    • We don't know of anyone on this forum who has had RLP organisations or bailiffs arrive at the door. They're going to threaten legal action because they think you may not know that they aren't able to carry this out and could be more likely to pay them. HB
    • Has anyone that you have known or posted on this forum received knocks on doors from them or received a ccj and been sent to court or have sent bailiffs or gave the debt to another company. if they don’t have any legal powers why do they threaten with court action 
    • Ok, so just been to see my friend, she still has her head firmly in the sand and had a pile of unopened post, thankfully nothing serious apart from this case!    In answer to your question it says N24 General Directions Order at the bottom of the page, then on page 2 where the line says "As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court) " this is N271 Notice of transfer of proceedings.  Within the stack of letters I found 2 from Kearns Solicitors,    02-12-2022 Document pack with covering letter stating under the s78 CCA please see enclosed  1) A copy of the executed Credit Agreement, 2)  A copy of the terms & conditions 3) A copy of the varied terms & conditions applicable at termination / assignment, and  4) A statement regarding the conduct of your account as requested by s78(1)(a) to (c)  (Would you like me to describe the documents attached?)   18-02-2023 Generic letter asking for her to contact them to discuss settlement or they will take to court for further legal action. 
    • well you made the cardinal sin by phoning these scammers at least once so their persistence could go on. however you are new so there you go. you never ever ever phone any of these likes of scammers on these fake schemes that seem plausible.  just like a DCA chasing any old debt .. they are NOT BAILIFFS and have  ZERO legal powers to actually do anything. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My niece dropped a perfume bottle on the toilet cistern tank cover, and being ceramic a corner piece chipped off. Its an old toilet so not easy getting a replacement lid possibly (£75) or full toilet replace £450. in this situation what is she liable for, could she just repair the lid with a good ceramic porcelain adhesive. If this is not acceptable what would the landlord fairly expect to happen ?

I think the first thing you need to find out is whether she is in this property for the long-term and whether she wants to keep good relations with her landlord.

I would say that a repair using glue will be not acceptable. I would be looking round for a replacement lid – and maybe you can find one on eBay.

The landlord is entitled at least to that. If you can't find one that matches the system then the landlord would be reasonable in requiring a completely new toilet although deductions would have to be made for the length of time that your landlord has had the toilet without any problems.

So, if the toilet has been in place for 20 years – and if your landlord expected to have the toilet for another 20 years then your liability might be 50% of the cost of replacement including installation.

I think the thing to do is to open a very friendly dialogue with the landlord begin by apologising. Better to tell it yourself than have it found accidentally later on

Hi

I have to agree with Bankfodder on this and it is also best to be upfront with the Landlord.

As for the toilet cistern cover as mentioned have a look on ebay or do an internet search for local reclamation or salvage yards in your area also

Normally the Landlords Building Insurance would cover it.

We could do with some help from you.

Hi

Yes I agree the Landlords Insurance may cover this but the Landlord could take a hit with the Insurance Company when they come to renew increasing the Landlords premiums.

The issue is the damage was caused by the Tenant that is in residence at present although accidental it was still damage they caused.

Replacement toilet cistern lid should not be difficult to find if they are standard colour. There are reclamation yards that hold large numbers of old bathroom fittings. 

Think I would try to find replacement over a few weeks and then if one cannot be found to contact landlord.

We could do with some help from you.
