  1. this is a minefield, you possibly have a case of constructive dismissal, I suspect however they have taken legal advice and by making your post redundant may have circumnavigated that. I'm supposing your not in a union, I would suggest you contact ACAS they are quite helpful and can help you.

  5. its now a court judgement so yes bailiffs can be involved, I'm sure the agreement isnt enforceable unless been signed by brother, I'm not 100% on CCJ action so wait until someone with better advice comes along

  9. dont withhold rent, is it the council that actually run the housing or is it a arms length organisation? Again I would speak with councillor and demand that a meeting is set up with yourselves, the councillor and the housing manager. When you get this you can get a plan of action set up and have it written down. The housing manager has to meet with you thats a load of rubbish that he doesnt meet people is he very shy?? Go back to councillor and if need be go to MP.
  10. Can I just say if you weren't aware Council Tax Collection is run by Capita who just happen to own Equita Bailiffs. So they are both gamekeeper and poacher. It is in their interest to get you to deal with bailiff as they can not only collect outstanding council tax but also any fees for their bailiffs. Remember Birmingham City Council are responsible for the action of their agents and this includes bailiffs. Keep us posted as to what happens
  11. yes complain to trading standards you've done your bit, all this letter is trying to do is to get a response so they can carry on with the threat-o-grams, once they realise you wont be responding they will stop bothering you.

  13. Just ignore them the more you write the more it encourages them to write back. I would ignore them ignore any threats from DCA's. If you start to waiver just come back for support. They will soon move on when they realise you arent bothering with them anymore
  14. its an invoice dont need to pay a penny, just ignore them as soon as theyr ealise your not going to pay they will move on to another poor soul. You may get a few letters threatening this and that but it will soon die off. So you dont have to pay, its unenforceable in law, they wont go near a court room with it. If you get anymore correspondence come back on here and we will sort it for you so in short ITs a speculative invoice IT IS NOT A FINE, you dont need to pay it.
  15. first of all STAY OFF THE PHONE, they will bully you and scare you. Write again demanding to know how much you owe, what were the fees charged (have a look on bailiff threads there is many templates for a breakdown of fee) so what if he turns up you dont have to let him in or talk to him just keep doors shut (locked) all windows closed (locked if possible) and back garden secure so he cant get around the back. The fees they can charge is £24:50 for first visit and £18:00 for 2nd visit and thats it. If you go on Islington council website there should be option to pay online if so do it and pay regular amounts to them. the bailiffs have took their fees so they can whistle from now on, as for threats, They cant put in you in prison, They cant break in, They dont have a van round the corner to get your goods, They cant return with locksmith, they cant get Police to arrest you and break in. So get letter sent off demanding breakdown of fees and how much was paid to Islington. I suspect Islington council tax is administered by Capita who by lucky chance also own and run Equita Bailiffs, so when you call the council tax dept you are speaking to a Capita employee who knows they must get you to pay bailiffs to increase profits for Capita
  16. He had no right to enter your property you need to call the Police,lets putit this way if I had enter your property would you have let me without ringing police? ohhh the arrested and sent to jail threat its a threat he cant do it regardless of what he thinks.
  17. well I wouldn't worry about Bailiffs they will NOT be coming in the slightest. They have as much right to visit your property as the milkman does and in fact Milkman probably has more right to visit as he is actually delivering something you requested. Look again at the letter its MIGHT, MAY, etc......they are using scare tactics to get you to ring them, because once you ring them they know they have a live one and will crank up the threat-o-grams. So never ring them ever. You could send the Prove it letter, also the Revoking of right of access letter, the statute barred letter, but this might just encourage them to write more, I would keep the letters and ignore. If they had any power to enforce the debt they certainly wouldn't be offering a 50% reduction. What they do is buy the debt for a tiny sum of money and then try to get you to pay full amount, so if you ignore they offer you a 'generous' offer of 50% reduction so £1225 becomes £600 approx yet they probably bought debt for £100 (or less) yet even with 50% reduction they make £500 off you for an unenforceable debt. I would sit tight and ignore they will get bored soon enough, and NO BAILIFFS WILL come out.
  18. unfortunately the days of common sense over parking fines has gone since council took over the 'policing'. You could challenge it further but I suspect you will lose, I would pay it at reduced rate but then write to council CEO and say that due to the parking fine it has certainly made you think twice to visit the City/Town also state about who you were visiting etc, maybe also send a copy to leader of council too and may be they will refund your money as a gesture of goodwill. The problem is with it being a football match visiting fans do sometimes arrive early and park nr ground. Sorry I couldnt be of any more help perhaps others will have more advice

  20. pay the council direct via online system, Equita are bailiffs for Capita,and Capita run Birmingham City Council, Council tax dept.....notice a link there how it cant be a conflict of interest I never know, hence the reluctance to take it back no fees in it for them. I would pay it via online system but I would get in touch with your councillor and complain about it. Others will be able to advise about what to do about bailiff and having an expired licence (is it not just demanding money with menaces if he isnt legal allowed to collect?) And from now on STAY OFF THE PHONE TO BAILIFF everything in writing and dont fall for anymore lies by Equita
