  1. thats very very unusual, I've got someone through 3rd suspension but never got past 4th, I do know one judge does not like granted evictions so upholds suspensions, never been lucky enough to get him, sometimes its frustrating that you get a suspension for someone who within 2 months are back not paying a penny expecting to get another suspension, but its worth helping for the genuine ones
  2. I take it you have made arrangements to pay arrears and current payments to get warrant suspended? If you keep to this agreement you shouldn't have any worries however if they need to restart the warrant you will be given notice of the eviction date, you can the apply to the court to have warrant suspended, you will go in front of a judge to state why it should be suspended and of course the other party will say why it should carry on. If this is your first application to have warrant suspended normally the judge will allow a suspension. If it is a second suspension in front of a judge, in my experience, you have a 50/50 chance of suspension. and if its a 3rd time you have very little chance of suspension. If you have an agreement in place to pay arrears plus present rent/mortgage if for any reason you cant pay I would advise you speak immediately to the company, that way they are more likely to give you a little extra time. Please dont bury your head in the sand hoping you can get a suspension. If you need further help please post more details we are all here to help you as much as possible
  3. dont worry about contacting the debt collector he has as much power as the postman. can you give us more details about debts so we can get correct advice. You dont have to speak to these debt collectors and they have no powers whatsoever

  5. think so Brig, I also agree about doing that with email think its pointless and only gives them moral high ground, although at one time I got so sick of takeaway menu's coming through my letterbox one sunday morning on my way to gym I redistributed them at every takeaway I passed. Childish but satisfying

I suspect its old Sky debt from 8 years ago, one where I never had Sky installed I cancelled before installation, within 14 day cooling off period, they still tried to charge me for installation and first month as they said I had wasted their time.......I just laughed at them and their demands, asked them time and time again to take me to court. 12. First of all theres been a few posts on here about landlords including council tax in rent then not paying it, and liability orders then in their name. this is from Manchester City Council: When is the tenant responsible for paying? If you are renting the whole of the property to one person or family, then it is the responsibility of your tenant to pay the Council Tax and we will send the bill to them. If you rent the property to more than one person, but they are joint tenants, then they are jointly responsible for paying the Council Tax and we will send the bill to them. So with that in mind you should pay council for council tax. You must if eligible to vote register on electoral roll if not you can be fined. As for Insurance I'm a tenant of local council and have content insurance and it doesnt say the landlord has to have building insurance but if taking out content insurance I would check this.
  13. I agree Uncle, someone who is perhaps at end of their tether cant see a way out thinks "stuff this I'm going to end it all and take them with me" Bailiffs dont help themselves with their actions, and coming across as legalised thugs, I've written many times to my MP about whole bailiff/DCA industry and its actions. Lets hope it doesn't take a tragedy to do something about it.
  14. comments are brilliant, and so was the judges summing up "The bailiffs, had broken into the property by knocking the fence down and going through the hedge. Their 'misbehaviour' went further and had fuelled the situation. He described them as 'incompetent and belligerent' and said it seemed remarkable to suggest they were experienced bailiffs. They lacked the professionalism and any understanding of the regulations concerning what they were permitted to do and their evidence was contradictory,Their attitude inflamed the situation and they went into the house completely uninvited. Mr Ashfield undoubtedly considered genuinely that he had been tricked"
  15. not sure where you stand legally nor would I try to guess, but this looks like a great story for Watchdog so might be well worth contacting them. I wish you luck,
  16. I'm with Bankfodder here, there is an advantage to OP, why appeal anyway the OP owes them nothing. I would save the document in question and wait to see what happens next.
  17. means nothing at all, I got pictures of a pigeon in my tree in the garden doesnt mean I can do him for trespass and thats what those pics are worth absolutely nothing
  18. makes no difference, just give us a few more details like has been asked, so we can be sure advice is correct but as long as it wasn't police or local authority nothing to worry about. If we know which company it is we can advise as to what you can expect, like letters with big scary red writing on it and such things normally you will get about 3 letters
  19. ignore its not a Penalty Charge Notice it is simply an invoice, look at this and sit back and relax
  20. its as Crocdoc says, however dont ring them, I would personally keep letter and do nothing, the chances are CCS have bought this debt recently and are trying to get payment for it. you will probably get a few more letters some with scary red writing, but once they realise you arent going to play ball they will move on. you might get the odd letter from time to time. If they call you DONT answer the so called 'security' questions they are nothing more than fishing to get you to confirm who you are, so they can start harassment
  21. I cant add anymore than it looks like its been copy and pasted direct from BPA website, scary that this advice will be seen by many people who will take it as the law
  22. I would still be tempted to go down the route of harassment, but I can understand if you didn't it does get weary and grinds you down.
  23. Dont phone them ever, If you are disputing the debt and from what you say its valid dispute, then council have to call off Rossers until dispute is settled, I've been through this and once I provided the relevant evidence to council that proved I wasn't liable it was withdrawn. So get onto council and HA get your dates sorted and any evidence you need and I suspect you wont hear a thing again. But as Sparks has said Rossers have no right to enter your property and in fact you dont have to talk to them, the debt was for £72 I suspect the £80+ extra is court costs rather than fees from bailiffs. So ignore Rossers and their little threats and deal with council, insist though that council contact bailiffs and stop any further action from them until dispute is settled.
  24. I'd ignore if they want Ms XXXXX that desperately they will ring or write to you
