  2. Hi everyone, thanks for taking the time to read this and for any input you may have. I've received a default costs certificate from preston county court saying i owe £7000 to a solicitors/insurance company who i had a personal injury claim against (passenger in a car accident and my driver was at fault). turns out my solicitor at the time filled a notice of discontinuent to the court and pulled out my claim without my consent back in july 2010 and ive heard nothing about it untill now. on the 9/4/13 i received a copy of the default cost certificate from there solicitors stamped and dated 9 january 2013. I've now got another solicitor looking at a possible case of professional negligence against the solicitor who delt with my claim but there threatening me with further action if i dont pay up. I've no savings to pay it and my incomings only just cover my outgoings but there charging £1.52 a day interest. i live with my partner and child in a mortgaged house with no equity possibly negative, and nothing to sell to raise funds to pay. what can i do or what can they do? i dont want to loose my home. please help. thanks
  3. Hello guys, I hope you can help me with this, it's all new to me. My mother is 90 and we had a bit of a crisis last week after a fall and some other stuff. She's in hospital now and waiting to go into a nursing home for at least 6 weeks. After that, we don't know if she'll go home and have help there or will need to go into a home permanently. There isn't all that much help available to fill the form in, but I'm going to try to fill it in online. My first question, will the system let me input it on her behalf, do you know? Second question, she doesn't use a mobile phone and wouldn't hear the other person anyway. Do I put a member of the family as a contact number? I shall be very grateful for any help you can offer. Hello, could someone please help with a problem my son is having.He was on CB ESA,6 weeks ago his payment didn't go into his bank and when he phoned about this he was told that he had been on the benefit for 12 months and had been sent a form to apply for IR ESA, he never got the form but of course the DWP won't accept that,he then filled the form out and took it to the Jobcentre,he waited while they faxed it through to the relevant department, he was told as he has no other income or savings that they would speed his claim up and it should be sorted within a few days,6 weeks later and he has still not had a penny,he has explained to them that his flat has gas and electric meters but as he has no money to top them up he has no means of heating,having a wash or cooking apart from all his other bills mounting up. Today he was told that the reason for the delay is that the person who faxed the application form did not attach a note explaining what it was for,my son asked to see a manager who told him that was rubbish as the form itself gives all the details needed,even though he has had no money for 6 weeks they told him they cannot give him any help, I am trying my best to help out but I am on benefits myself,he just doesn't know where to turn to next so any advice would be much appreciated.
  5. last year my matrimonial home was sold and i rec 40.000 from the sale .at the time i was on income support so it was suspended naturaly . i payed my rent and bills ext but as im not used to having lots of money i have spent most of it .i have 2 disabled children and im a single mum i bought us a good reliable car for 7.600 as i knew i would never be in the position again to aford one . i never kept cheqe on my acounts properly and spent a lot of money on my children i basicaly gave them all the things i couldnt aford before .i im my eyes gave them a better quality of life .i thought this was mine and the kids money to spend just as if it was a wage . now ive hardly got any money left and put a claim in for income support .first they asked for 6 months bank statments then they asked for statments from when i got the money of which ive sent to them . my friend had told me i might get into a whole load of trouble because of my spending and be charged with benafit deprevatin im so scared i had no idea about that at all i didnt think i was doing any harm like i said earlier i thought it was our money to spend .someone please help me i cnt sleep on a night with worry i dread the phone ringing and feel like a criminal .
  6. Hi, Im hoping someone may be able to help me out with a bit of advice, im currently an assistant manager in the retail industry, it is a large retailer across the UK and Europe. Im finding myself demoted with 3 days notice and the reason for this demotion is that the Store manager above me is under performing and will be being demoted into my current role, as a knock on effect of this i am required to also take a demotion, losing my manager status and my monthly salary. The short story is that my manager is under performing and will be being demoted into my role, therefore i am required to demote myself and return to an hourly paid role on the shop floor. The only alternative i have been given is to transfer to another branch ( very inconvenient ) and continue my role there. Any ideas where i stand with this would be greatly appreciated, stressing out here !!!
  7. sorry if this is in the wrong place but my heads a bit all over the place i keep recieving letters for my ex partner who moved out nearly 12 months ago regarding a council tax debt from his previous address in a difference council area and town. well several times ive rung up the agency (including 2 days ago) saying he doesnt live here toget "not a problem we'll have your address taken off"etc etc well today theres a knock on the door from my neighbour saying they had had a letter from the agency to ask for information on my ex, apparently they've been sent to all my neighbours, im absoloutley devestated i rang them and the girl says they can do that and that im probably lying about him being there as "they oftern get lied to about this" and that i wouldnt of been told i can have my address taken off becuase they arent allowed to do that! yet other agencies ive rang up ragarding my ex have just taken my name off i have seen or spoken to him in nearly 12 months and theyjust keep dragging it up and contacting my neighbours, im so upset and im unwell anyway i cant deal with this stress, im trying to get on with my life and hes just refusing to sort his debt from before we were even together does anyone know anything i can do?? it just doesnt seem right
  8. Hello People I'm being taken to court for the finance co to get possession of my car due to missed payments. I have a couple of issues which I would like someone to clarify if possible please. (Bear with me it's a case of one HP agreement forming part of the current one) Previous car loan was applied for by OH and all negotiations were between him and salesman. OH couldn't get credit so over the phone salesman asked me if there was anyone elses name he could use as we would lose the car otherwise. Reluctantly I gave mine - doh. I was asked to sign some forms and we had the car. I had no idea what the payment terms were at time of signing since OH had agreed the terms not me. (Was this mis-sold to me because of this? It was late 2005 and I had no pre loan info whatsoever either) FFwd 2009 bought another car with £1000 owing on first car. "Not a problem, we can sort that out" says the salesman. I was asked if I wanted a warranty, 'no' I said. Next day I had a call to say 'new loan is agreed and we're throwing in a free warranty'. Great I thought, this is persuading me to def take the new car. I'm now being taken to court as I said so after looking at my HP agreement and other paperwork it turns out the warranty was not free and the RTI insurance was only for a couple of years but I am paying over the life of the loan which I didn't know. So can I counterclaim the warranty, RTI insurance, late payment £30 fees, and the £1000 added onto this agreement from the first agreement since I wasn't told that this is what they were going to do? Had I known I would not have gone ahead at that point, I would have waited the extra 4 months and paid off the first agreement because what is 4 months when the first agreement was over 4 years? Can anyone offer any advice since I have 9 days left to file my defence. Thanks
  9. My late faither in law died owing us several thousands of pounds - He had cancer, we paid for some of his surgeries and sent him and his wife money to live on as they were broke. They had been trying to sell their villa over there to pay off the massive debts they had incurred, they owed every body money. To cut a long story short my mother in law finally sold the villa. We assumed we would be paid the money we lent them. The problem now is that she is denying the debt. We have bank statements to prove we paid them the money. She is saying it was gifts. We employed a solicitor in this country to act for us, but he has been less than helpfull. She does not attend her solicitors appointments and is completely ignoring the situation. Can we take court action against her in this country or does it have to be done in spain? Any advice would be greatly received.
  10. We are in a position where we can no longer afford our mortage and are 7 months in arrears. We have had the house up for sale since May and have reduced the price 3 times but have only had 3 viewings its not overpriced but nothing is selling in our area. We have our first court date in a weeks time and to be honest I've been burying my head in the sand, we did have somewhere to move to but thats fallen through and the council have been no help. We have 5 children 1 whom is disabled and I have no idea what to do. I'm so scared of being homeless especially with christmas coming up, is there any way to stall things? I've been looking through various posts and found one by someone called debtdoubter09 who seemed to be in a similar position last year but I can't find any posts saying how she eventually got on. Is there anything we can do to stay in the property till its sold? Just to give us the extra time to find somewhere to rent We could probably afford to make token payments of say £500 (normal payments are £1290) All my children are little and two are under 3 we have no family to help. I don't even know how to start filling in the forms from the court I just burst into tears everytime I look at them. My husband suffers from depression and just can't deal with this at all. Please I just don't know where to turn, I've tried shelter but I can never get through. If
  11. hello someone told me that somebody might help me im so streesed out and i feel just awful , i care for someone , a friend he is 37 years old i have known for many years , after he lost his partner 8 years ago he had various mental health issues and an obsession that everyone around him might die would result in endless panic attacks etc , on august the 7th his cousin died and he only has a few people in his life his cousin being one of them .now the way he goes about it is ,pretending that it has not happened i know that is not the way to deal with things but i respect that we are all different so i go along with it and dont mention it ,if someone mentions any death we all know (those around him) that we have to stay with him ,my main concern being hes too unpredictable, well he had a medical and i phoned up the atos healthcare center the day before and was told to leave my phone number and the person i was ringing about and they would ring back when it was less busy , i totally forgot about it and they did not ring back ,well on the day of the mdical i rang my friend up and said that i couldnt take him as my tyre has blown (which was obviously a lie i didnt want to mention the death he was dealing with) my reasons for ringing the medical health center was to explain that taking him to the medical was too risky and if i could re-arrange another appointment in the next 4 weeks and that would give me time to get him an appointment with the DR and get medication to keep him calm etc now he never reads mail but he opened the department of works and pensions letter and filled out some form saying "why did you not attend" and he put the blown tyre etc and his brother mailed it off , well he had a letter back saying that his reason for attending was not good enough and have stopped all his benefits and even his housing benefit and council tax benefits i dont know what to do , i dont want to mention what the real reason for taking him to the medical was because i know he will sink into depression etc so its all my fault that this has happened to him , i cant sleep i feel so guilty all i got going round my head is why didnt the medical center people ring me back or have someone actually answer the phone when you ring He's had an appeal form sent to him and i told him i would take care of it and i dont know what to put
  12. Hi have had a loan with toothfairy for well over a year now, have commented before! I have paid back just over 150 now , called them today to try and clear the original loan of 400 plus interest. I have been paying back weekly 5 to 10 pounds. I have just over 300 to hopefully clear the debt but they have refused it marshall hoare. Do i pay 300 and then say paying no more or carry on with a minimal payment ie 1 pound as they wont accept the offer? thanks
  13. Hi everyone, I know there are a lot of questions like these but i wanted this cleared up so i know how to deal with my debts. I currently have a few defaults on my account from about 3 years ago and less, i never bothered dealing with them because i was out of work etc. I still owe the original amounts to these debts and am going to arrange repayment plans with the debt collectors shortly. Because the defaults are so old, they are offering 50% settlement offers. So i have the following questions if you don't mind answering: 1) If i settle the debts paying the 50% off settlement figure, how will this show on my report? 2) I know defaults stay on the account for 6 years, if i went into a repayment plan and paid them all off in full over the next 1-2 years, does this mean they won't drop off the account for another 6 years after they're settled? Or do they drop off the account after 6 years from the original default date regardless? 3) When i spoke to a women on the phone she offered me 50% off if i could pay there and then, but she said it will only show on my account as partially settled, how will that affect my report instead of being settled in full?   14. A 21 year old friend recently entered into a contract for an iphone for her landlady who has bad credit, in her own name. Now that she is moving out she wonders if it was a wise thing to do! Currently payments are £20 a month and have always been made on time. Any Advice?
  15. Hey guys I am really curious to know what the rules are for demoting someone at work.. I have a manager in one of my stores and he is doing a poor job. Basically his general attitude and belief towards work are not in line with what I want and I don't believe he is going to change. he is too soft on his staff, and let's them get away with things. He has a different management style to mine, and whenever I try to make him see it my way, his response is "we will have to agree to disagree".. He doesn't see that it is his soft attitude that is causing staff to like him and not in fact because he is a good manager .. He has been in that position for 2 years and with the company for almost 5 years. I don't want to sack him, as I could use him elsewhere ito do other tasks, but I do want to demote him, either from his managerial role completely or put him as assistant manager to someone else who will be above him. I just wondered what the rules are for demoting someone? Is there a process I have to follow? As I understand it, I can demote him but still keep his rate of pay the same (which I don't want to do). I should mention he is also on a bonus structure. Any help would be really appreciated guys.. Paul
  16. Hi, Can you just confirm that I have this correct. Loan 5000 PPI 1972.11 Monthy amount 152.78 over 5 years. (mad, how could I have been such an idiot) So it is 28.28% which works out 43.206 ? is this right? Any mathematician out there can just confirm for me I would be really grateful.
  17. Hi I've been promised a payrise on the condition that a colleague passes his probabtion period. This colleague works in a related department but we have very different roles and I've been here a couple of years longer. Also, I'm not confident he will pass his probation! Can my payrise be dependant on the performance of someone else? Thanks JP
  18. I have a son who is permenantley in a wheelchair and recieves the higher rate DLA. He is attending a residential college and as such the authoroties have stated that he is not entitled to the carers allowance while he attends the residential college. Is this correct?
