    • Worth noting that all of these firms - either the alleged EIS investment, the rebate company themselves or the payee were all registered to the same address. Clavering House is 3 miles away from HMRC Benton Park view offices.   Wardrop - unfortunately unsuccessful due to late appeal - assessments opened by HMRC in March 2019. Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

    • I am reading the thread now and think although its probably very similar to my predicament,  I have no way of obtaining the terms anymore due to MyParcelDelivery having being dissolved and their website not being active now. I have nothing to quote from and they didn't send me a copy at the time of order, the website that I believe they reinvented themselves as P4D has terms I am looking at now but however similar they may be I wont be able to quote from them in this case. Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Help me out here guys as I'm a wee bit confused now. I had thought PW had RBS on the ropes and that they were offering him money to go away.

 

This letter suggests they want money from him, and confidentiality, for them to leave him alone. Did I miss something or simply misunderstand what's happening here?

 

RBS claim I owe £11.5k

 

They must assume a reduced liability from £11.5k to £3k is a good deal......well I don't.

 

This will be sorted in open court.

If there's no merit to my allegations......why the draconian confidentiality agreement.

 

They've tried every dirty tactic possible to keep me from exposing their false/creative accounting practices which has included the threat of imprisonment from a circuit Judge brought about and submitted by RBS lies.

 

It won't be me taking further legal action?

hi paul ive just posted on humbles thread this could you use sparkie as a witnes just a thought ?

you could i suspect use the above in conjunction with Audi alteram partem

by bringing forward other witnesses to be heard who can show that there was at least a good arguable case that they would succeed at trialwith regards to HFOC and their methods but i guess you would have to consult with a barristor or ask someone on here such as car or pj

Well looks like they need to revise the offer.

 

RBS if you are reading this, which l know is very possible, how about this as a few pointers to start with.

 

* forget about the £11.5k you allge paul owes.

 

* put right Pauls credit record.

 

* apply to the courts at you own expense to have any ccj(s) you have set aside stating the money is not owed.

 

* send out to paul a formal in writing on record appology admitting your mistakes.

 

* compensate paul with at least £15k for the hassel and stress you have caused him.

 

* make a donation to cag that matches exactuly what you have paid paul.

 

If any of it is wrong please say paul but this seems more reasonable.

The court, Cobbetts and senior RBS have now been made aware of their "notice to act"

 

I have now got the backing of some seriously important people.....in addition to lawyers?.

 

Got to be careful what I say but, If I was RBS i'd be ******** myself.

Knowing what I know ......because Paul & me work so close...........it is more heavy than what Paul has hinted at ...I too will say no more than that.........except that it will have a profound effect on other RBS customers dealings with RBS.....to say the least mine.

I think all of this is pretty shameful, with Paul having to endure all of this whilst a supposedly professional institution carries on like some kind of organised crime syndicate. All the worse from one that the tax payers have bailed out. Will be following this with a lot of interest and wishing the very best for you.

 

Sooner the practices of such banks are exposed the better, really about time that things changed for the better and the total abuse of customer trust was re-aligned once and for all.

I echo what Slick says. I do hope the bank AND Cobbetts get what's coming to them.

 

I don't know anything other than what I have read in this thread (and sparkie's), but to me it looks as though the bank and their poodle solicitors have been as bad as each other.

I'm informed that the bank's solicitors made a number of telephone calls yesterday, I'm also informed that the bank's solicitors "seemed a bit edgy".

Not sure if I've posted this before but just shows how aggressive RBS treat their customers who challenge erroneous documentation.

 

RBSs lawyer (sent from London again...costs!) presented me with this outside the court minutes before the hearing dated the 18th.

 

In addition the lawyer placed an application for a civil restraint order alleging that all my allegations were untrue.

 

My claim was eventualy struck out and proceedings transferred to the high court in Sheffield to be heard in front of a circuit judge. In respect of this matter, I decided it would be better to offer the bank an undertaking to avoid the prospect of having my name appearing on the public register as well as being slaughtered with costs as they were sending the big boys up from London again to sort me out (in court that is).

 

However, the bank would not accept my undertaking unless it was made in front of a Circuit Judge. It was obvious this action was to intimidate and coerce me to capitulate as their representative gave a smirk when the judge threatened me with imprisonment.....their application was then dismissed by the Judge, however, I ended up with costs.

 

What does this say about the Integrity of this state run organization?

 

BTW, my solicitors believe all my allegations have merit.
