    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Evening people,

 

We have an UPDATE.

 

I received another couple of letters from Lloyds TSB. Nothing to exciting though.

 

The first one is regarding my Current Account Overdraft.

 

It reads -

It would seem they are somewhat puzzled with both accounts, for the time being.

 

Oh well, at least I don`t have to reply to these and waste my envelopes, paper and printer ink just yet ;)

Earlier this year, I got concerned when 2 of my recorded delivery letters to BLS didn't get signed for, so I did a bit of investigating, along with another forum member Tecnobaz and we discovered that the PO Box number doesn't officially exist and the postcode given doesn't exist either. By some dodgy dealing or other, they had managed to have a re-direct put on this fake address and they were receiving the post but not having to sign for it.

Tecnobaz and I both complained to Oxford TS and eventually got them to agree to investigate. I haven't had any letters from BLS since and I was hoping they'd now been stopped from using this [problem].It looks as though they're still going strong though, so I think it's time to remind Oxford TS they're supposed to be dealing with this.

Thanks for the post.

 

I never thought much of it really, but now you`ve brought that up, I DID notice it took a while for my letter to be signed for. The Royal Mail website did state it would take longer than usual as it had been re-directed to somewhere.

 

I tried your link but it came back with a `Page Unavailable Error`, I tried it in Internet Explorer 7 and Firefox 3 and both gave the same error type, so I`m not sure the link is working.

 

Aren`t they allowed to use this method of receiving mail or something? I don`t know.

 

If you have a letter I could use to throw at them, then I`ll use it by all means. The more cheeky and abusive the better ;-)

Hi NP,

When I sent letters to BLS it used to say on the Roal Mail website that there would be a delay as they were being re-directed, then they would just disappear off the radar and never get signed for.

I rang Roal Mail complaints department and they checked the postcode and PO Box number and informed me they didn't exist and it was the complaints department who then discovered the re-direct which is totally against Royal Mail regulations apparently. The person I spoke to was adamant that the matter had to be passed to the fraud department to deal with. I rang up for an update a couple of months ago and was told that it couldn't be discussed because the fraud department were dealing with it.

It's obvious now that absolutely nothing is being done except perhaps BLS are now signing for the stuff. I suggest you call Royal Mail's complaints department and tell them, pointing out that you are fully aware that they had promised to put an end to this abuse several months ago. You might also email or write to Oxford TS . I'll get back onto them too on Monday morning, because they promised me an update which hasn't happened yet.

I'm also going to see whether Royal Mail have some sort of governing body or watchdog which might investigate why they're allowing a DCA to flout their regs, even after the problem has been uncovered.

I would send future correspondence to LTSB direct, explaining that you're not prepared to communicate through a false address. After I sent a letter like that, I haven't heard a peep out of them since.

I don't know whether that's anything to do with TS dealing with my complaint or because they didn't like my letter. LOL:D

Is a response necessary NP ?. It looks as though BLS are just rattling their cage. I think you have already sent them the "If you visit, I will ensure the rotweiller is hungry" letter havent you ?.

 

Alternatively, as they are saying they will advise LTSB to arrange the visit, you could write to LTSB enclosing a copy of BLS's letter asking them what the heck is going on. On the one hand they (LTSB) say they are investigating a legitimate complaint and on the other their pseudo solicitors are threating to arrange for the Kray Twins to visit. Put the ball back in their court.

Would you beleive I received another letter from Lloyds TSB this morning at my parents house? :confused:

 

It is pretty much exactly the same as the other I received, claiming they are sorry I have the need to complain, and that they hoped the problem would be sorted out by now, but isn`t, so they would appreciate if I have fire while they sort their lives out.

 

Are these fools for real? They`re just a bunch of incompetant imbeciles!

By the way, does anyone know who complained that my new Avatar was in bad taste? It`s quite sad really, they probably get worse letters from DCA`s and find my Avatar offensive, probably a Troll on the prowl I think!

It was only on a day or two.

 

It was a cartoon of a guy on the toliet straining for a dump. His head goes red then explodes all over the walls. The body falls on the floor then a lump of dump shoots out his exhaust and lands in the bowl.

 

I thought it was quite funny really ;-)

Hi all,

 

Well, we have another UPDATE on the Current Account front.

 

This evening I picked up my post from the olds, and there was a dodgy letter from SC&M.

The thing is, I have also received mail from Lloyds TSB stating they are STILL looking into my complaint and don`t know when they will be able to sort it out.

 

Does anyone have any idea`s with this please?

I find this quite interesting really.

 

This letter reads despite several reminders the account remains out of order, Well, yeah, I guess it does, but it doesn`t mention the fact that they`ve sent me about 3 letters stating they are looking into my complaint and that they STILL are unable to solve it and will need more time to sort it out.

 

That was their response to my snotty letter stating that if they returned all the charges on the account it would no longer be overdrawn and that I was also interested in reading the agreement they kept referring to.

 

The mind boggles!

Thanks for the post.

 

This recent letter is regarding the Current Account Overdraft.

 

Now, what they want is the unauthorised overdrawn amount of £194.81 which they state is against the agreement.

 

I have wrote to Lloyds TSB with a snotty letter stating if they refunded all the charges applied to this account then it would not be overdrawn, and that I would also be very interested in receiving a copy of the agreement they refer to.

 

Now, all they have sent back on about three (3) seperate occasions is that thay are still looking into my complaint, they are unable to solve the problem at this time, and will need more time to look into my complaint. Each one gives another 4 weeks for them to look into my problem. Eh? Am I missing something here?

 

Now, it seems the left hand of this lot doesn`t know who`s cheesy helmet is being pulled with the right hand :-|

 

Shall I just ignore this nonsense?

 

This account is around 22-23 years old now, and I remember charges back then were only £5, so where has the modern charge of £35 come from?

 

Could I go along the lines of no agreement, then the overdraft was a gift as I never asked for it in the first place?

 

I don`t know. Any thoughts on this people?

I am not sure, but I think there should ahve been terms and conditions when you originally opened the account. Else how do you know what you agreed to in terms of charges. .

 

you could of course make a complaint to the FOS. Saying something along the lines of... LTSB are continually sending letters saying they are looking into your complaint whilst at the same time you are receiving letters from **** saying LTSB are advising Legal action. Or would this be a Trading Standards COmplaint in that you are being harrassed whilst a legitimate dispute is in place ?
