What has been said already is excellent advice. We had a mortgage a few years back with GE Money, previously iGroup and they started repossession proceedings for arrears that were less than £900 at the time, equating to less than 2 month's payments but dropped them when they realised that they'd look a bit daft in court.

 

Please don't make an offer that you will struggle to pay and take every bit of proof of income with you, including an I&E form and statement like Ell-enn has wisely said.

 

Also, please try not to worry, everyone on CAG is here to help so you don't have to struggle on alone.

What has been said already is excellent advice. We had a mortgage a few years back with GE Money, previously iGroup and they started repossession proceedings for arrears that were less than £900 at the time, equating to less than 2 month's payments but dropped them when they realised that they'd look a bit daft in court.

im just worried because of the arrangement we made with GE money , that its going to look bad for us with not being able to pay the amount this month after tomorrow it will be £50 short of what i agreed ive said ill try and get it to them by the end of the month but that wasnt good enough for them.realistically with us having the attachment of earnings for the council tax at the moment we can really only afford a maximum of about £70-£80 a month on top of our payment, plus even though our morgage rate was fixed for 3 years at £480 our payment is now £487 which i cant understand. ill just be glad when its all over. Any suggestions on how to write the witness statement? im no good at things like that i end up rambling:|

Shelter helped me write my witness statement. In fact they actually wrote it. I phoned them up told them what was happening and they wrote me a statement and emailed it to me. I then copied it to the form. These guys were fantastic. It is well worth seeing what they say.

Hi there, please don't worry so much, the judge will decide what happens not the monkey on the end of the phone at GE. I will prepare a statement for you when I get home from work tonight (I may be able to do it earlier if I don't get too many phonecalls this afternoon) based on the information you have given on this thread - you just have to fill in the missing figures etc.

 

I'll get back to you as soon as I can.

  • Affixed is a revised income and expenditure sheet which reflects our ability to repay the arrears.

cheers thats great, do we just take it with us to court ? ill do an income and expenditure sheet aswell , but its going to be slightly different from the one i sent ge the other week, would it be best to take my husbands payslips to show the judge also the revised tax credits form?

Hi there, take 3 copies with you and anything else which you think will back up your case i.e. revised tax credits etc. If you think you can have it all ready in the next day or so you could take it along to the court and ask for it to be added to your file, but still take copies with you.

thanks for all the advice, been to court this morning and the judge agreed to suspend the possession aslong as we pay £25 a month on top of our monthly instalment .the judge was great he didnt want to listen to anything ge solicitor had to say , the lady from the cab at the court spoke for us and she said afterwards she has never known a judge silence a claiment's solicitor like he did today with the ge money solicitor it was quite amusing , he was very sympathetic towards us and we have to have a reveiw in august about increasing the payments when the attachment of earnings order ends on my husbands wage but hopefully by then we will have cleared the arrears

hi there, i was wondering if you or someone else has, any advice with regards to ge money and the £40 charge every month which is added to our arrears. my partner and i have already been to court and it was not nearly as bad as we first thought. we had sorted all our other creditors with the advice and help from the cccs. we agreed with the judge that we would pay extra on our payments, as much as we could afford and increase it as and when we were able to. unfortunately because of this administration fee of £40 a month our arrears are not coming down as quickly as we would like. we pay £80 over our normal payment which of course means only £40 is coming off our arrears which is only £668. are they allowed to charge so much a month for arrears. i would appreciate if someone could advise me on this matter. unfortunately what makes it worse is that i am physically disabled which took a turn for the worse 18 months ago and i had to go on benefits and had a small pension from the bank whom i worked for 29 years but was pensioned off early due to ill health. things were okay then and we were able to manage quite nicely at that time, but i continued to get worse so much so that my partner had to give up work and become my full time carer. both the courts and ge are aware of this. it does seem a bit excessive for such a small arrears and at this rate it will take a long time to pay back the arrears. i thought i read somewhere that the charges should be added to the actual loan amount. thank you for taking time to read this. i have already received so much help regarding rma/nco and have finally got them off my back thanks to you lovely lot out there.

the £40 is not part of the arrears its added to the loan, so every month you are in arrears they charge you £40 i know its excessive , my mortgage was a fixed rate and because they add the £40 every month my payments have gone up slightly because its added to the amount borrowed
