    • Well, we live on the same road so it should be the same postcode. When I spoke to dpd and asked why were my neighbours' address not on the list and she said maybe they're not of the same postcode and I checked and they definitely were.
    • again a quick google search states Appeal a DVLA fine - GOV.UK (www.gov.uk) i would not be appealing mind. it's only a summary charge which they rarely do court on and pass out the powerless DCA's whom are not bailiffs they have 6mts. see where they go. as you've sorn'd it will probably be nulled. dx
    • There are a number of reasons why you may not have been issued a notice in the post within 14 days. If you were stopped by the police it may have been given verbally. In the case of speeding offences, the police may issue you with a conditional offer of a fixed penalty of 3 points and £100.00 fine by post or an offer of a speed awareness course. If the offence is considered too serious for a speed awareness course or fixed penalty you may be charged with an offence which normally occurs by way of the issue of a Single Justice Procedure Notice. If the vehicle within which the alleged offence took place was registered to another person or company there is technically no need for a notice to be issued to the driver. After the police have obtained details of the nominated the driver, they will normally send the notice to them, although there are no time limits within which they must do so (provided that the notice was received within 14 days by the registered keeper of the vehicle). In such circumstances, a person may receive a notice several months after the alleged offence too place but still be prosecuted. A Guide to a Notice of Intended Prosecution | Motoring Offence Lawyers the above copy n paste link has purely been copy n pasted here to inform you of the regs, which you could have done yourself by, as this is, a google search......... we do not ever recommend using such offered webservices! dont dx
    • all DYL's are subject to a TRO. looking at this newish, ever increasing as old ind units have gotten removed, estate, there are only lines on one side, on the other there is a parking lane with traffic calming through which you mention. i seriously doubt your mate has any clue what he is talking about.!! its not a private housing assoc estate. so its a public council owned road. no construction co can just decide to draw their graffiti on a road. the DYLs are certainly there pre 2016 even before his home was built. now ive had a quick look to see if the main access to royal park road has signs. there is no royle park road even on your map but there is a royal barn road which leads to where you are parked royal road has a restriction sign on the pole by the fence of the electric substation jnc with gipsy lane there does not appear to be one leading in from the other end - tesco petrol station

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You know what I would really love to know? Which company pays their wages. And who is named on their contacts of employment.

A certain "team leader Cabot Financial" mentioned in a previous post started work in my company a little while ago:cool:. This could be very very useful especially if she keeps in touch with her old mates. Keep y'all posted.

Very good. Huge differences in culture like Romania perhaps, Chechnya or possibly Uzbeckistan? I think they may find some peoples are not as restrained in their dealings as we Brits. Excellent

Cabot's 'Spanish' company

Debt recovery with quality and commitment

Oh come on you're boring me - lets post something useful shall we? All this professionalism is getting to me. Once signor Maynard is out there its gonna go belly up anyway.

What shall we put? a few sales agreements perhaps, an Irish MBNA DOA? A few blogs of their staff - a few names perhaps - lets spice it up a bit... who's next?

What about the fact that the Debt Buyers and Sellers Group have a member who never buy or sell debt amongst them :o - who? Cabot Financial (Europe) Ltd and who is the chief exec at DBSG at present ? Ah, Kenny Maynard himself..credit controller extrordinaire. :D

Page 5 - It's our KM without a tie -- Wow, Cabot actually doing something for charity? Well, not really...It's the staff who buy the raffle tickets..Typical, the staff do all the work and KM gets the pics and the credit for it.

KM (?) says (and I quote) : "An ethical and responsible approach is the bedrock of Cabot Financial's culture" ... yeah, right-o Ken

Here's another recent snippet from Cabot, once again they bang on about ethical collections:

Cabot Financial is the pioneer and market leader in consumer debt purchase in the UK. Formed in 1998, we currently own more than 1.6m customer accounts, with a cumulative face value in excess of £3.2bn and listed as No.38 in The Sunday Times Deloitte special report on Britain’s Top 100 performing privately owned companies (Feb 07).

Cabot’s continuous development and expansion has resulted in established strong, long-term relationships with the major UK and European lenders. Our mission is to maintain and continually improve our position, sustaining excellence through ethical collections and focussing our people to achieve their personal best.

Providing the highest standards of service, integrity and expertise makes it easy for originators to work with Cabot as the partner of choice.

Two things here pmhcfc, First is I owe the man an apology - I almost can't bring myself to do it, but being the principled old dear I am - here it comes:

1st) Mr Maynard I said you never give to Charity cos it says so in your accounts that £0 went to charity. So I take it back, Helen Rollason was a great gal. Good to see you doing some good for once. There's a few debt counselling charities that could also do with some, but I take this as a good start.

2nd) Why the feck do you have to spoil it by promoting the low life company Cabot is by using this photocall to promote Cabot, its expansion and all the dross and misery your company generates for the 'customers' by making it sound glamorous and like it's a useful company like manufacturing that is expanding and doing something for the community? Don't you see stress is the biggest cause of Cancer this country has and Cabot are causing more stress and misery than any other dca out there?

Not sure if they actually give anything themselves Andrew..The report says that the money is raised by STAFF buying raffle tickets etc. And a staff member's husband running the marathon, donations are from STAFF, family and friends. Also, money is raised through the Xmas raffle..Tickets bought by STAFF. I've worked for companies a lot bigger than Cabot and the Xmas raffle prizes are normally donated by other companies and local business. But you're right that Helen was a great gal.

And, as a footnote, not that I'm suspicious of the antics of Cabot, but it's a strange coincidence that the guy who ran the marathon is the husband of the lady who was nominated (working for Cabot) for a Business of the Year award 2007...Of course it has nothing to do with earning Brownie Points for the said member of staff who was up for the award...

1st (observation)Reading between the lines it's the staff who raise the cash - the guy in the picture ran the London Marathon and was sposnored by various folk. It's hardly a slice of the company profits.

2nd (observation) yes it is a bit rich isn't it? Whatever way Maynard and crew like to wrap it up they bring misery to their fellow man. Giving a bit of cash to the odd charity isn't going to alter that fact. End of story.

I say vulture!! the man is a vulture - end of story - bet he can't even spell ethical - let alone do ethical trade?

Unless of course the "ethical" part of his business is the recycling of paper? Me wonders if that's where all our CCA's went - he recycled them into RAFFLE TICKETS FOR HIS STAFF TO WORK HARD SELLING - SO HE CAN STAND SMILING AND CLAIM HE RUNS AND ETHICAL BUSINESS? ;) Maybe that's the answer?:D
