      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just re read the paperwork (talk about confusing) think when it comes to basics they are offering me the ppi plus 8% interest and taking me back to how my loan would have been calculated without the ppi.

Well good news all. I have had a partial refund from my battle with Creation Finance!!!

 

As you know, my original claim with Creation was close to £4000.00 , i have been preparing to go to the foslink3.gif as i had heard nothing after my last letter.

Today however i have received a letter from Creation offering £440 refund of charges plus 8% interestlink3.gif at £76.84.

Also a refund of PPI £1176.23 plus 8% interest of £132.72.

Total £1825.79!!!

Its not what i'd hoped for but better than a kick in the teeth. They have told me this will be paid into the account to cover my debt with them, so thats good.

 

But its not over yet! As you may have noticed from the figures they have indeed paid back the premiums paid by me, but they have not added the 39.9% interest that i have had to pay monthly on these amounts.

Also i have not had to sign a letter of acceptance for this offer as they have told me that they are paying this into the card account directly.

 

So i shall wait till it has been paid, then off to the foslink3.gif it is to try and get back the interest on this!

I am pleased with this result and feel now that as they have made a payment it will hopefully be easier to claim the interest back on this

They say "having reveiewed your complaint i feel there is a lack of supporting evidence to confirm the the sale of ppi was carried out in accordance with our standard procedures"

 

As a result all ppi premiums plus interest refunded!

Its only a small amount but its a win!!!!!!!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

This site is really maing me feel more poitive while i attemt to reclaim PPI. Is it true that you are more likely to have a successful claim using a company even though the charge about 25% ?

why should you wish to have your reclaim ''eaten up '' by a claims company when you have all the tools right here on The Forum...

 

You have wisdom and experience from a variety of perspectives here an so to possibly give a sizeable chunk away is unreasonable.

 

Claims Management Companies have there place but you can do it yourself..and you'll get a sense of satisfaction too...

 

In fact I would go far as to say that Banks are far happier to deal directly with you than through a CMC..you'll possibly get a cheque accompanied with a smile!!!

I ahve written to the Ombudsman and have requested that I am provided with the info required on the SAR, and also clarityont he repayment of the refund that is being payed back into my account by RBS supossedly as I do not have documentation confirmaing this. a proper statement reconcilling to the loan amounts and interest reates. etc. I am awatin the FOS responce.

 

I have also written to RBS telling them I have rerefered the case to the FOS as I am not satisfied I have been treated fairly.

Seems like a long time ago that I said that the FOS had decided that Amex must pay back all ppi charges on cc - finally it has now been paid. Whoopee!

Cleared balance and a little bit more so happy, happy happy!!

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

I am happy to see the ongoing successes with PPI reclaiming and well done to all claimants and those that helped along the way. Apologies for my absence due to family health issues. I will endeavour to get more time back on CAG but cannot guarantee how often.

 

Just one more success for this thread and that is Barclays paid up today over £4,500 by cheque so I only have one outstanding claim with Capital One for less than £200.

 

Keep up the good work PPI is still a major thorn in the side of thousands of consumers.

Good to see you back on the forum AA :)

 

Celebration time here this weekend.

 

After rejecting Barclaycards pathetic ppi refund offer (£1,400 ish) and after 18 months of letter exchanges & involvement of the FOS, received a 'fresh' refund offer of £9,000 + in full & final - clears the card & leaves a nice balance left over ( time to spoil the missus I s'pose?).

 

Could squeeze ''em a bit more as they have 'estimated' ppi for the missing statements but I have two years more statements then they think I have, but I am more then happy with their current offer + its been a long battle & I want closure.

 

If only I can get Mercers non compliant DN removed from the CRA now :rolleyes:

 

Still fighting Egg & Santander

Congrates for this, well done all. for the DCA jut write to the SRA and include the correspondence in tre your refund from Barclays, and ask for a correction of the info on it due to the resolution with Barclays. and write Barclays to correct the entries copying int he CRA.
