    • Hello, You can't make EVRi investigate something. The only thing you could potentially look to do is take EVRi to court for the value of the lost parcel, however with a value of only £25 there will be limited point to doing that.
    • Is the letter headed Letter of Claim/before Claim or similar? If not, it sounds like more of the threatogram chain. If you're not sure, post up an anonymised copy of the letter and we'll check. HB
    • So guess what, we have received a final demand letter for £100. It states if payment is not made by 11/06 they will have no option but to forward the case to their litigation dept with a view to commence County Court Proceedings. So just wondering if anyone has any advice. Do we ignore this? or do we need to take action? Thanks

    • Thanks for the reply and clarification, that might just explain why in my case contact has pretty much ceased. Though with such companies it doesn't mean they won't ever threaten to return to court as a tool to force one's hand if they feel they are not self informed on their chances etc.  But concerning how last year they tried to use the CCJ to get a charging order and the court granted an intirum order on our mortgage using the CCJ that would have been a good 2-3 months beyond the 6 years, should the court not have checked the age of the CCJ in the first case or would they always grant an interim order simply off the back of a CCJ being produced without even checking the age of it?.  Had I not defended that action at the time they may well have got a default using a CCJ older than 6 years which could be a concern going forwards. At the time when I contacted the court to question the paperwork for a final order application the clerk suggested people don't get informed when companies apply for interim charging orders, they are automatic if a claimant has a CCJ and people only get contacted once a date for a final order application goes through. kind of begs the question if such companies can continue a seemingly backdoor method to attempt default action if un-defended if the initial application doesn't need to check the age of a CCJ?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im not too sure what would happen with the wrong information in your Statement of Claim, It may be well worth giving the court a ring and see what they recommend.

in N1, spreadsheet and Statement of claim i have a breakdown of the charges(ppi+interest+8%+£120) Total £xxxx.... and they are correct

 

I have just noticed that on the page x in my statement of claim:

 

The claimant has calculated the claim using the following calculation.

 

Claim for charges, and interest paid on those charges scheduled separately:£1,146.36

Claim for consolidated loan interest added to 1 above:£778.06

Claim for interest on consolidation loan interest claimed:£118.46

Court fee: £120

 

Total Claimed £2162.88

 

Alternatively, the Claimant seeks damages of £2162.88 in regards to the Defendants clear breach of the Claimants human rights as prescribed by Article 1 of the first protocol of the Human Rights Act 1998 whereby the Defendants actions did cause the Claimant to suffer personal loss to the sum of £2674.24.

I phoned to the court..and they do not know what to do..they advised me to seek a legal advise or amend the claim with £35....

Feel a bit stupid..and very lost...Do i amend it with judge? or just leave it as it is.

On all other forms the total amount is correct.....

Hi Itsme,

 

I have only claimed the 8% interest. I'm not stressed about it at all at the moment! I just put the form in and now i'm waiting to see if they defend. I honestly thought that it was quite likely they wont defend as if they do and they lose then they have the possibility of every one of their customers making a similar claim? That said, i have not found any threads on here from anyone who has taken them to court - let alone won! yours was the first i have seen. As far as i can see we both have valid claims and it will be against Welcomes interest to fight them and lose. That said i know what arses this company are and i would be willing to bet they will drag the cases out for as long as they possibly can.

I belive 2 people won WF claims..but i think i was before court...everybody else just left it undone...Hopefully WF will not defend neither in my case no in yours:)))

Hi Its me,

I think I would just leave the claim as it is for the momment, I doubt very much that they will go to court over the claim. I may be wrong but Im sure others will correct me here if that is the case.#

Hiya

 

i am in the process of ttrying to get my money back for PPi from welcome finance.

 

I am trying to figure out how to calculate the interest. not the court interest but the amount that would have been put oon the pii as it was added to the loan

 

my loan amount was 1500

ppi cost 320.81

 

apr was 44.6 and monthly interest was 2.75 %

 

so how on earth do i figure it out???

 

do i just work out the monthly 2.75% figure from the date i took out the loan until the settle ment date???

 

i confused llol

no....it means that they are taking 28 days to prepare defence....the other letter said ..till 27/03/2007 to REPLY:)))

Well thay have replied and took 28 days...to defend themselfs..

They will now have 28 Days from the date of Service to submit their defence, No doubt they will leave this to the very last minute too.

 

I have AQ now from Court so will be getting that Back ASAP, let them know I mean Business..lol

Hi Its Me Just recieved my answer from Welcome looks i too have 28 days to get them to court they sent me letter today still offering me £315 as a goodwill on their behalf but they do not feel the PPI was missold that it was voluntary so you are not alone Archie

Thank you, Bankworthnightmare....very helpfull:))) But i am more than sure WF is taking as much as possible time to make claimant to change their minds, scare tham...i am taking it to the end...In some other cases they started to make some offers to the claimants...to shut them up...(never happend to me))))

Good luck with your claim against Welcome - I hope they pay out.

 

Part of my job involves getting Welcome to pay their bills - it's like getting blood out of a stone!

 

I'm glad to see Welcome are getting some stick as they are pants.

 

You might be interested to know that Welcome offer their employees some pretty good incentives to meet their targets such as exotic holidays abroad, trips to posh hotels in Paris, meals out and huge cash pay outs! So their employees are probably using every trick in the book to get good results. I bet they have targets on getting customers to sign up for PPI so it's not surprising me there are so many mis-selling claims.

banksworstnightmare - has anyone taken them to court for the money they owe, you can always pm your answers :)

 

I am preparing to go to court, I have my schedules, forms, particulars sorted just waiting to hear from someone and then off to file.
