  1. Do not call the bailiff, I would contact the council showing you have made a sensible and reasonable off to pay the bailiffs that they have refused and you ask the council to take the debt back. I suspect they will probably state they cant (yes they can), then I would pay the council direct using online system, keep records of what you pay and make sure you are using correct account numbers. How much are the liability orders for? how much have you paid? Are there any fees stated yet on the account? If so how much? Next action DONT let bailiff in he has no right of entry, although he will threaten he can. keep curtains shut now downstairs in case he comes back, they have been known to look through window and do a walking possession. Dont worry too much they are just trying to up the pressure to collect money (they might be nearing contract renewal time and need to get cash in)

  3. perhaps a little note on Asda facebook page letting others know about not paying always helpful. Its amazing what big companies do to customers and expect loyalty from them
  4. ignore, like has been said enjoy the letters in big scary red bold lettering, keep the correspondence, and I wouldn't bother entering any dialogue with them it only encourages them to write more
  5. I would say stop contact with them, and see what they do next I suspect the usual threatograms but when you dont contact them the debt will become statute barred in May 2013 so can no longer be chased so stay off phone to them
  6. get a solicitor, it will be a one year ban, the limit is 35mg so he was over by a lot not borderline. the blood limit is 80mg. so he will get a 12 month ban a fine of up to £5000 and he could get 6 months in prison. I personally would do all three if I was a magistrate. he will get a a chance to reduce ban with drive aware course I suggest he takes that option up. Also he should be aware that when banned the police will be looking for him if he is tempted to drive again.
  7. ignore them, Lowells, red hamptons all the same company all sit one desk down from each other, as you got a mortgage its pretty fair to say this debt has fallen off your credit file, Lowells buy thousdands of debts for probably about £1 per debt they then send out lots of scary sounding letters to get you to pay, think about it, they buy a debt for say £1 the debt is £1100 they get you to pay £250 of it thats a very tidy profit. You can send the prove it letter in debt library but me personally think this just encourages them to write more. It becomes Statute Barred in November next year. Their solicitors are hampton the next desk down from Red, if you ignore them Lowells write to you, then Red, then Hamptons, if you still ignore then guess what yup Lowells write then Red, then Hamptons. Debt collectors do like to send scary letters out around xmas, thinking that you will be terrified into paying in case they turn up on your doorstep demanding money (and if they do that they can be told to go away very easily). I would file the letter away and wait to see what they write next I think they will give up if you ignore and dont worry about them they are toothless
  8. are you a single parent? if so then it shouldn't be with a bailiff as you are classed as vulnerable. bailiff charges are £24:50 for first visit then £18:00 for 2nd visit so total of £42:50 so we need if possible a breakdown of fees if you have them. Yes if you ignore them they eventually pass it back to council, however the council can go for a committal to prison (remember they could not they will) what you need to do is speak to council and ask them to take it back, explaining you offered a reasonable amount to bailiff who refused payment (do you have any letters refusing payment) I would also be bringing in your local councillor too explaining situation and getting his/her help. So I would contact council ask them to take it back as their own agent will not accept the payment plan.
  9. you can pay council direct (although they will insist you cant and must deal with bailiff), best to pay using online system (make sure you use correct council ref number), if and when Jacobs turn up you dont have to talk to them, you must not let them in, they have no right of entry, they cant get police to get entry, they cant get you arrested, they cant get a locksmith, they cant break in and a friend even had the line "we will have to get social services to look after kids while we get you into prison" that is a lie, they dont have a van in area to take your stuff, and no they cant take kids presents (another line done at Christmas). Stay off phone to bailiff. so pay council, either full amount if you can or regular amounts each week (or month), and ignore bailiff and his/her empty threats.

  11. as was said previous dont pay Bailiff pay council direct and dont take the we cant accept payment you have to pay bailiff......they MUST accept payment. next dont ring bailiff ever as you have found out they tell porky pies and make threats. If the bailiff turns up on monday you dont have to let him in, in fact DONT let him in he has no right to enter, of course he will tell you he has. He will say he is coming back with a locksmith to break in....guess what he isnt because he cant break in....he will say I'm coming back with police to get entry and you will be arrested yep you guessed it he cant and wont be. Final one is he walks back to his car after saying he is ringing van that is in area to come and get goods, all he is do is ringing the office to ask the time etc...... there is no van and certainly if he has no walking possession he cant remove goods. So go to council and pay the £75 (if you can if not use online system and pay what you can afford and pay that every month). So in brief dont speak on phone to bailiff dont let bailiff in or pay him or speak to him pay council then have a great christmas knowing you beat the bailiff

  16. my personal opinion is sit back very very unlikely to go to court, and stop talking to them. Once they realise they soon stop constantly writing occosionally sending out the odd letter demanding payment or sending an 'account statement' hoping you suddenly send a payment. gradually they fade away.........

  18. a few questions spring to mind here: 1.If its council tax (poll tax) why has it been passed to a debt collector not a bailiff? 2.Surely a liability order would have been obtained could the original OP speak to court to find out? I'm not sure what Liverpool council policy is but a lot of council write off debts after 10 years, although debt is technically still on books councils tend to treat them as dead and written off, I'm wondering if Liverpool have put a trainee to see how many of these 'dead' debts they can get cash back on. Those that ignore etc are passed by but those that get responses are pursued. I would say ignore Moorcr@p and do as Bazooka Bob has advised, and speak to CAB
  19. 20 minute break for every 6 hours worked by law. nothing about paid breaks "When you are working you have a right to 20 minute break for every six hours that you work. Your employer can tell you when to take it as long as it is taken in one block, is not at the beginning or end of your day and you are allowed to spend it off the premises. Workers that are under 18 are entitled to more and can take 30 minutes for every four and a half hours that they work" as for smoking breaks my personal opinion is you have a smoke in your own time, I dont smoke so why should non smokers work full 6 hr shift when smokers get 10 minutes to smoke. I think smoking breaks are at desecration of employer

  21. first stop stressing, the bailiff of course wants you to pay an massive amount a week, but you dont have to pay him you can pay the council direct using their online payment system but only pay what you can afford. However make sure its regular amount. Now lets deal with the bailiff, he has no right of entry to your property, so dont let him in no matter what he says. heres some of the lines used to get in " I need to use the toilet is it ok to come in" no let him/her pee themselves. "do you have a pen I can use?" then they follow you in. Dont phone them EVER. Threats the bailiff will use "I'm coming back with locksmith if you dont let me in" NO he isnt and no he cant do it. "I'm coming back with police to arrest you and get you sent to prison" No he isnt and no he cant. "I have a van in area that is going to take all your goods to pay the debt if you dont let me in" theres NO van ever. Right keep all curtains closed when out of property, bailiffs have a habit of looking through windows and making illegal levies, you dont have to open door or even speak to bailiff, if you do speak to bailiff then do so through letterbox and record the conversation. As for suffering from depression/diabetes I'm not sure but it may make you a vulnerable person therefore the council have to take the debt back and call off bailiff but others will advise on that

Most site owners charge a small fortune for you to move sites to site of keep you on there sites. I've heard of charges of nearly £4000 to move off a site

I'm assuming no bailiff has been into your property to make a walking possession order, if so they can not remove goods it is just an empty threat. Next dont open the door to bailiff you dont have to. in fact you dont even have to speak to him. His threats will come next he will say he will get a locksmith to change locks (he cant) he will force entry (he cant) he will attend with police to have you arrested ( he cant) in fact pretty much everything he threatens will be a lie. Fees are quite simply this First Visit £24:50 second visit £18:00 (and any further visits) so a total of £42:50. max. Are you a single parent? Are you registered disabled? are you on benefits? I ask this because if you answer yes then you may well be classed as vulnerable and if thats the case then the council HAVE to take the debt back. Keep paying the council direct but make sure its the right account. The council can not refuse payment however the muppets on the cash desk dont know the rules.
