MAJOR UPDATE

 

The letter i recieved back from Experian was mostly about policy and procedures, when i get a minute ill scan it but the opening paragraph is the most important.

 

Dear KPR

 

 

"Thank you for your letter which has been brought to my attention in the Directors Office.

 

We have taken the decision to REMOVE the following information from your credit report until we are able to obtain a substansive response from Littlewoods.

 

"CREDIT INFO LISTED"

 

We will notify you of any response we may recieve and any action we may take based upon this.

 

its great news.

 

so while it is not over yet, its certainly beginning to move in the right direction.

 

Ive ordered a new copy of my credit report from Experian this morning, and am about to order from Call Credit and Equifax too, if there are any mentions of Littlewoods on them, ill send them the same letter i sent Experian

 

I would think now that i have written to the Comp Secretary, Chairman, and now Experian are going to be looking for a "substansive report" from Littlewoods, it would be in their best interests to quit now and admit defeat, however, if they dont, i will get a Court order to get the information removed, lets face it ive got the best damn case you could hope for.

 

So while the war still rages on, i have one this battle, at least in the meantime.

next move is to see what Littlewoods say to experian.

 

and wait to see what Experian say to me.

 

IF (and this is a big IF) Experian putthe info back on, without signed consent, and without CCA, i will issue them a letter before action as, now they are known as DATA CONTROLLERS, have to obtain proof if asked

 

If Littlewoods dont give up, ill take them to court as well and get an enforcement order for them.

 

I have however today, sent off a cheque for my credit reports from Equifax, and Call Credit, and if Littlewoods is on there, then they get the same letter Experian got

 

if littlewoods dont want to give up, ill give them all the paperwork they can handle.

 

PS - ordered new copy of Experian report on Tues, that should be here fairly soon

ultimately i want written proof from either the CRA's or Littlewoods that the info will STAY off my file. because then, it can never be disputed again.

update to this

experian have yet to tell me of their findings with littlewoods.

ICO still has not assigned my case to a worker (from july)

and Equifax have contacted littlewoods and littelwoods say that i have been told on numerous occasions by their legal team that they are right and i am wrong.

dont know what to write back to equifax to be honest, as i sent them the same letter that made experian cack themselves.

im am about ready to leave the default on there, i cant seen an option but court, but im not good enough myself to do it, and cant afford the costs of a solicitor if i was to lose!

MAJOR UPDATE TO THIS

 

believe it or not the ICO have found in favour of littlewoods saying that if i want ill get the wrong date of birth and WRONG starting credit date fixed.................

 

 

They have passed the buck and said that they do not deal with sections 77 and 78 of the CCA and that i should contact the OFT.

 

 

can you believe this?

 

i forgot the letter today, but will bring in it tomorrow, scan it and post it as its too long to type.

 

What can i do now, complain to OFT or just seek legal advice...........

Unbelievable I've been reading all day about other Littlewoods cases and strangely in every one I have read the ICO have found in favour of Littlewoods and the FOS have refused cases from before April 2007.

I'm now wondering who keeps an eye on the ICO and who you would complain about to them because quite frankly after all my hours of reading history keeps repeating!

have a look in the pdf I have attached, this is what Experian were sending out in 2002. There is a bit about Information Commissioners Office can rule, if data is disputed. They seem to have change their tune of late.

How many chances are you going to give them?

 

If you threatened 14 days then N1 then do it .... you have exhausted all other avenues as far as I can tell.

i phoned up littlewoods and they gave me a different address for their legal department/company secretary

 

so i will copy all correspondance to them, and give them 14 days.

 

then its N1 time

 

what i would like is a little help on what i can do for N1 and POCs
