    • You don't mention what the debts are, which is important, as it really depends on the details in deciding best course of action. So list types of debt e.g credit card, type of loan, utility bill; current owner bank or dca; approximate amount for each debt.  And do you own any property assets. There is no blanket advice regarding all types of debts. Whoever you contact regarding debt advice would want to know all of the information. The debt buying businesses deal with multi billions worth of debts. They can't issue Court claims for most debts as the cost of pursuing would be ruinous and don't have staff resources. Instead they rely on credit records being impacted and therefore people need to resolve the debts. And they rely on anxious debtors paying amounts after receiving threatening communications. If you know you are likely to be made redundant, start looking for other employment soon. Due to longer recruitment processes being followed by employers, it can take about 3 months between applying and starting a new job.

    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got all the statements this morning in over 50 seperate envelopes!! Postie nearly had a fit!

 

Even GE Money (who are not normally known for their sense) managed to send all the statements in one envelope.

As part of this process we wrote a letter to the Job Centre and local tax office. Today we received an astounding answer from the job centre where they say

We have no authority to become involved with any disagreements you have with your bank, you have entered into a contract witthem and by doing so accept their rules and regulations including any charges levied.
The SSAA1992 and TCA2002 both say that any such agreement is void. Oh well!

I read on one thread that someone got over 50 copies of their statements

 

 

Howard told me when i queried similar response that due to postal rules re weight they can only fit 5 statements in each envelope per first class stamp.iftherewasanemoticonbyaugestqx6.gif Apparently they are unaware of the Post Office small packet service, or can`t be *rsed to go down to Post Office to post them.

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

Hi Steven

re letter from job centre. Need that answer be the end of it from the job centre. Perhaps this was from someone who had not fully thought it through, perhaps dealing with complaints or such like. Would a letter to someone up the command chain be beneficial? Just a thought. Sometimes the same question to differnt parts of an organisation illicits different answers, although you'll be aware of that.:)

I did a sort of pincer movement - local jobcentre and Minister for Work anad Pensions - hoping the messsage might percolate from both ends and meet in the middle. Well, it was a plan! (did the same for tax credits - local tax office and chancellor of the exchequer)

However when I started my claim I had not mentioned this before as I was unaware it was illegal to take money from social security benifits, is there any way that I can include this in to my claim and maybe add arguments to the lifting of my stay??

Sorry not to answer before but I have been away. You could include it but it is probably better to include a statement that you are on benefits and the charges have caused and are causing severe hardship. Therefore the stay is unfair on you as it prolongs the period of hardship.

 

You might find this of use which I've cut from another thread -

 

This direct quote is taken from the FSA Press Release, dated 27th July:

 

"The FSA also expects firms to continue to help their customers avoid incurring unauthorised overdraft charges in the first instance and to continue to deal with hardship cases."

 

and this in the FAQ's:

 

"Consumers who are in very difficult financial circumstances - 'hardship cases'

 

Banks and building societies will have to conduct a filtering process to ensure that cases of genuine hardship are still dealt with during the waiver period. Cases of hardship would still be entitled to be referred to, and dealt with by, the FOS."

 

Clearly, where a bank fails to deal with a case involving "hardship", the FOS will be expected to intervene - AND the FSA may also consider withdrawing the waiver.

Hey Steven - just wanted to say that you're doing a top job. I'm on benefits and Abbey used payments of these to clear a build up of bank charges - so I'm looking at ways to use this angle if my claim gets stayed. I hope it's okay to use some bits from your POC above?

 

One minor point (I'm sure you're already on top of it) - in your POC above you mention that you're claiming back court charges, but if you're on certain benefits these are exempted - there's a from EX160 that you have to complete for th court and submit with the N1 along with proof of the benefit.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

This is not directly relevant in that the claimant was not on benefits but it is relevant in that she used the 'hardship' deffence to stop the bank taking charges whilst the case was stayed.
