

 

I also sent the Govan Law Centre letter with personal amendments (to LTSB, my claim is stayed at court) and the reply was the standard generic 'we're looking into your complaint' type requiring 8 weeks for resolution. I have copied my letter and their reply to my court requesting a further 8 weeks stay extension while I wait LTSB's decision and have yet to hear back.

Hi landy/kenny, I had that letter landy had and just a week later got the sod off letter... 4 different banks , not all for myself but thay all said pretty much identical stuff..... These letters have been prepared in anticipation of the govan letters I can assure you... They are to similar not to be pre organised....

There is no hope of getting money back they have the bat needed to smash claims back... supreme court ruling.... we are all losing sight of right and wrong.... read an earlier post I copied from bob bankbuster... sets it all out very clearly... this is a set up and we are able to do nothing there are 1800 daily guests on here and just 300 caggers they now what everybodys next move is and have already prepared response.... I would suggest a little more direct action be discussed..... ie stop paying unsecured debt, clear out savings and cause a run on a bank and a mass protest at how we are having teh wool pulled over our eyes.... supreme court stated decision would not solve myriad of cases, however it clearly has.... you will see when you get response letter in a week or two????

I think we need to keep all of this in perspective, this is all still very new and there is a lot to digest. I agree there has most likely been corrupt style back room deals going on but the picture is bigger than this.

 

I don't believe the argument is over but we do need to adopt a smarter approach and this time ensure the OFT have nothing to do with it.

 

As much as I'd like to see a bank put in its place this will never happen as the British public are too disorganised and the sense of spirit the country used to have that we now need has long gone. As such the banks will continue to do what they want and we'll simply have to like it. Unfortunately, it's the cost of the society we have all helped to make :-|.

 

Time will tell but I for one have not thrown the towel in just yet.

Basically if the OFT had not got involved and then got it wrong, we woudl still be proceeding with our cases. Even more annoying is that we had to wait over 2 years for this verdict.

I would like to continue to pursue my bank regarding unfair charges using the section mentioned by the appeal court. It does not seem as if Martin L and his QC have been able to put anything together, but is ther anything stopping us pursuing it on an individual basis demanding that the bank give a breakdown of their costs involved in returning a DD or even allowing an unauthorised overdraft.

Has ML and his QC concluded there are no further options yet? As for asking the bank to detail how they arrive at £30 for a computerised DD refusal they've always insisted that due to competition sensitivity that they won't reveal. Nonsense of course, a bank is a bank, they're all at it.

 

Interested however in the fact that you can still claim unfair relationship and the burden of proof falls onto the bank to show their costs are proportional to their supposed loss caused by your breach. If they won't detail how they arrive at £30 for example then surely that's enough to demonstrate the relationship is unfair? Can't have it both ways, bank or not.

Bank charges more expensive than payday loans

Taxpayer-funded banks are slapping hard-up customers with fees and interest equivalent to more than 3,000% a year, according to a Daily Mail investigation.

This makes banks more expensive for short-term borrowing than payday loan companies and dodgy back-street lenders where the amount borrowed is often dwarfed by charges and interest.

State-backed Lloyds Banking Group offers the worst value for money for customers slipping into unauthorised overdrafts. Lloyds TSB charges a massive £216.32 for someone who goes overdrawn by £150 for ten days.

While Halifax, also Part of the Lloyds group, charges £50, and Barclays - which was not bailed out by taxpayers - has a charge of £44.

According to the Daily Mail, these charges exceed those charged by many of the controversial payday loan companies, which offer short-term loans at astronomical rates of interest.

Lloyds TSB charges a massive £216.32 for someone who goes overdrawn by £150 for ten days.

One such company, Speed-e-loan says its interest rate adds up to 3,142% a year for someone wanting to borrow £150 for ten days. But providing the loan is repaid on time, the cost is actually £20.44 - one-tenth of what Lloyds charge for unauthorised borrowing.

Chris Tapp, director at Credit Action, says: 'People don't realise how expensive unauthorised overdrafts can be, as they don't have to display the annual percentage rate (APR) which shows the true cost of borrowing. When you talk about payday loans being a cheaper form of borrowing, it is very jarring.

'If people could actually see just how much they cost, it would give them much more incentive to stick within their budget. The way the charges are levied can lead people into a spiral of debt, as they get charges on charges. And these are not fringe lenders; these are the High Street names, some of which we own.'

Not all the banks charge extortionate rates for unauthorised borrowing. For the same amount borrowed over the same period, HSBC charge a fraction of what Lloyds TSB do, with a 0.75p levy. While building society Nationwide charge £20.78.

Marc Gander, from the campaigning Consumer Action Group, says: 'It's disgraceful that those who are struggling the most are hit the hardest by these excessive fees. Where are the regulators to ensure customers are treated fairly?'

Something Has To Be Done................... And Quick

 

Historic charges are now gone imvho except for some very special circumstances that will need personal POC's and hardships that can be shown to come from the charges themselves.

 

I would expect that something will appear just before the general election to show how each party is working on behalf of the downtrodden consumers...

 

Just my thoughts tho.

I cant figure out or find out what happens when the stay runs out on the court case. Mine does in a week. Is it thrown out of court and then you have to pay them the charges on charges or what? Or can you extend the stay as I have seen mention on this thread and see if anything turns up? If you just discontinue cant they get you for costs?
