    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

He was using YOUR money to watch films - what has several films (including Oceans 11 amongst others) got to do with Jacqui Smith representing her constituents?

Indeed. Where I work you'd be looking at disciplinary action if you claimed movies, excessive drinks etc. through travel expenses. Not that you'd be able to because they scrutinise each invoice you submit and query all that stuff.

 

But that's the private sector. It seems the public sector is a free-for-all?

That said, at the company I worked for before this one, expenses were a joke. Staying in a hotel you could claim what you wanted because no-one at the company saw the invoice as it was all handled through a booking agency, who paid for it and submitted one big bill to my former employer every so often, so your inflated claims were always missed. One of my colleagues ran up a £400 hotel bill over a two night stay; bearing in mind the room rate was £80 per night that's a fair few drinks...

 

So maybe no-one was checking?

I suppose, with a Bank Holiday weekend approaching, we can expect postal threat-o- grams to appear, and several very worried people who have not found this site will be scared S***less

 

It seems to be always the same when the support offices ( CAB and the like) are shut down

Would it be wrong of me to mention what my friend did some years ago now? He got the reply paid freepost envelopes for several DCAs, boxed a brick for each one, and stuck the freepost address from the envelope on the top. Then marked it FRAGILE - IMPORTANT DOCUMENTS ENCLOSED and whisked it to the post office. I think it was something like £10-£20 worth of postal weight. After doing this twice to one creditor, he never heard from them again :)

Of course i would never do this :)

 

(I have a brief case full of reply paid envelopes for various DCAs if anyone is interested, maybe i should list the idea and the included envelopes on Ebay :D)

Watching TMF on Freeview shocked me the last night. All those attractive females in their underwear staying at home waiting for guys like me to phone them. :rolleyes: I can go out myself and pay an average of £1-50 a min to chat to girls that aren't really interested and just out for a few free drinks.

 

Guy's boast about how much a night out has cost them. Girls boast about a night out costs the taxi fare home and they get drunk for free. That's why they can afford £300 on a handbag. :D

Not done the call yet, but I will be soon. Only just got credit on my phone. Money is a bit tight at the mo.

 

I'm so skint at the moment, that tonight I had to go to KFC and lick other peoples fingers. ;)

 

Anyway, back to the DCA Easter weekend threat-o-gram thing.

I have a feeling I'll be getting at least 3 "Pre Court" theats with extra red ink, because they know I can't write until tuesday and will be so scared I'll have to phone them instead.

 

I want to be a W**ker like Mr.Ton. Only I will be recording it, and using it as evidence against them.

 

My only dilemma is how to offer to pay them. :confused:

 

Do I use an Easter card....3 toy yellow chicks if they promise not to send the bailiffs in to reposess my latest bargains from Poundland.....

 

Nope, I'll pretend to believe everything they say. Let them break lots of laws and guidelines....Then inform them of their huge mistake and let Youtube peeps and the OFT deal with them. :D

After a number of complaints the makers of the game Cluedo have made a simpler version of their game. It will include a non British character. So now you only have to work out how and where they did it.

 

Instead of worrying about everyone else, how about we start sorting out the mess in our own country for a change? Then we might actually get somewhere.

 

Or would I be considered racist for even mentioning it?

Had a bit of fun earlier in the kitchen with the family present and told my dear Crap1/Debitas caller that they couldn't talk to my OH because he had just left the house for a drive in his new Bentley:eek: And I did it all with such a smile on my face and such a sympathetic tone in my voice. You should have seen the kids faces :lol:
