Hi there,

I have been posted approximately 15 letters with a fine from “comune di milano polizia locale” from 2020

they have instructed a international debt collectors to collect the outstanding amount.

How do I get out of this

please I need help and advise as I don’t have that sort of funds.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Yep.

I too have moved from Italy to Britain in the past, with traffic violations in Italy pending.

I volunteered my British address to the Italian authorities and told them to actually get on with court action in a British court instead of just coming out with idle threats.

I'm still waiting.

Excellent news.

Instead of any actual court action, you've just received a silly "threatening" letter from a toothless paper tiger who can't do anything as it's not their debt.

Article 1193 of the Italian Civil Code applies only in, er, Italy.

Whilst I concur with  'ignore', please bear in mind that if you revisit Italy with the same vehicle, it is possible that their system could flag up your visit with possible clamping.

I do not know the mechanism in Italy, but it is something to bear in mind should a subsequent visit be contemplated. Perhaps someone more familiar with Italian procedures could advise?

i would suspect that as in the uk this is now well out of time (2020) and its been passed to this lot to see if they can mug you along with 10''000's of other people .

almost certainly again, like the uk, the authorities are not allowed to use any the anpr to detect where you are and mug you either

a dca unless they OWN a debt cant do court (and gov't debts are NEVER sold) .

Can you imagine how many unpaid tickets there must be in a city like Milan?  They will have enough problems trying to enforce tickets against people living in Italy and will do nothing about those moving abroad with all the massive hassle involved.

In fact, if they could they would have done so years ago
   - original sanction
   - reminder letter
   - threat of legal action
   - legal action started.
Instead they're still faffing around after 15 letters!!!

I've been there, done that, nothing happened.

Following Gick's question, I looked up what they can really do, which is start the legal process in Italy and send the equivalent of the bailiffs around and even give you a 90-day driving ban ... if you live in Italy.  These sanctions BTW are against the person, not the vehicle.  But none of this will happen unless you move back to Italy and take out residenza, and even then only in theory and only for a limited time.
