    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Do they let you bring a cairry oot in the court, I wonder? We could make a party of it.

There's a nice court here.

A river and some benches across the road. I usually go down early so I can watch the solicitors pulling their little old lady trolleys along. Full of their heavy bundles for the day. They always wave. Been there that often they think I'm one of them.

 

Time the prelims to start with the Summer. Cite everyone as witnesses. Cabot can pick up the tab. Wages and travel expenses. Sweet.

I'm now ready to pick a fight with Cabot. 2 Summary Cause claims now being served. They were warned often enough and chose to refuse the option of not going to court. I know they read this forum and want them to know this is coming.

 

Here are my terms:

March straight back to West Malling, stopping at every home to beg forgivenes.

 

Here is my battlefield:

 

Protection from Harassment Act 1997

 

Prohibition of harassment:

 

1. - (1) A person must not pursue a course of conduct-

 

(a) which amounts to harassment of another, and

 

(b) which he knows or ought to know amounts to harassment of the other.

 

Civil remedy:

 

3. - (1) An actual or apprehended breach of Section 1 may be the subject of a claim in civil proceedings by the person who is or may be the victim of the course of conduct in question.

 

(2) On such a claim, damages may be awarded for (among other things) any anxiety caused by the harassment and any financial loss resulting from the harassment.

 

When I'm finished with Cabot (europe) Serving on Cabot (UK) who are I believe responsible for the actions of their agents.

I have read through this entire thread and havent laughed so much in a good while. Louiboy, goan yersel mate. I am starting a thread with my own sorry debacle of a cabot fight but want to wish you the best of luck with your up n coming battle. We'll all be staying tuned.

 

I can only imagine their office meeting trying to figure out what to do about you now pmsl.

i really don't think the FOS, TS, ICO are really gonna do anything about Cabot or other DCAs.
Not unless the volume of complaints is high and hits a level where they have no option to act. Then they'll probable just pick on a few little ones. Only good thing is the man hours involved in dealing with the paper work. Costs the DCA's time and money.

 

The only real option is to demand proof of the DCA's actions and authority all the way face them in court and hit the balance sheet where it hurts.

I've had a letter from Hodsons as part of my pre-litigation invitation.

Previously they had made an offer to give me a good ass kicking.

I made the counter offer of Court action.

 

They've reassessed the situation and made another counter offer.

Indicated any action will be vigourously defended.

That's a hefty climb down from the initial offer of a good ass kicking.

 

Hope they are not planning to defend with bad breath, colourful language and a feather duster!...

 

My strategy is now clear. Inform Cabot (E) of my terms, if they refuse initiate legal action. When action is commenced move onto the next problem. Not forgetting Cabot (UK)

 

This week the Cabot (E) files are on their way to Trading Standards West malling.

Close inspection of the S.A.R - (Subject Access Request) files from Cabot (E).

 

Both Cabot (E) and (UK) will be hearing from me on a regular basis for the next year.

The FOS say they cannot do anything because the complaint has to be on something that occurred after 6 April 2007.

 

The ICO say that if the company has corrected the wrong information then they are OK now (no comment/answer to the 5 unlawful defaults for the past 4 years and no proof of consent to carry on processing my data).

 

Trading Standards keep passing me to a debt advisor within my local council as they say its a 'debt' issue and i may need advice. I keep telling them to do their job and process my complaint.

It would appear that most TS offices seem to be unaware of our rights etc regarding the CCA & DPA. Either that or they are ignoring our complaints. Maybe they are becoming inundated with these type of complaints, and simply cannot cope with the workload!

 

Anyway, I for one will keep chipping away at them!

Cabot sends a letter. Quincy notices something that causes him to suspect foul play. Quincy's boss gets upset, believing that Quincy is seeing evidence that doesn't exist and he should go back to the day job. Not one person is allowed to point out that there are probably bodies rotting in the aisles, considering the amount of time he spends investigating just one letter.

Today I was picking through my S.A.R - (Subject Access Request) from Cabot. Noticed something peculiar. Stopped me in my tracks it did. HELKC1 duplicate hello letter from Cabot. Must be an original hello letter sent previously. Back to the beginning. No sign of HELKC1, found CFHEL2 (CFHEL2 Clydesdale Bookon Trace) sent to account holder. Is it something to do with Clydesdale Finance (CF)?

 

Lady luck showed up with a helping hand, found in a folder 2 letters sent on the same day from both Clydesdale Finance and Cabot. So long, farewell, auf Wiedersehen, good night. Hello! Hmmm!

 

Individually there's nothing of note about the letters. Side by side it's a different story. Same font (Windows Times New Roman), default leading, default kerning, default line spacing. Not beyond the realm of perception that 2 companies at the opposite end of the country could produce and sent 2 letters on the same day in an identical typographical style to the same person.

 

Quincy became curious. Scanned sections of the letters at 600dpi. Assembled a collection of letters in the same font, default style and created a few identical letters for comparison.

The top 2 are from the Hello and Goodbye letters. They are reasonable similar. Slight difference in the spread of the toner. Uncoated paper was used for No 1 letter, coated paper for the other. Laser printer produces sharper results on coated paper. You can see on the first one where the toner has spread more on the rough surface. No 3 comparison. The ascender (long downward stroke) on the Y is thinner. No 4 comparison The serifs (tails) on the top of the Y are shorter than the Hello, Goodbye type. The dot on the tail of the Y is also thicker. No 5 comparison. Somebody needs to buy toner for the printer it's about to run out.

 

Quincy found it very strange that 2 different laser printers almost 300 miles apart produced an identical result on the same day. When the sample groups were overlaid for comparison only 2 letters were a close match. Guess which? There's even a small printer spot/defect 3.5 cm in from the page margin on each letter. blob.jpg

That's a quincydence. To much of a quincydence.

 

Quincy solves the case, then explains everything over breakfast/lunch/dinner with his pals. The only possible explanation, given the available evidence is that both letters were printed on a laser printer in West Malling on the same day.

 

Dammit!... "I don't like it Quince, I don't like the looks of this Quince".

 

Does that mean the assignment was not completed. Looks like the original creditor never completed their part of the deal. Cabot sent both letters. Something smells bad.

 

Just following the trail of evidence...

It is like I said Andrew1, I have a letter "from" Bank of Scotland and Barclaycard. Two completely different companies, yet both of these letters are the same word for word, even the font is the same.

 

I find this very strange as my friend works for Barclays and he has confirmed that they have their own special font call Barclays Serif Regular, which is part of their corporate identity..

 

*Legal Disclaimer - I am not suggesting for a moment Cabot would dare write letters on other companies headed paper.

 

*Reality Check - Sorry, yes I am.... They even confirmed this in my SAR they said they would produce bank statements and print them on BOS paper.

tbern, you don't have to perjure yourself by suggesting that they use other companies headed notepaper - they print their own with the banks logo and details in my opinion they couldn't possibly arrive with such precision both in the same envelope as mine did.

35mm for the left at the bottom 10mm up. Is it legal to produce a document claiming to come from another company on their headed note paper?
