Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

oh i dont belive this i have installed a excell veiwer so i can see it but cant work on it. It like given me chocalate and telling me i cant eat it so ok whats next why is this so easy for everyone else.

go to download: Download Central and download the Open Office Suite.

 

It is a very good alternative to Microsoft Office. It contains a spreadsheet package called Calc. It will be able to handle the Excel spreadsheet I have sent you.

Sorry. I fell asleep! I was up until the wee hours of the morning last night, so I probably had about 4 hours sleep. Then I had an interview today that lasted almost three hours.

 

All the excitement was too much for me today :p

Ok yipee i have finally done the spread sheet now i have to write a letter to reject offer tell them about the contractual interest and give 7 days,

I am very disappointed that you have failed to respond to my letter of the 15/05/07, Due to a bereavement within the family I have not been able to deal with matter until now.

Firstly I must point out that you seem to consider my previous letters as complaints, I must inform you that they were not complaints they are, and always have been requests, requests which you don’t seem to be taking seriously.

I now understand that the regime of 'fees' which you have been applying to my account in relation to late payments, over limit fees and so forth are unlawful at Common Law and contrary to consumer regulations.

If you say they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, this is in order to reassure me that your charges really do reflect your costs.

As I previously stated in my last letter to you dated 15/05/07 I respectfully decline your offer of full and final settlement and return your cheque to you of £****.

I would also like to inform you that I am changing my request due to information received via various websites and the media and will be claiming the contractual interest that has been taken from me

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise.

I calculate that you have taken £**** plus £**** which you have charged me in overdraft interest for the sum which you have taken. Total £***.

I am enclosing a copy of the schedule of the charges which I am claiming.

Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosities caused directly by the taking by you of penalty charges which you had applied unlawfully to my account.

 

In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable.

 

I require repayment in full of this money and removal of the default notice. If you do not comply fully within 7 days then I shall begin a claim against you for the full amount plus interest, plus my costs and without further notice.

 

You are also reminded of my request that you forward a copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions. I'm not sure what you mean either.

 

I included a line with regards to sending a revised schedule of charges, as Coxey is going for CI at 30.9% based on the principle of mutuality and reciprocity.

 

Please clarify :cool:

 

BTW Coxey - interview went well just waiting to hear. Hopefully four months of unemployment may soon be over. Wish me luck! ;)

Coxey guess what? I just got a call 5 minutes ago - I got the job. Yippeee!!! I'm really psyched. OMG the wait has been worth it.

 

My letter to Mr Udy at Cr*p One has been delivered too, so just waiting to hear from him (well his team that is).

 

I'm stoked. Now I have to stay away from the forum to get my dissertation finished. :(

 

I'm starting full time work on Monday, so I need to do this. I shall be checking in though so don't worry. :p

You should send the amended schedule of charges, don't give them any excuse later on to play up. You must keep the claim whole as well, default removal and charges refunded. Other than that you seem to be doing well with deedee's help. Keep us posted.

Hi all

Been to Glastonbury at the weekend had a great time but how sad am i missed this site;)

Hello both of you.

The thread I linked to is in the Lloyds forum so it's fine to use. The title's good for getting help and I'm still subscribed so I can keep an eye on you (so behave!:p ) Haven't gone anywhere deedee, just been very busy for the last couple of weeks. Haven't even had time to do much about Lloyds bouncing my settlement cheque. Off to leeds now but back soon;)
