I would first get the calls stopped (and its illegal to call you at work) theres a template letter in the library section that will gets the call stopped but in the mean time if you can record the calls, if not get a notebook and record time length of call and what was said, (this will be in case you go down the line of complaint) Next the letter I would send is the one to stop doorstep visit again in letter library. These letters give you a little peace of mind and stop any more threats on the phone. do you have any written correspondent that says you have paid this and that there was a mistake on Welcome finance part. If not I suspect you know realise that never phone these people always correspond in writing to them, as you have (or will) find out they will suddenly have no record of any phone calls. I would personally go to trading standards and take you evidence that you have paid this off, and make a formal complaint also a complaint to FSA and OFT as well. they want to escalate the matter well let them take you to court they know they are on a loser and will soon back down. What has probably happened is they have lost a payment but hope by threatening you they will get that payment back. Be brave get the letters sent and get complaint done and they relax. If you have paid why should you pay again lets put it this way if you went to Asda bought a trolley full of shopping and just as you were leaving the store they said I'm sorry but we dont think you paid for these you must pay again would you? of course you wouldn't this is no different, you've paid they have made a mistake so its their problem not yours.

  3. you got it in one its a fishing trip, these offers are great, you take them up on it they ask for bank details and amazingly they take as much as they can and then say it was an error but amazingly you never get the cash back but then they find a 'reason' to carry on with the debt. Ignore carry on paying what you are and dont contact them

I have spoken to a magistrate friend she confirmed no prison sentence regardless of previous conduct (if all fines where paid) but you may get a much larger fine this time as a deterrent to appear before them again. and Remember you still have to get a TV licence. also the TV Gestapo will be calling again as your address is now on their hitlist.
  6. you can not be jailed for having no TV licence however you can be jailed for not paying the fine (which you have paid previously) I would to put your mind at rest take a visit to local CAB and see what they say, you may have a defence here (others on here are very experienced in this matter). But for the offence of not owning a licence you cant be sent to prison, I would suspect you would have to be willfully refusing to pay fines etc for prison to be considered.
  7. Retty you must report them to OFT/Trading Standards Hamptons sit at desk behind Red who sit behind Lowells, when Hamptons finish with the threat-o-grams they walk up to Lowells desk and they start it all over again. Until they realise that no one is paying them. But you must report them
  8. right scotcall have as much rights as the milkman to visit you so ignore their threats. They have no legal rights to come to your property so lets get them stopped visiting you. In the library section of this site you will find a template letter to stop the visits. Ignore the threats they make to you. The next template letter to send is the stop phoning me letter. The reason to send these is to get them to start a paper trail. When did you last make a payment to these catalogues? Stay off the phone these people are very skilled in getting you to agree to make payments you cant afford with all sorts of threats. These are not priority debts and all that can happen is they can go to get a CCJ but doing that means they will get a payment but only a very reduced one that you can afford. So they try to avoid that with threats and remember thats all they are threats they have no legal rights to do anything to you. What I suggest is you right to the catalogue company explaining the position you are in and offer a payment of £1 a month for the foreseeable future until you are in a better position to pay it off. Ignore Rossendales pay council via online or automated telephone system. pay regular amounts using the correct ref number, dont ring bailiff ever but from now on if you have a car park it a couple of streets from house, keep downstairs curtains shut, and lock any side gates to house. If you have a garden put any furniture either in shed or cover it over. Dont let bailiff in, he has no rights to enter threats he will use are I'm getting a locksmith to break-in I'm fetching the police I will get you put in prison I will break in when your not there These are standard threats and he cant do any of it. Another tatic the bailiff employs is just let me in and we can set up a payment plan that you can afford and as soon as he is in he does a levy on goods. So pay council direct and stay off the phone to bailiff and if they do show up speak only through letterbox (if you want to speak at all)
  10. not to sure as to law (with it being an airport) in this but I feel from what you say its a private company chasing you therefore is basically an invoice and therefore not enforceable in law regardless of their threats. But like I said with it being an airport parking not sure about the law on it. Someone will be in better position than me.
  11. My first question is it your debt? if not then no they cant do that to get you to pay someone elses debt. However I will tell you its a long road ahead to get the prepayment meter removed. So first thing is find out if its your debt. If its not then demand removal of the prepayment meter immediately. and get in touch with ofgem
  12. Not sure about fees, but please stay off the phone to bailiff they will make all sorts of 'threats and lies' I'm sure others will help with the fees and about payment etc.
  13. if its a private company just ignore it its no more than an invoice and has no standing, they will continue to write to you me personally I would bin them from now on, writing to them only encourages them to keep bothering you.
  14. Just contact them all tell them what happened and you will be surprised how understanding they are, you're not the first and I'm sure you wont be the last, just dont leave it and hope it will go away, just make that first call to tax credits and it will be fine
  15. no, I would ring them up and speak to them, if you look about the forum Tax Credits are very understanding and will be OK with you, I believe you can have about 20hrs paid work before having to declare it however to put your mind at rest ring them tell them. If you have been over paid all they will do is reduce you payments to get back the over payment. So ring them stop worrying you wont be going to prison or being arrested. Student Loan I wouldn't worry about because regardless of situation you get the same, in fact you may have been underpaid in relation to that. So I would personally ignore Student Loans as you have to pay it back anyway as it is just a loan and not a benefit. So plan of action ring Tax Credits today inform them of everything and then take it from there, and then have a nice meal and a good sleep x
  16. no Sars only to Black Horse, and at the same time I would be speaking to the court informing them that DLC are exceeding court judgement figure, courts dont like that and they may be in some trouble.

I would personally pay what I was ordered to pay and tell dlc to like it or lump it. However give us more details and we can help you more, DLC are quite aggressive, however dont talk on the phone to them in fact never talk to a DCA on phone

  20. welll to start off the levy was invalid as they can only levy on the debtors goods but as you've found Bailiffs consider themselves above the law. I very much doubt they turned up with a van in the slightest what you need to do is stop ringing the baliffs and write for a break down of their fees. Others will be placed to give better advice as this is not an area I'm familiar with. Theres lot you can do remember that the council although passed it to bailiffs they are still responsible for the bailiffs actions.

I'm with Cat10 just sit tight and ignore they wont be going near any court room, Hamptons on it now give it 3 weeks and Lowells will write again with 'generous' offer then all quiet for 6 weeks then maybe Red again as a final attempt and then it will be statute barred so ignore and raise a glass to the numpties of Lowell/Red/Hamptons and wish them a less prosperous new year

Right I'm sure they want to send a bailiff out (no bailiff no fee) However as you are on DLA I believe you are classed as vulnerable and the council have to take the debt back (others know more about this aspect) however if the bailiff turns up he has no rights of entry so dont let them in keep all downstairs curtains shut & windows (bailiffs can legally enter through open window) move any vehicles away from property (couple of streets away if possible) and keep back gates looked and any garden furniture out of sight. Talk to bailiff through letter box or if you have a chain on door through that and RECORD it either using video camera or mobile phone. DONT post it on youtube just keep it as a record. Things bailiff may say are: We are coming back with a locksmith to get entry (no they arent they have no powers to do so) We will get you put in prison for refusing to let us in (no powers to do so) If we can just come in to get an agreement with you (only want to get in to get a levy on goods NEVER let Bailiff in) We have a van in area I'm calling them now to get your goods removed (with no levy they cant and most certainly there is no van in area) We can charge whatever we like and when we come back it will be more money (The fees are £24:00 for first visit £18:50 for second visit and thats it *unless a valid levy is made which is they dont get in they wont have one*) In the mean time pay amount you afford to council direct using either online banking or the councils automated payment system. make regular payments and always on same day (say 15th of every month). I'm sure others will advise about vulnerable status this is the way to get debt back to council. I would not entertain the bailiffs now if the council are in agreement on taking back the debt, If you could ask the council for that in writing or in an email copy it and when bailiff turns up hand it to them through the letterbox and walk away let them talk to a shut door. I agree about seeing if you were eligible for Council Tax Benefit, I suspect you were and that with what has been paid may be an end of the debt. So get into benefit dept of council and get claiming. I agree with Brassnecked complaint letter to CEO of Council, copies to all leader of council etc. Make sure you put how much distress this has caused you I suspect you wont be seeing Rossendales again once this is all set in motion.
