  1. I think on this occasion the company has acted well within the law, I would have felt the same way as the manager if you tried to blame me for parking fine. Yes it was gross misconduct, You also said you never took a day off sick but then state you were signed off work for 2 weeks by doctor. As you hadn't worked there for 2 years you arent entitled to an employment tribunal, and if you were I suspect any legal advice would be to not to proceed. I'm sorry I cant be more positive you have learned a harsh lesson about lying to get out of parking tickets.
  2. Before agreeing to settle this debt did you check if it was Statute Barred? if not you should have done. I believe by acknowledging this debt you have set the SB clock again. Have you checked they had a valid CCA? If you have not done these then let others guide you as to if you should be paying Lowells anything at all let alone 30% of debt.

  5. Its speculative invoice it is NOT a fine. They may write as much as they like but will give up after a few letters. Look on Forum at previous Parking tickets by private companies. So ignore demands they wont take it to court as it stands as much chance of winning as I have been named next Pope. It's all threats just keep all letters dont respond and they will move onto another victim.
  6. Dont ring bailiff for the moment lets parked them to one side, was you on ESA when Council tax was built up? The council may have no choice but to deal with you as I believe you may be classed as vulnerable. Just wait a bit for others advice as some may have better info regarding ESA and vulnerability
  7. if its a council or Housing association property you wont be allowed to and if you do and are found out you will be evicted. If its your own property and with a mortgage you wont be allowed to either.
  8. I had them phantom up a £50 payment when I sent SB letter but a couple more letters (and I wish I used wazzer on it) they accepted they made a 'mistake' so dont be put off if they phantom a payment just come back here

  11. yep its Statute barred from what you have said Muck Hall specialise in Statute Barred Debts. The letter is in the library on the forum, also they are not allowed to call your husband at work so thats a complaint to OFT about that.
  12. you could go to your local trading standards and ask them to investigate this matter, I'm not sure but there may be a letter in the library on this site, to deal with this. I would personally just bin them and ignore them.
  13. if its statute barred I would ignore them,& their very kind offer. when they offer you discounts etc you can bet your last pound its statute barred. so ignore them and they will move on to someone else

Theres a letter template in library to stop calls however I think you have to divulge your address to send it but then you are setting up a paper trail for any further correspondence if they use it for further correspondence. I have used the template to stop calls and to be honest it stopped all contact from the DCA as I suspect they realised I had been given professional advice. Others may offer further advice so sit tight for a bit. In the meantime please record calls (if you can with device) if not then write time of call, length of call, brief transcript of what was said (maybe worth writing a little script before hand) and any names of person calling. If the harassment continues and you make a formal complaint this will aid you.
  15. really I would ignore it, Muck Hall are very well known for being muppets (sorry for offending Kermit and crew) others may help as tp how to legally deal with it but I would suggest you contact local trading standards and complain

  17. if its passed back to council they will probably contact you to get payment, and if you have been paying them regular amounts at regular times it goes well for you with them setting up repayment plan as you can show a record of payments. if bailiff shows up dont hesitate to get on here but just dont talk to them

  19. Contact council and tell them about your situation, they have to take debt back as you classed as vulnerable person. DO NOT RING the bailiff. out of interest what council is it? if its revenue is outsourced to Capita you may have trouble (you might not) as Capita own Equita Bailiffs. if you do have problems post back here and we will advise further and the bailiff doesnt have a van round he corner to seize your goods. also did he do a levy on goods if so can you list what goods he listed.
  20. its a fishing trip, the mistake you made was ringing them in first instance, some questions, how old is the debt? have you checked your credit file? and they cant contact you at work
  21. You are classed as vulnerable and should not be having bailiffs visiting, there are people who will advise you as to how to proceed but dont panic. They cant take mobility car, they cant enter your house (unless you leave a door open or window so keep them locked) you dont have to speak to them, please wait until people who can advise you about vulnerable status have replied. Just one thing when you do get it back to council please keep up payments and only offer what you can afford, be realistic. I highly suspect that Newlyns wont be attending it is more to frighten you into ringing them. But if they do turn up remember you dont have to talk to them, in fact I would advise not to they are highly skilled in threats and getting you into payment plans you cant afford. So just wait for advice over vulnerable status.
  22. That is very scary but not surprising they may need to check nearest landfill next to ATOS they may find some appeals (been checked that statement by lawyer and its not libelous)
  23. right pay the council direct, but use online system (they will turn you away if you go to pay in cash) there was no need to panic over this. Is there a list of charges and if so what charges did he put? Are you paying the 10% or the full amount?
