    • Thank you. Such a good point. They did issue all 3 before I paid though. I only paid one because I didn’t have proof of parking that time, only for two others.    Unfortunately no proof of my appeal as it was just submitted through a form on their website and no copy was sent to me. I only have the reply. I believe I just put something like “we made the honest mistake of using the incorrect parking area on the app” and that’s it. Thanks again for your help. 
    • They are absolute chuckleheads. You paid but because you entered a different car park site also belonging to them they are pursuing you despite them knowing what you had done. It would be very obvious to everyone, including Alliance that your car could not have been in two places at the same time. Thank you for posting the PCN so quickly making it a pity that you appealed since there are so many things wrong with it that you as keeper are not liable to pay the charge. They rarely accept appeals since that would mean they lose money but they have virtually no chance of beating you in Court. Very unlikely that they will take you to Court given the circumstances. Just in case you didn't out yourself as the driver could you please post up your appeal.
    • Jasowter I hope that common sense prevails with Iceland and the whole matter can be successfully ended. I would perhaps not have used a spell checker just to prove the dyslexia 🙂 though it may have made it more difficult to read. I noticed that you haven't uploaded the original PCN .Might not be necessary if the nes from Iceland is good. Otherwise perhaps you could get your son to do it by following the upload instructions so that we can appeal again with the extra ammunition provided by the PCN. Most of them rarely manage to get the wording right which means that you as the keeper are not liable to pay the charge-only the driver is and they do not know the name and address of the driver. So that would put you both in the clear if the PCN is non compliant.

    • Hi Clou, Welcome to the Forum and thank you for reading first before you posted. There seems to be many problems with Cornwall and getting a signal to use your a phone which could be why these parking companies don't use alternatives. It is a shame you paid the first one as you would probably have not had to pay that one either.  Was the car park at which you paid the same parking company as the one sending you these PCNs? On the subject of PCNs could you please post them up so we can see if they comply with the Act.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been dealing with my mums debt problems for several months now and she has been paying Fredricksons for a debt but they have never told her where it orginates from.

 

Fredricksons are collecting on behalf of Arrow Global according to the letters and they say she owes £250. I have got 2 of the letters from Fredricksons (which i can post up) one dated 30th of October stating they want a first instalment of £28.50 by the 6th of November then another £15 per fortnight from the 16th of November 2009.

 

My mum has unfortuately not been able to pay those amounts and received another letter from Fredricksons dated 16th November 2009 saying that unless she makes a payment in the next 5 days they are going to instruct Bryan Carter to commence proceedings in the County Court.

 

I sent Fredricksons a CCA request on Tuesday 24th of November and they received it on Thursday 26th of November.

 

Today my mum has received a letter from the famous (or should i say Infamous) Mr Carter which i have posted below.

 

I want to know where i go from here.

If they 'issued court proceedings' on the 1st December it could take months for a date to go to court, and Carter is easily challenged.

 

Have you CCAd the original creditor yet, regardless of the different companies now involved - Fredricksons and Carter are one and the same company, so there is no surprise. Carter's court POCs are usually very bald and can be challenged - at which point he discontinues.

 

CCA the original creditor as Carters will need the original paperwork in court. Don't worry that it is Northampton - as soon as you file your defence it is transferred to your local court.

With a little bit of luck they will fail to provide the agreement in time and you can place the account in dispute, therefore BC and his cronies will not be able to continue with any legal recovery action.

 

As a matter of course you should report this vile man to LCS: Legal Complaints Service home

I sent the CCA reqest to Fredricksons and they received it on the 26th of November. They will be in default of the request on the 17th of December.

 

Do i have to send a letter to Carter to say we are awaiting a copy of the agreement from Fredricksons?

 

My mum is really panicking as she thinks Carters are going to take her to court before we get a copy of the agreement.

If it will help put your mum at some ease then yes, a letter to him stating that you have requested the CCA and they have until the 17th December to supply you with it, will cover all bases.

 

The actual probability of him 'fast tracking' this to court before Christmas is extremely unlikely, so by then you will either have the agreement sent to you, or it won't have been or it will be unenforceable and you can place the account in dispute where he won't be able to take your mum to court.

I stumbled on your thread today in a state of blind panic and couldn't believe it as I have exactly the same letter as your mum received.

I went numb when it arrived in November. I got notice that proceedings would be issued on 2nd November. I stupidly hid it away in case my oh found out I was in such trouble & haven't slept since.

V stupid but until you are in this mess you don't realise how dark it all is.

 

In my case the OC denied the account was sold on and sent a dodgey 'CCA'. When I disputed it's enforceability they point blank refused to discuss further, told me to get legal representation and then instructed Fredrickson after that. B Carter came on board last.

It would help me greatly to hear what your experience has been. Has B Carter hassled your mum since or did the court thing happen?

If it is any reassurance it would appear that he doesn't fast track to court as I haven't heard anything else since the last letter dated 26th October.

I have asked caggers advice on my own thread about where to go next as I am terified that something formal has happened and I just didn't hear about it yet. So I can understand your mum's worries.

I think I'll try the CCA to Fredrickson/Carter anyway even if it is repetition.

I wrote to Carter explained we had asked for the CCA and he wrote back saying it was on hold.

 

The worst thing you can do is ignore DCA's. Confront them, keep everything in writing and send all letters recorded delivery.

 

Carter has done nothing yet. I am waiting for the 17th of December when Fredricksons will be in dispute with my CCA request. I will wait and see if they come up with anything.

 

I would definately CCA them again. If they have not provided you with a CCA after 12+2 working days then you can put the account in dispute and they should leave you alone.

 

I know you are worried but you are getting the best advice on CAG. Carter has been seen off by many a cagger and will continue to be seen off by many more.

Thanks for coming back. I drafted a letter last night just tidying it up a little.

I don't want to get too extreme as this is a complicate process and I am far from comfortable in it.

I hope your mum is feeling a lttle better about it all. Hopefully I will too. Soon!

I told her she is in good hands and i will get it sorted. Ive already got 2 DCA's off her back (one was Statute Barred and the other was making her pay too much) and she is pleased with the results so far. I told her to leave it with me.

 

I have also given EON a kicking for her.

Hi all

When I read of "delays in the court system etc" I have to laugh -- DCA's can sometimes get stuff through in DAYS if they feel they can get away with it whereas if YOU really needed a Court for something it could take months or even Years.

 

That's the problem of allowing an institution like the Northampton Bulk Court to exist wherby the DCA can issue judgement applications via the Internet in seconds.

 

Of course a Judge still actually has to sit in but with the sheer speed of the process often a CCJ will be gained by these DCA by DEFAULT as before you even know they are going to Court they will have done it.

 

Undoing / getting a Set aside is possible but a real nuisance.

 

However challenge EVERY SINGLE SENTENCE on every piece of Documentation you get (or even Don't get) from these rotters and if you have any case whatsoever go for the Juggular.

 

DCA's are the ** EDIT ** OF THE EARTH -- of course it would help if NO debts were ever allowed to be passed on but I suppose that's never going to happen.
