Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR). Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period. Since our March 2024 publication, we have increased our initial estimate of borrowing in the financial year ending March 2024 by £0.8 billion to £121.4 billion, now £7.3 billion more than the £114.1 billion forecast by the OBR. Public sector net debt excluding public sector banks (debt) at the end of April 2024 was provisionally estimated at 97.9% of gross domestic product (GDP); this was 2.5 percentage points more than at the end of April 2023, and remains at levels last seen in the early 1960s. Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure.     • That's very interesting to hear! I received a notification of a CC verification from Coles in Australia on the 12th May - also a Sunday evening. Not having been to Oz for about 30 years I was somewhat suspicious and so immediately cancelled the card. Guess what, it's the one I use to pay Lyca with...........       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok all. Finaly got around to sending my prelim, letter and now sending my Lba..barclays owe me £4,885 not including the 8% intrest were able to claim back..just a mater of time now before i file with the courts.:D

filed my claim with the court on wednesday the 27th june for £6,414.98..That includes total amount to date plus int + court costs. On the same day barclays came forward with a offer of £3.500. which i have sent a letter stating i would except as part payment to the total amount and that legal action had started to recover the full amount.just waiting for a date of issue from the courts as the posal strike as put all mail back for a few days..regards taff.:D

Did you file with your local court? Past threads indicate B's will withdraw the offer now you have rejected which obviously is no skin off your nose and the 8% is accruing (even though I'm sure £3.5 k in the bank next week would have been handy!)

my claim was issued on the 27th june,And today time has run out for barclays to acknowledge my claim, I phoned my local court who are dealing with it, and thay have said there has been no acknowledment from barclays, OK do i give them more time..or do i ask for a judgment against them, I have heard this will prolong the case,or do i just phone them and ask whats going on and are thay going to defend..any ideas :) thanks taff.

Taff, I think it'd be worth calling Barclays and giving them a nudge in the right direction. You may find that they're about to, or will arrange to send the acknowledgment in as it may have just been missed. Since you've also had a partial offer, it may also be worth asking them if they are ready to settle in full to save more time and hassle. If they say no, simply say fine, I'll look forward to hearing from you then...and continue as normal. I say this because sometimes you never know until you ask....although Barclays do tend to take it to the line.

Hello all..since my last post ive tried many times to get a responce from the litigation dept,ive left messages as ive only been able to talk to a recorded message, and still am non the wiser if barclays are going to acknowlage or not,should i ask for a judgement against them now?help please... thanks taff..:)

go for mate, sent mine in a few months ago, got the statments, bank sent letter saying that they would look into my complaint, few weeks later replied with offer:mad: :mad: , turned it down now just waiting for reply regarding possible court action. Buggers just charged me again and i have requested that they include that in the settlment.

 

Next on the list is Barclaycard & Marbles

Hi taff

 

Quite honestly, I would ring Wrexham court. Confirm that you have allowed a few extra days out of courtesy for the bank to acknowledge and you feel it appropriate to now file for Judgement.

 

The court staff will pull up your case and see the time scale and advise you whether they have received anything - often it can take a few days for it to come through from the local court. Mine (Cardiff) took over a week for them to forward on the Defence from Barclays because the actual court was dealing with a backlog and staff were working weekends to clear.

Hi welshcakes..thanks for the reply,i have already phoned wrexham court today and thay said its up to myself what i do next,i know the courts have a backlog of claims to deal with as do the banks but barclays have been so slow from day 1 back in february until now it just doesnt seem to change..stuff it i'll give them until friday and if i dont recive acknowlagement from barclays i'll file a judgement against them...cheers anyway for your help welshcakes..taff..
